Book excerpt: An Introduction to the Philosophy of Law: Large Print By Roscoe Pound The latter, he says, can be just only with respect to those things which by nature are indifferent. Thus when a newly reconstituted city took a living Spartan general for its eponymus, no one was bound by nature to sacrifice to Brasidas as to an ancestor, but he was bound by enactment and after all the matter was one of convention, which, in a society framed on the model of an organized kindred, required that the citizens have a common heroic ancestor, and was morally indifferent. The distinction was handed down to modern legal science by Thomas Aquinas, was embodied in Anglo-American legal thought by Blackstone, and has become staple. But it is quite out of its setting as a doctrine of mala prohibita and mala in se. We are delighted to publish this classic book as part of our extensive Classic Library collection. Book excerpt: Excerpt from Lectures on the Philosophy of Law: Designed Mainly as an Introduction to the Study of International Law As practical arts invariably precede science, law first appears as Positive Law This does not necessarily involve the existence of a legislative body or a king, or even a judicial tribunal, for we find rudimentary traces of law before these exist in any form. But when law has become separated from other social phenomena, and where, as in active communities, there is much intercourse between individuals, its growth is rapid and its bulk often overwhelming. This was one of the causes of codification in the time of Justinian, and this is also the cause of the agitation for codification in our own day. The objects of a code in such circumstances are practical. They are, first, the instruction of the student of law, and, secondly, the necessities of the practising lawyer or judge. Setting aside compilations in the form of dictionaries, we have various codes, digests, and treatises, arranged on some definite principle. Thus, treatises on the law of property. Book excerpt: Excerpt from The Philosophy of Law: Being Notes of Lectures Delivered During Twenty-Three Years 1852-1875; In the Inner Temple Hall London The author of the following pages will require no introduction to the legal profession in America. To the general reader it need only be said that Dr. Herbert Broom, as the author of Commentaries on the Common Law, Commentaries on Constitutional Law, and the work on Legal Maxims, has long enjoyed the highest credit and reputation as a writer on legal subjects. As professor on common law to the Inns of Court, London, bis lectures for nearly twenty-five years, ending only last year, have been well known to English students; and it is from notes of these lectures that the author has drawn the material, the result of long and careful thought, for a statement of legal principles at once concise, lucid, and comprehensive. Dr. Broom has only attempted, however, to give, within the compass of this work, the elements of the existing law of England. Book excerpt: Jurisprudence Cases and Materials begins with two chapters on the ancient Near Eastern, biblical, and classical origins of law and jurisprudence. It offers chapters that trace the systematic development of the Anglo-American analytic canon and modern critical responses. It also analyzes jurisprudence in the courts. The result is a book that attains unusual breadth and richness of treatment of the web of law and philosophy. The book uses cases to make jurisprudence more meaningful to students and to explore the "relevance" of jurisprudence, exploring how jurisprudential assumptions implicitly or subconsciously dominate the thinking of jurists and therefore play a role in driving the law. Jurisprudence is at the very heart of law and the book tries to make that clear. Having in mind the different ways that people like to teach jurisprudence, the authors sought to design a flexible book. Students can be taken sequentially through the ancient Near Eastern, Biblical, and Classical origins of law and jurisprudence, the Anglo-American canon, modern critical responses, and how it is all reflected in the courts. The book can be taught sequentially or topically. Materials are provided which can be combined in a rich variety of ways to suit the professor's preference. The authors provide suggestions from their experience of different ways to structure the course from the materials.

Book excerpt: Excerpt from Institutes of Law: A Treatise of the Principles of Jurisprudence as Determined by Nature With this limited aim, then, the branch of science with the study of which we shall be here engaged, may be de scribed as having for its object the discovery of that law which, by the nature of all rational creatures, and independ ently of their volition, determines their relations to each other and to surrounding existences, in so far as this law is medi ately or immediately revealed to human reason and realizable by human will, under the conditions of human existence in time and space. The validity of the law of nature, it is true, is not, or at any rate cannot be conceived by us to be, limited to humanity, or to humanity under the conditions of time and space. Culverwell accordingly defines it as that law which is intrinsical and essential to a rational creature; 1 and Hegel.
