Book excerpt: Excerpt from American State Trials, Vol. 6: A Collection of the Important and Interesting Criminal Trials Which Have Taken Place in the United States, From the Beginning of Our Government to the Present Day The law against duelling easily reached a humble and ridiculous challenger like John Wood (p. Though it was absolutely impotent when it confronted men in high places, such as Aaron Burr, who killed Hamilton, and Senator Benton, who killed Lucas. This medieval custom (which was not without its good side, as was pointed out by counsel in the Trial of Wilkin son, 1 Am. St. Tr.) died a natural death in the United States about the middle of the nineteenth century, not on account of legislative enactments, but because pub lic opinion came at last, with practical unanimity, to condemn it. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from American State Trials, Vol. 17: A Collection of the Important and Interesting Criminal Trials Which Have Taken Place in the United States From the Beginning of Our Government to the Present Day In planning and producing this American State Trials Series John Lawson rendered a service of the highest importance to the legal profession. This service contributed both to the advancement of legal science and to the daily needs of the practitioner. The applied science of Law involves not only its system of principles but their application to concrete facts. This application may be studied in two chief bodies of recorded data, viz., in the transactional instruments of trade and industry and in the conduct of trials in court. The latter body of records is indispensable, in any system of law, for showing us how the principles work in practice. Yet (oddly enough) in our inherited system no official provision is made for preserving the knowledge of it. The traditional court-record, as handed down for seven centuries, breaks off with the impaneling of the jury and then resumes with the verdict. The gap between these two entries represents the trial itself, of which no record is officially preserved. Thus the preservation of that knowledge is left to private unofficial enterprise. In England it was frequent for one or both of the parties, or for some outsider, afterwards to print a report of the trial in a pamphlet. From time to time collections of such reports were published; and finally came Howells great series, the "State Trials," covering three centuries; with its continuation (starting a century ago) the "State Trials New Series."
