The five sections of the book look at: * the effects of European harmonisation on crime * criminal justice, law enforcement and penal reform * organised crime, from the Mafia in Italy to drug running in the Balkans * local crime in international contexts * possible future directions for criminology and some suggestions for a new criminology of war.

Book excerpt: The collapse of communism and the process of state building that ensued in the 1990s have highlighted the existence of significant minorities in many European states, particularly in Central Europe. In this context, the growing plight of Europe's biggest minority, the Roma (Gypsies), has been particularly salient. Traditionally dispersed, possessing few resources and devoid of a common "kin state" to protect their interests, the Roma have often suffered from widespread exclusion and institutionalized discrimination. Politically underrepresented and lacking popular support amongst the wider populations of their host countries, the Roma have consequently become one of Europe's greatest "losers" in the transition towards democracy. Against this background, the author examines the recent attempts of the Roma in Central Europe and their supporters to form a political movement and to influence domestic and international politics. On the basis of first-hand observation and interviews with activists and politicians in the Czech Republic, Hungary and Slovakia, he analyzes connections between the evolving state policies towards the Roma and the recent history of Romani mobilization. In order to reach a better understanding of the movement's dynamics at work, the author explores a number of theories commonly applied to the study of social movements and collective action.

Available in PDF, EPUB and Kindle. Book excerpt: A comprehensive insight into the valuable work carried out by one of the Council of Europe’s highly influential mechanisms, the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT). Since its inception in 1989, specialist members of the CPT (lawyers, prosecutors, prison experts, doctors, psychiatrists, etc.) have visited thousands of police stations, prisons, immigration detention centres, psychiatric hospitals and other places of detention all over Europe, to monitor the living conditions (hygiene, provision of food and drink, health care, etc.) of those being detained. Following these visits, the CPT issues reports suggesting improvements and laying down standards. The purpose of this book is twofold. In the first part, the authors explain the background and origins of the CPT, its membership and modus operandi, as well as how it interacts with other bodies, such as the UN’s Subcommittee on Prevention of Torture (SPT) and the national preventive mechanisms (NPMs). In the second part, the authors describe the CPT’s key findings and standards in the main situations of deprivation of liberty (police, prison, immigration detention, mental health and social care). In a detailed appendix, the authors provide summaries of the key CPT findings for the 47 states visited by the CPT.

Available in PDF, EPUB and Kindle. Book excerpt: The controversial nature of seeking globalised justice through national courts has become starkly apparent in the wake of the Pinochet case in which the Spanish legal system sought to bring to account under international criminal law the former President of Chile, for violations in Chile of human rights of non-Spaniards. Some have reacted to the involvement of Spanish and British judges in sanctioning a former head of state as nothing more than legal imperialism while others have termed it positive globalisation. While the international legal and associated statutory bases for such criminal prosecutions are firm, the same cannot be said of the enterprise of imposing civil liability for the same human-rights-violating conduct that gives rise to criminal responsibility. In this work leading scholars from around the world address the host of complex issues raised by transnational human rights litigation. There has been, to date, little treatment, let alone a comprehensive assessment, of the merits and demerits of US-style transnational human rights litigation by non-American legal scholars and practitioners. The book seeks not so much to fill this gap as to start the process of doing so, with a view to stimulating debate amongst scholars and policy-makers. The book's doctrinal coverage and analytical inquiries will also be extremely relevant to the world of transnational legal practice beyond the specific question of human rights litigation. Cited in Nevsun Resources Ltd. v. Araya, 2020 SCC 5.

Book excerpt: This accessible text looks at the impact of the globalization process on social policy. National social policy is increasingly determined by global economic competition and international organizations. Its substance is becoming more and more transnational and now has to be understood in terms of global social redistribution, social regulation, social provision and empowerment. Global Social Policy examines trends in global inequity and summarizes the diverse experiences of different welfare regimes across the world. The authors review the social policies of international organizations such as the World Bank, the International Monetary Fund, UN Agencies and the European Union, and show them to be engaged in heated controversy regarding the future for welfare. They argue that this concealed global discourse needs to be brought into an accountable arena.

Book excerpt: The Council of Europe, of which all European States are members, plays a pivotal role in the promotion and protection of human rights, democracy, and the rule of law in Europe. Bringing together specialist scholars and practitioners, The Council of Europe: Its Laws and Policies offers profound insights into the functioning of the organization. The organization's primary and secondary law, its institutional structure, and its far-reaching fields of activities are comprehensively and systematically analysed. This volume investigates the impact of the Council's activities within the national legal systems of the Member States and the dense web of relationships between the Council of Europe and other international organisations. An important reference work on one of the most influential organizations in Europe, the book concludes that the Council of Europe has played a considerable role in the constitutionalization process of regional public international law.

Book excerpt: Based on the experience of many countries in the WHO European Region and the advice of experts, this guide outlines some of the steps prison systems should take to reduce the public health risks from compulsory detention in often unhealthy situations, to care for prisoners in need and to promote the health of prisoners and prison staff. This requires that everyone working in prisons understand how imprisonment affects health, what prisoners' health needs are, and how evidence-based health services can be provided for everyone needing treatment, care and prevention in prison. Other essential elements are being aware of and accepting internationally recommended standards for prison health; providing professional care with the same adherence to professional ethics as in other health services; and, while seeing individual needs as the central feature of the care provided, promoting a whole-prison approach to care and promoting the health and well-being of people in custody.

Book excerpt: Education plays an essential role in the promotion of the core values of the Council of Europe: democracy, human rights And The rule of law, As well as in the prevention of human rights violations. More generally, education is increasingly seen as a defence against the rise of violence, racism, extremism, xenophobia, discrimination and intolerance. This growing awareness is reflected in the adoption of the Council of Europe Charter on Education for Democratic Citizenship and Human Rights Education (EDC/ HRE) by the Organisation's 47 member states in the framework of Recommendation CM/Rec(2010)7. The Charter was developed over a period of several years as a result of wide-ranging consultations and is non-binding. it will be an important reference point for all those dealing with citizenship and human rights education. it will hopefully provide a focus and catalyst for action in the member states, As well as a way of disseminating good practice and raising standards throughout Europe and beyond.

Available in PDF, EPUB and Kindle. Book excerpt: Are more people being imprisoned throughout the world? Why is imprisonment still being used on a wide scale when an increasing number of alternatives are available? What are the major developments in prison law in the last decade? What problems arise in prison systems when states become constitutional democracies for the first time? Should prisons be privatized? How can prison conditions and prisoners' rights be improved? What special measures should there be for women, juveniles, violent offenders or drug addicts in prison? What programmes work effectively under which conditions? The second edition of "Imprisonment Today and Tomorrow" presents much fresh information in its attempts to provide answers to these and other crucial questions. It provides authoritative accounts by leading national experts on the place of imprisonment in 26 penal systems of major countries throughout the world. In addition, through the chapters on the work of the European Committee for the Prevention of Torture and Inhuman and Degrading Punishment, non-governmental organizations and the United Nations, it sheds new light on international initiatives to promote prison standards. These are complemented by a comparative survey of world prison populations and a final chapter in which the editors evaluate developments described in this volume and elsewhere in order to arrive at conclusions about international trends and to make well-grounded proposals for prison reform.
