In September 2003, a group of academics, government officials, and business leaders gathered at the University of Calgary under the auspices of its Latin American Research Centre (LARC) to discuss issues related to international trade negotiations in agriculture. This innovative undertaking, which was a collaborative effort of York University, the University of Western Ontario, L'Université du Québec à Montréal, and the University of Calgary, had one main objective: to identify trade issues common to Canada and Brazil and to formulate possible plans for co-operation and coalition-building. Trade Negotiations in Agriculture: A Future Common Agenda for Brazil and Canada? is one result of this highly successful conference. This collection highlights some of the outstanding contributions from conference participants and provides useful background information for those who want to learn more about these important international economic issues. With Contributions by:Eugene BealieuShenjie ChenJames D. Available in PDF, EPUB and Kindle. Book excerpt: July 12, 2011-Over the course of a generation, Brazil has emerged as both a driver of growth in South America and as an active force in world politics. A new Council on Foreign Relations (CFR)-sponsored Independent Task Force report asserts "that it is in the interest of the United States to understand Brazil as a complex international actor whose influence on the defining global issues of the day is only likely to increase."Brazil currently ranks as the world's fifth-largest landmass, fifth-largest population, and expects to soon be ranked the fifth largest economy. The report, Global Brazil and U.S.-Brazil Relations, recommends that "U.S. policymakers recognize Brazil's standing as a global actor, treat its emergence as an opportunity for the United States, and work with Brazil to develop complementary policies."The Task Force is chaired by former secretary of energy Samuel W. Bodman and former president of the World Bank James D. Wolfensohn, and directed by CFR Senior Fellow and Director for Latin America Studies, and Director of the Global Brazil Initiative Julia E. Sweig.Recognizing Brazil's global role, the report recommends that the Obama administration now fully endorse the country's bid for a seat as a permanent member of the United Nations Security Council (UNSC). It argues that "a formal endorsement from the United States for Brazil would go far to overcome lingering suspicion within the Brazilian government that the U.S. commitment to a mature relationship between equals is largely rhetorical."Domestically, Brazil's "inclusive growth has translated into a significant reduction of inequality, an expansion of the middle class, and a vibrant economy, all framed within a democratic context." Consequently, Brazil has been able to use its economic bona fides to leverage a stronger position in the international, commercial, and diplomatic arena. The report stresses the importance of regular communication between the presidents of both countries. "Cooperation between the United States and Brazil holds too much promise for miscommunication or inevitable disagreements to stand in the way of potential gains." A mature, working relationship means that "the United States and Brazil can help each other advance mutual interests even without wholesale policy agreements between the two," notes the report. The Task Force further recommends that- the U.S. Congress "include an elimination of the ethanol tariff in any bill regarding reform to the ethanol and biofuel tax credit regime."- the United States "take the first step to waive visa requirements for Brazilians by immediately reviewing Brazil's criteria for participation in the Visa Waiver Program."- the U.S. State Department create an Office for Brazilian Affairs and the National Security Council (NSC) centralize its efforts under a NSC director for Brazil in order to better coordinate the current decentralized U.S. policy. The bipartisan Task Force includes thirty distinguished experts on Brazil who represent a range of perspectives and backgrounds. The report includes a number of additional views by Task Force members, including one that notes, "We believe that a more gradual approach [regarding Brazil's inclusion as a full UNSC member] would likely have more success in navigating the diplomatic complexities presented by U.S. support for Brazil." Another view asserts, "If the United States supports, as the Obama administration has said it does, leadership structures in international institutions that are more reflective of international realities, it must support without qualifications Brazil's candidacy [for the UNSC]."

Book excerpt: "The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) is a free trade agreement involving major countries across the Asia Pacific region. The trade pact, which entered into force on 30 December 2018, is considered by many to be the “gold standard”, given its ambitious scope and depth. This volume offers multi-dimensional insights into the CPTPP and its impact on Southeast Asia. It begins with broad analyses covering the historical, economic and geopolitical aspects of the CPTPP. Subsequent chapters focus on the nature and implications of three key path-breaking provisions in the trade agreement, namely investor-state dispute settlement, intellectual property rights and state-owned enterprises. The effect of the CPTPP on Southeast Asia in terms of regional production networks is also examined from the perspective of Japanese multinational enterprises. The potential economic impact of the agreement is analysed for member countries (Vietnam and Malaysia) as well as countries that aspire to join the CPTPP in the future (Indonesia and Thailand). The world trading system is in disarray: the World Trade Organization has been weakened, perhaps terminally; the world’s two economic superpowers are locked in deep, politicized disputes; the forces of populism and nationalism are everywhere complicating the return to a more liberal, rules-based order. These trends are challenging one of the building blocks of ASEAN economic development, namely these countries’ outward-looking trade and investment policies. With impeccable timing this important volume by a group of eminent authors assesses these issues with reference to the Comprehensive and Progressive Agreement for Trans-Pacific Partnership. The CPTPP excludes the three largest traders—China, the EU and the US—but it is a welcome second-best initiative that may have broader, positive ripple effects. This is the volume to read to gain a deeper understanding of the many complex issues at play." -- Hal Hill, H.W. Arndt Professor Emeritus of Southeast Asian Economies, College of Asia & the Pacific, Australian National University

Book excerpt: This report provides the first-ever comparative analysis of the role and performance of private health insurance (PHI) in OECD countries. It analyses PHI markets and identifies policy issues arising from their interdependence with publicly financed health coverage schemes. The report assesses the impact of PHI against health policy objectives, paying special attention to the challenges and benefits associated with different insurance mixes. The analysis identifies strengths as well as areas where private health insurance might pose challenges to health system performance. This report shows how governments can help ensure that PHI markets make a positive contribution to the performance of health systems. Examples of useful practices for developing more efficient and equitable health insurance markets are also presented.

Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of competition law and its interpretation in Brazil covers every aspect of the subject – the various forms of restrictive agreements and abuse of dominance prohibited by law and the rules on merger control; tests of illegality; filing obligations; administrative investigation and enforcement procedures; civil remedies and criminal penalties; and raising challenges to administrative decisions. Lawyers who handle transnational commercial transactions will appreciate the explanation of fundamental differences in procedure from one legal system to another, as well as the international aspects of competition law. Throughout the book, the treatment emphasizes enforcement, with relevant cases analysed where appropriate. An informative introductory chapter provides detailed information on the economic, legal, and historical background, including national and international sources, scope of application, an overview of substantive provisions and main notions, and a comprehensive description of the enforcement system including private enforcement. The book proceeds to a detailed analysis of substantive prohibitions, including cartels and other horizontal agreements, vertical restraints, the various types of abusive conduct by the dominant firms and the appraisal of concentrations, and then goes on to the administrative enforcement of competition law, with a focus on the antitrust authorities’ powers of investigation and the right of defence of suspected companies. This part also covers voluntary merger notifications and clearance decisions, as well as a description of the judicial review of administrative decisions. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Brazil will welcome this very useful guide, and academics and researchers will appreciate its value in the study of international and comparative competition law.

Available in PDF, EPUB and Kindle. Book excerpt: This 2005 book argues that Europeanization and globalization have led to ever-more intensive legalization at transnational level. What accounts for compliance beyond the nation-state? The authors tackle this question by comparing compliance with regulations that have been formulated in a very similar way at different levels of governance. They test compliance with rules at the national level, at the regional level (EU), and at a global level (WTO), finding that in fact the EU has higher levels of compliance than both international and national rules. The authors argue that this is because the EU has a higher level of legalization, combined with effective monitoring mechanisms and sanctions. In this respect it seems that the European Union has indeed achieved a high level of legalization and compliance, though the authors add that this achievement does not settle the related queries with the legitimacy of transnational governance and law.
