The process began with the writing of the Constitution, continued through its ratification by the states, and culminated with the adoption of the Bill of Rights. In 1991 the bicentennial of the adoption of the Bill of Rights provided an occasion for examining the origins of this most important statement of individual rights in American history. Published on this anniversary, The South's Role in the Creation of the Bill of Rights sheds light on the paradoxical part the South played in the process of drafting and adopting this document. In cogent essays from the Chancellor's Symposium on Southern History held at the University of Mississippi in 1988, six noted experts in legal, constitutional, and southern history fill a gap in the literature of southern legal history for the period 1787-1791. The southern role is particularly important because political leaders in the South took the lead in promoting a bill of rights and at the same time vociferously defended the right to hold slaves. The essays in this book comprise a complete discussion of the writing and ratification of the Constitution and the adoption of the Bill of Rights in five southern seaboard states. They reveal the interplay of a desire to protect states' rights, a concern for the preservation of individual liberty, and a defensive attitude toward slavery that governed southern attitudes. These concerns dominated constitutional discourse until the Civil War. The South's peculiar “cultural constitutionalism” was first given definition in this period of American history, and as this book reveals, it initiated the process of setting the region apart from the rest of the United States. The events of these years were a necessary first step in establishing a southern regional identity.

The Framers, who made short work of regulation with the simple admonition that "Congress shall have the power To... regulate Commerce," would surely blanch at the extent to which those few words have since been interpreted. Beyond mere immensity, one wonders if they could have foreseen the degree to which broad bureaucratic discretion would threaten the constitutionally based separation of powers, rule of law, and individual rights—or, on the other hand, to what extent unchecked administrative oversight and political manipulation could threaten regulatory efficiency and effectiveness. In this volume eight prominent scholars representing the disciplines of political science, government, law, and philosophy analyze and debate with each other different aspects of government regulation, and the problems generated thereby, from a constitutional perspective. Topics include the growth, scope, and range of government regulation; regulation as it is affected by liberal thought and action; the paradox posed by the dangers to society of zealous regulatory efforts to protect it; a philosophical analysis of the preconditions for a free society; the expansion of public power through increased regulation at the expense of democratic accountability and control; expansion of judicial power to cope with regulatory rule making; the need to maintain the viability of private institutions, to include the family, in the face of increased regulation; the need for a renewed effort to assure that officials of the expanded regulatory structure have a sense of and carry out their duty to the American people; and competing views concerning how the Constitution should be interpreted regarding administrative decision making and judicial review. The Constitution and the Regulation of Society is the second of a three-volume series examining significant features of the Constitution. The series, inspired by the bicentennial of that great achievement, consists of essays presented by scholars at three conferences held at Brigham Young University in 1985, 1986, and 1987, and several additional essays written especially for these volumes. This volume includes in addition debate and discussion between the contributing scholars during the conference they attended.

From Revolution to Reunion investigates the way in which South Carolinians, Patriot and Loyalist, managed to reconcile their bitter differences and reunite to heal South Carolina and create a stable foundation for the new United States. Rebecca Brannon considers rituals and emotions, as well as historical memory, to produce a complex and nuanced interpretation of the reconciliation process in post-Revolutionary South Carolina, detailing how Loyalists and Patriots worked together to heal their society. She frames the process in a larger historical context by comparing South Carolina’s experience with that of other states. Brannon highlights how Loyalists apologized but also became vital contributors to the new experiment in self-government and liberty. In return, the state government reinstated almost all the Loyalists by 1784. South Carolinians succeeded in creating a generous and lasting reconciliation between former enemies, but in the process they downplayed the dangers of civil war—which may have made it easier for South Carolinians to choose that path a second time.
