Book excerpt: The 1989 UN Convention on the Rights of the Child has inspired advocates and policy makers across the globe, injecting children's rights terminology into various public and private arenas. Children's right to participate in decision-making processes affecting their lives is the acme of the Convention and its central contribution to the children's rights discourse. At the same time the participation right presents enormous challenges in its implementation. Laws, regulations and mechanisms addressing children's right to participate in decision-making processes affecting their lives have been established in many jurisdictions across the globe. Yet these worldwide developments have only rarely been accompanied with empirical investigations. The effectiveness of various policies in achieving meaningful participation for children of different ages, cultures and circumstances have remained largely unproven empirically. Therefore, with the growing awareness of the importance of evidence-based policies, it becomes clear that without empirical investigations on the implementation of children's right to participation it is difficult to promote their effective inclusion in decision making. This book provides a much-needed, first broad portrayal of how child participation is implemented in practice today. Bringing together 19 chapters written by prominent authors from the United States, Canada, the United Kingdom, Ireland, New Zealand, Australia, and Israel, the book includes descriptions of programs that engage children and youth in decision-making processes, as well as insightful findings regarding what children, their families, and professionals think about these programs. Beyond their contribution to the empirical evidence on ways children engage in decision-making processes, the volume's chapters contribute to the theoretical development of the meaning of "participation," "citizenship," "inclusiveness," and "relational rights" in regards to children and youth. There is no matching to the book's scope both in terms of its breadth of subjects and the diversity of jurisdictions it covers. The book's chapters include experiences of child participation in special education, child protection, juvenile justice, restorative justice, family disputes, research, and policy making.

Book excerpt: This multidisciplinary volume offers an essential, comprehensive study of perspectives on the scope and application of the best interests of the child and focuses mainly on its application in relation to child custody. With expert contributions from psychological, sociological and legal perspectives, it offers scientific analysis and debate on whether it should be the primary consideration in deciding child custody cases in cases of divorce or separation or whether it should be one of several primary considerations. It explores complex dilemmas inherent in shared parenting and whether the advantages it offers children are sufficient when compared to attributing custody to one parent and limiting visitation rights of the other. Offering a comprehensive analysis of this complex topic, chapters provide detailed insight into the current state of research in this area, as well as expert guidelines aimed at resolving the controversies when parents agree or disagree over their children’s living arrangements. Cutting-edge topics explored include: transnational shared parenting; alternative dispute resolution; breastfeeding parents; religious disputes between parents and the psychological, social and economic factors that affect shared parenting. The Routledge International Handbook of Shared Parenting and Best Interest of the Child will be essential reading for scholars and graduate students in law, psychology, sociology and economics interested in shared parenting and family law.

This book was released on 2020-11-29 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: This revised second edition analyses social policy in Scotland since devolution in 1999 and reflects the nascent and distinctively Scottish policy agenda. Along with updated chapters, there are two new inclusions: a chapter analysing post-devolution Scotland and a chapter on the likely impacts of Brexit on and within Scotland. Providing diagrams, tables and a range of activities, the book maintains an innovative and pedagogic emphasis to introduce students to a wealth of materials, ideas and practical responses to the increasingly complex and diverse situations faced by social workers and other professionals. Part 1 of the book looks at what social policy is, how and why it is made and highlights the importance of the relationship between social policy and the law. Part 2 refers to specific themes of social exclusion, poverty and (more visible for this revised edition) austerity, considering their complex and multidimensional forms and discussing the range of policies currently extant that aim to combat such disadvantage. Part 3 provides a comprehensive overview of policy for practice, considering concepts of health inequality, mental health, older people, disability, children and families, education, substance use, criminal justice, asylum and immigration and homelessness. This book will be of interest to undergraduate and postgraduate students as well as post-qualified professionals seeking to understand the complexities of the social policy landscape in Scotland, and its influence on social work and related forms of professional practice.

Available in PDF, EPUB and Kindle. Book excerpt: This book considers whether coercive control (particularly non-physical forms of family violence) should be prohibited by the criminal law. Based on the premise that traditional understandings of family violence are severely limited, it considers whether the core of family violence is power-based controlling or coercive behavior: attempts by men to psychologically dominate their partners. Such behavior can cause significant psychological, physical and economic harms to victims and is increasingly recognized as a form of human rights abuse. The book considers the new offences that have been introduced in England and Wales (controlling or coercive behavior), Ireland (controlling behavior) and Scotland (domestic abuse). It invites consideration of three key questions: Do conventional criminal laws adequately regulate non-physical abuse? Is the criminal law an appropriate mechanism for responding to the coercive control of family members? And if a new and distinctive offence is warranted, what is the optimal form of that offence? This ground-breaking work is essential reading for researchers and practitioners interested in coercive control and the proper role of the criminal law as a mechanism for regulating family violence.

It analyses the varying approaches in England, Scotland, the US and the Netherlands and addresses major questions of dispute resolution, redress, judicial and non-judicial approaches and the protection of citizens' rights. The first review of mediation in citizen v. state disputes outside the context of the courts, this topical book also incorporates findings from a recent ESRC study into dispute resolution in special educational needs cases. It will not only be of interest to those concerned with education issues but also those interested in administrative justice, especially the role of mediation generally

Available in PDF, EPUB and Kindle. Book excerpt: The collection aims to inspire readers with new approaches to implementing and monitoring the United Nations Convention on the Rights of the Child, to make rights ‘real’ in children’s lives. Children’s human rights are internationally recognised in the legally binding international treaty—the UN Convention on the Rights of the Child, the most ratified of all human rights treaties. Although measures are increasingly being taken to implement the Convention at a national level, more needs to be done to ensure that children’s rights are recognised and supported in their daily lives. This collection brings together the latest research on new approaches to embedding children’s rights into national law and policies, with contributions from academics, practitioners and importantly young activists, from the UK and beyond. This book will be of interest to all human rights advocates, particularly policy makers and practitioners looking for new ways in which to make children’s rights real. The chapters in this book were originally published as a special issue of The International Journal of Human Rights.
