También muestra un panorama de las relaciones entre el Derecho y la lógica, especialmente referidas a la interpretación, a la argumentación, y a la metodología jurídicas. Tampoco olvida la importancia del estudio de la relación del Derecho con los valores, especialmente con la justicia, que es el primero y más importante de todos ellos. Por último, reflexiona sobre la deontología profesional, estudiando de forma más concreta, las particularidades deontológicas de los principales operadores jurídicos. Los temas elegidos forman parte de algunos de los más debatidos dentro de la Filosofía del Derecho actual. Reflexionar sobre estos problemas es una labor propia de todo jurista, en realidad lo es, de todo ser humano preocupado por entender y mejorar si es posible, el mundo que le rodea. Este libro modestamente pretende ayudar en ese intento. Milagros Otero Parga, nació en Santiago de Compostela en 1960. Es doctora en Derecho (1987) por la misma Universidad. En la actualidad y desde 2011, es Catedrática de Filosofía del Derecho. Ha publicado 16 libros y 138 artículos en revistas nacionales e internacionales. Los temas a los que presta mayor atención son Axiología Jurídica, Derechos Humanos, Historia del pensamiento Jurídico, Argumentación Jurídica y Mediación. Es profesora invitada en algunas de las más prestigiosas universidades de Bue­nos Aires, Santiago de Chile, Sao Paulo y Montevideo. Asidua visitante de México ha sido conferenciante en las universidades Iberoamericana, Panamericana, Ana­huac, Intercontinental, Autónoma del Estado de México, Instituto Tecnológico de Monterrey, Universidad Judicial de Durango y Universidad Popular Autónoma del Estado de Puebla. Es asesora académica de la Comisión de Derechos Humanos del Estado de México y de la Escuela Judicial del mismo Estado. Este último orga­nismo la nombró también Magister Honoris Causa. Es académica numeraria de la Real Academia Gallega de Jurisprudencia y Legislación. Fue decana de la Facultad de Derecho de la Universidad de Santiago de Com­postela y secretaria de la Comisión de Doctorado y Tercer Ciclo de la Universidad. Tiene en su poder la Medalla de Plata de Galicia, la Insignia de Oro de la Facultad de Derecho, y la Insignia de Oro de la Universidad de Santiago. Ha sido Valedora do Pobo de Galicia (2015-2019).

Se trata de un trabajo de carácter compilativo y crítico que busca ofrecer al lector una reconstrucción histórica de los principales temas y problemas de los que se ocupó la filosofía del derecho desde sus orígenes hasta la actualidad. Si se comparan las dos ediciones se encontrará que mientras la primera edición agrupó su contenido a partir de tres ejes temáticos: uno conceptual, que exponían y explicaba las nociones básicas, uno histórico que mostraba una panoramica histórica de la reflexión filosófica sobr el derecho y una parte crítica que revisaba algunos problemas de filosofía del derecho. La versión actual mantiene la misma perspectiva, pero fusiona la parte histórica y la crítica; adicionalmente, amplia el contenido de algunos temas y actualiza otros, a partir de siete capítulos, seis de los cuales corresponden a sendos problemas que la filosofía del derecho a abordado en su desarrollo histórico, a saber. El tema o problema del derecho natural, que fue el primer problema del que se ocupó la reflexión filosófica y que en parte coincide con los intentos de hallar el fundamento del derecho justo, el cual se convertiría en arquetipo o modelo del derecho ideal, tan es así que, desde los griegos hasta las postrimerías del siglo XVIII las reflexiones y discusiones de los filósofos fue sobre el derecho justo o natural. El tema o problema de la autonomía y existencia del derecho positivo, pues los cambios culturales, políticos y económicos hacen que la idea de un derecho natural superior sea insostenible y que surja tesis y argumentos que le nieguen al derecho natural el calificativo de jurídico y que sólo se otorgue esta etiqueta al derecho positivo. Por ello, la cuestión ahora será como fundamentar la autonomía y obediencia a un derecho positivo, en algo diferente a la moral (derecho natural) o el poder de facto (fuerza). El tema o problema de la ciencia dogmática del derecho y el método jurídico, problema que surge en el contexto político, social y cultural específico del siglo XIX, cuando ya se ha consolidado la idea de que el derecho es el derecho positivo expresado en la decisiones legisladas o en una práctica social reiterada que el juez debe interpretar. El tema o problema del concepto y la validez del derecho, problema que surge articulado a una nueva visión de la ciencia jurídica, que para algunos teóricos del positivismo jurídico no se identifica con la ciencia dogmática jurídica, la cual es relegada a una mera técnica jurídica, sino con una teoría general del derecho que diera cuenta de los elementos más relevantes y comunes a todos los sistemas jurídicos. El tema o problema de la inclusión de la moral en el derecho, que surge desde la segunda mitad del siglo XX, cuando hace crisis el positivismo jurídico que desconectaba lo jurídico de la moral y de lo justo, lo que hace surgir nuevos planteamientos filosóficos que proponen una nueva apertura a los problemas axiológicos y se experimenta un progresivo replanteamiento de las escuelas y corrientes que hasta entonces fungían de paradigmas del pensamiento filosófico jurídico. Finalmente el problema de la conceptualización del positivismo jurídico que surge luego de las críticas de los antipositivistas, lo cual exige que los defensores del positivismo, se den a la tarea de intentar precisar lo que a su juicio constituye el núcleo básico del positivismo jurídico, para diferenciarlo de otras teorías a veces sostenidas por positivistas, pero que no dan cuenta de lo esencial del positivismo y que ha permitido que en ocasiones se tenga sobre el positivismo una idea villana que concibe a esta teoría como moralme
