Book excerpt: La entrada en vigor del nuevo Reglamento General de Protección de Datos refleja un nuevo panorama cuyo fin es consolidar un tratamiento armónico y homogéneo del derecho fundamental a la protección de datos personales en el ámbito europeo. En lo que respecta a su proyección internacional, incorpora modificaciones en los criterios que delimitan el ámbito territorial de la normativa europea, más concretamente, en el propósito de garantizar su aplicación al procesamiento de información de personas ubicadas en la UE asociados a comportamientos dirigidas a su territorio.La presente investigación analiza la opción que integra el Reglamento 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016 de litigar en el propio domicilio del demandado en concordancia con la esencia protectora de esta norma. Por añadidura, la interacción con el Reglamento Bruselas I bis deriva en una extensión de los foros disponibles y en mejores líneas de defensa para el demandado, líneas que pueden ser ampliadas en función de lo acordado en el contrato. Por otra parte, en materia de ley aplicable, es indiscutible la ausencia de novedades que nos condicionan a mantener los criterios autónomos tradicionales.El siguiente punto de reflexión lo debemos dedicar a las resoluciones judiciales en materia de salvaguarda de derechos de la persona y en particular de protección de datos, pues la interpretación jurisprudencial procedente del Tribunal de Justicia de la Unión Europea y del Tribunal de Derechos Humanos de Estrasburgo constituyen una garantía adicional sumada al trabajo que desarrollan los tribunales nacionales.Como resultado, la protección de datos ha planteado diversas barreras en materia de competencia judicial y determinación de ley aplicable, sin embargo, mediante el nuevo Reglamento se persigue constituir un régimen de Derecho Internacional Privado adaptado a un entorno virtual interconectado que no podemos obviar, por lo que se hace necesario como ya hemos venido apuntando, una intervención legislativa de carácter supranacional.
