Book excerpt: The VA is not your loving Uncle Sam who opens his wallet and says, Here you are, nephew a $1,000 check per month for the rest of your life. That should take the pain out of your service injuries, writes John D. Roche. Far from it, he reveals. Though the Veterans Claims Assistance Act of 2000 requires Veterans Affairs to assist veterans in developing the foundation to support their claims, in reality if you rely on the VA to find and develop the evidence necessary to grant benefits then your claim is likely to be denied. "Claim Denied!" will help those veterans whose benefits have been denied correct the mistakes they made when they submitted their original claims. Appealing a VA decision is not an impossible feat, Roche says, but a veteran s story must be presented in a well-organized and logical format, so any reviewing authority is able to understand the issues as they relate to the laws. This book explains in detail how to develop and present a successful appeal.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Book excerpt: "The Department of Veterans Affairs(VA) has struggled to provide timelyreviews for veterans who appealdecisions on their disabilitycompensation claims. A veteranappeals to the VA regional office thatmade the initial decision, and if stilldissatisfied, to the Board of VeteransAppeals (Board). An appeal to theBoard adds more than 2 years, onaverage, to the wait for a decision onthe appeal. To resolve more appeals atthe regional level and avoid waits atthe Board, VA, in 2001, established theDecision Review Officer (DRO) reviewas an alternative to the traditionalregional office appeal review. A DRO isgiven authority to grant additionalbenefits after reviewing an appealbased on a difference of opinion withthe original decision. In contrast, underthe traditional review, new evidence isgenerally required for a grant ofadditional benefits. GAO examined (1)the extent to which veterans choose aDRO review, (2) outcomes for DROreviews, and (3) VA's challenges inmanaging DROs. GAO analyzed Boarddata, surveyed managers in all 57regional offices, visited 4 offices, andinterviewed veterans. "

Available in PDF, EPUB and Kindle. Book excerpt: In response to a congressional request, GAO evaluated the Department of Veterans Affairs' (VA) appeals process for disability compensation and pension decisions, to determine whether VA could improve the timeliness of its appeals process without detriment to quality. GAO found that VA did not: (1) effectively manage appeals, since it lacked adequate data to identify systemic problems; (2) accurately report on the time the appeals process took, and lacked adequate time standards; (3) ensure timely resolution of processing and reporting problems, which often involved multiple organizational units; (4) provide adequate guidance and oversight for regional offices; or (5) ensure that regional offices were complying with procedures. GAO also found that: (1) despite the appeals process being the same for all regions, the average time varied widely among VA regional offices; (2) delays in regional offices were due to slow case statement processing, and delays in requesting or using appeals medical information and forwarding appeals to the Board of Veterans Appeals (BVA); and (3) VA developed an automated Veterans Appeals Records Management System to provide BVA with appeals data for reporting and control purposes, but the system had never provided accurate data. In addition, GAO found that: (1) the reported average processing time did not accurately reflect the time VA took to provide final decisions on appeals, because it did not account for regional office time spent on remanded decisions, and VA double-counted cases remanded to BVA; and (2) VA management, Congress, and others did not have a complete picture of how long veterans waited for appeal decisions.

Book excerpt: Approximately 4 million U.S. service members took part in the wars in Afghanistan and Iraq. Shortly after troops started returning from their deployments, some active-duty service members and veterans began experiencing mental health problems. Given the stressors associated with war, it is not surprising that some service members developed such mental health conditions as posttraumatic stress disorder, depression, and substance use disorder. Subsequent epidemiologic studies conducted on military and veteran populations that served in the operations in Afghanistan and Iraq provided scientific evidence that those who fought were in fact being diagnosed with mental illnesses and experiencing mental healthâ€"related outcomesâ€"in particular, suicideâ€"at a higher rate than the general population. This report provides a comprehensive assessment of the quality, capacity, and access to mental health care services for veterans who served in the Armed Forces in Operation Enduring Freedom/Operation Iraqi Freedom/Operation New Dawn. It includes an analysis of not only the quality and capacity of mental health care services within the Department of Veterans Affairs, but also barriers faced by patients in utilizing those services.
