Book excerpt: The fight against the sexual exploitation of and trade in children has gained particular and renewed international attention in the last few years and has become one of the most important concerns in the context of international law enforcement policy and cooperation. Since 1998, policy makers have come up with new legal initiatives at global as well as regional levels in order to tackle this problem in a more effective and coordinated way. This proves that the time has come to match words and actions, and to come up with concrete and useful tools for law enforcement services and NGO's active in the areas concerned. The current study therefore examines the feasibility of the further elaboration and implementation of recommendations from a previous project (96/STOP/003) regarding the systematic gathering and administration of data concerning missing minors, minor victims of trafficking in or sexual exploitation of children and perpetrators of sexual offences against minors, with the goal to further prepare the practical setting up of several international databases with immediate relevance to the police and the prosecuting or investigating magistrates or officials, both in the EU Member States and the candidate countries. It is recommended to give Interpol a mandate to host an international database on missing persons and to create an EU monitoring centre responsible for the gathering and administration of reliable statistics and legal information on sexual exploitation of children and trafficking in human beings. It is also recommended for Interpol to host an international reference database on child pornography and to set up an analysis/intelligence child porn database at Europol. Regarding suspected and convicted sex offenders, it is proposed to create a database on pending investigations, an EU criminal records database and a database at Europol containing encoded information on both suspected and convicted offenders of sexual offences against children. Finally, it is suggested to create a European network of national DNA databases. The book also contains a summary of the conclusions in French.

Book excerpt: Every State has an obligation to prevent terrorist attacks emanating from its territory. This proposition stems from various multilateral agreements and UN Security Council resolutions. This study exhaustively addresses the scope of this obligation of prevention and the legal consequences flowing from its violation, so as to provide greater clarity on governments' counterterrorism duties and to enhance State accountability for preventable wrongs. It defines the contents and contours of the obligation while placing critical emphasis on the mechanics of State responsibility. Whether obscured by new technologies like the Internet, the sophisticated cellular structure of some terrorist organisations or convoluted political realities, the level of governmental involvement in terrorist activities is no longer readily discernible in every instance. Furthermore, the prospect of governments waging surrogate warfare through proxies also poses intractable challenges to the mechanism of attribution in the context of State responsibility. This monograph sets out the shortcomings of the extant scheme of State responsibility while identifying a paradigm shift towards more indirect modes of accountability under international law, a trend corroborated by recent State and institutional practice. Drawing on varied legal and theoretical influences, the study devises and prescriptively argues for the implementation of a strict liability-inspired model grounded in the logic of indirect responsibility with a view to enhancing State compliance with counterterrorism obligations. This shifts the policy focus squarely to prevention, while promoting multilateralism and transnational cooperation. Ultimately, the legal and policy sensibilities underlying the book converge into a new theory of prevention in counterterrorism contexts. The issues surrounding sovereignty and jurisdiction are likely to become ever more pressing as globalisation, growing pressure on resources and the need for energy and national security become acute, and the resolution of special delimitation disputes seems likely to become a vital question in the twenty-first century. As a result of the fast pace of technological developments in air and space activities and the massive increases in air transportation , satellite communications and space exploration, the need for scholars and practitioners to sharpen their appreciation of the legal and political issues becomes crucial. This book will focus primarily on the issues of sovereignty jurisdiction and control in airspace and outer space and their effects on public and private activities, but it will also look at related issues pertaining to the Seas and Antarctica. Commercial exploitation, resource control and the international regime regulating contractual obligations in relation to transportation of goods and services over all forms of territory will be examined to the extent that they are necessary to explain jurisdictional rights and duties over territory. Older problems of international law such as crimes in the air and airspace trespass are treated along with newer developments such as space tourism as well as growing demand for private ownership and involvement in outer space exploitation. The book goes on to consider the distinction between airspace and outer space and puts forward legal criteria which would allow for the resolution of the spatial delimitation dispute. These criteria would determine where in spatial terms the exclusive sovereignty of airspace ends and where outer space – the province of all mankind – begins, and contribute to the jurisprudence of territorial sovereignty and jurisdiction.
