Le bilan des efforts déployés récemment sur la scène internationale pour réaliser un tel renforcement, ayant débouché sur l'élaboration du très controversé ACTA, démontre que la réponse à cette question ne peut être ni simple ni immédiate. Evaluer l'opportunité et déterminer la nécessité de renforcer cette protection ne peuvent se faire qu'après un examen approfondi des solutions juridiques, existantes déjà dans les dispositifs nationaux des deux Etats qui assurent chacun une protection efficace des droits des auteurs, tout en adoptant des approches diamétralement opposées en la matière à savoir, la France et les Etats-Unis. Une fois ces deux droits comparés, une inégalité dans le niveau de protection ressort, appelant des améliorations qui passent par une intégration d'institutions juridiques « venues d'ailleurs ». Cette intégration qui aura pour résultat d'harmoniser ces deux droits, dans le respect des particularismes nationaux, pourra se réaliser à l'aide du droit comparé. L'harmonisation des droits nationaux dans le respect de leurs différences est aussi l'oeuvre du droit international surtout lorsqu'il s'agit d'une matière qui ne peut être traitée qu'à l'échelle internationale, voire mondiale. Pour pouvoir comprendre les raisons de la persistance des différences entre les deux droits menant à cette inégalité, l'examen des instruments internationaux adoptés en la matière, censés harmoniser la protection du droit d'auteur, est indispensable. Le bilan de cet examen s'avère mitigé dans la mesure où, les spécificités nationales l'emportent, bloquant ainsi le processus d'harmonisation. Or, le droit comparé a comme rôle principal de préparer un terrain favorable à une harmonisation internationale réussie, en dégageant des solutions concrètes, pratiques et surtout adaptées puisque ne heurtant pas les traditions juridiques nationales qu'il aura réussi à identifier.

Dans une première partie, la comparaison des différentes oeuvres protégées et les conditions d'application de cette protection met en lumière la similitude des problèmes rencontrés, similitude qui a permis une évolution interne autonome comparable dans des systèmes a priori divergents. Bien que des différences apparaissent au niveau des fondements des deux systèmes, il existe beaucoup de traits commùns induits par des impératifs pratiques, notamment dans le domaine des nouvelles technologies. Dans une deuxième partie, la comparaison des droits accordés et de la gestion des atteintes licites ou illicites aux droits d'auteur met en évidence les dérives connues par chaque système : les droits d'auteur vers un aspect plus économique, le copyright vers une personnalisation de la protection. Peut-être tout simplement parce que la protection la plus adaptée aux problèmes rencontrés par les titulaires de droits est un juste milieu entre ces deux notions. Le droit d'auteur arbitre en effet un jeu délicat entre divers intérêts particuliers qui ne coïncident pas toujours : intérêt de l'auteur, du public, du destinataire de l'oeuvre et des intermédiaires sur le marché. Olaceer le créateur au centre de ce jeu n'est pas toujours réalisable et réalisé en pratique. Des deux cotés de l'Atlantique, la protection devient finalement la rémunération du travail de création ou de la prise de risques et le fait que les investisseurs puisssent être protégés pour leur rôle participatif à la création témoigne de la recherche d'un équilibre pour un système plus performant.

En effet, face à son souhait de voir son investissement artistique récompensé et protégé, il se dresse un public aux revendications nouvelles. En quête d’un accès gratuit à une multitude d’œuvres, ce dernier conteste d’abord le monopole de l’auteur et favorise l’apparition d’intermédiaires qui, en générant de nombreux profits sans rémunérer le créateur, sont à l’origine d’un phénomène de captation de valeur. Désireux de participer activement à l’accès en diffusant les œuvres à ses semblables, il s’est ensuite érigé, par l’accomplissement d’actes d’exploitation, en contre facteur. Dans ce nouveau contexte, d’autant plus complexe que l’activité du public et des intermédiaires participe à la visibilité des œuvres d’art, la recherche d’un équilibre pour mieux protéger les droits d’auteur est apparue indispensable. A cette fin, différents mécanismes techniques et juridiques ont dû être adoptés.

La surprotection de ces mesures permet une maîtrise de l’accès à l’œuvre, qui est étrangère au droit d’auteur. Une étude des modes de limitation de la protection juridique des mesures techniques confirmera la nécessité de maintenir l’équilibre des intérêts, grâce à différents mécanismes visant à modérer les effets indésirables de ces mesures sur les exceptions au droit d’auteur et sur d’autres intérêts.
