Book excerpt: This is the first book dedicated to clarifying the concept of “foundlings” and how to best prevent their statelessness in light of the object and purpose of Article 2 of the 1961 UN Convention on the Reduction of Statelessness and equivalent nationality law provisions. Among other features, the book defines the terms “foundling,” including the maximum age limit of the child to be considered a “foundling”; “unknown parents”; being “found” in a territory; and “proof to the contrary”; as well as the procedural issues such as the appropriate burden and standard of proof. In doing so, the book draws upon a comparative analysis of national legislation on “foundlings” covering 193 states, case law, and precedents in some states as well as international human rights law norms including the best interests of the child. As its conclusion, the book proposes an inclusive model “foundling provision” and a commentary to inform legislative efforts and interpretation of the existing provisions. Its findings are useful not only to state parties to the 1961 Convention but also to non-state parties, particularly in countries lacking systematic civil documentation or experiencing the effects of armed conflicts, migration, trafficking, and displacement.

Linking up with the first volume, The Search for Security in the Pacific, it offers a new and path-breaking understanding of Australia's relations with the world from the outbreak of the First World War to the making of peace in Europe and the Pacific. This study explores a number of fundamental issues that shaped Australia's response to the world in this era, such as race and culture, geopolitics and security, domestic divisions and ideas of loyalty, and the philosophies and personalities of the chief policy makers. From the outset of this global conflict Australia was involved in a 'hot war' in Europe against Germany and its allies, and in a 'cold war' in the Pacific against Japan. The British Australians, for reasons of sentiment and interest, supported the Mother Country, but even as they did so they were deeply concerned about Japan's ambitions. As a result Japan figured prominently in Australia's approach to the war and the peace. In tracing out this story, the book throws light on many particular aspects of the 'hot' and 'cold' wars. They include the origins of Asian studies in Australia, intelligence gathering, the secret service and loyalty leagues, the fear of Japan in the conscription controversy, Irish Catholics and the Anglo-Irish War. The labour movement and the Bolshevik revolution, the ideological clash of the American President and the Australian Prime Minister over peacemaking, the visit of the Prince of Wales, 'Britishness' and the failure of the idea of Greater Britain all influenced the development of Australia's defence and foreign policy. At the end of the book there is an attempt to provide an assessment of Australia's leadership through these testing times and to point out the significance of this experience for a later generation of Australia policy makers.

Two types of state tend to contend for power: trading states and territorial states, although most states are never “pure” and tend to contain within them multiple polities with different agendas. This book describes the hegemonic transition between two major trading states, Britain and America. British decline began in the late Victorian era, but the transition to American power was slow, and other states also sought hegemony. Transitions between trading states focus on economic struggle, though struggles between trading and territorial states and between territorial states are marked by armed conflict. In 1919 President Woodrow Wilson saw three arenas of competition developing between Britain and America: in international transportation, international communication, and petroleum. But Britain was challenged economically by America as early as 1861 via the Morrill Tariff, her economic hegemony was gone by the 1880s, and she was “defeated” by 1947. From the 1880s on both America and Germany sought to replace Britain as hegemonic power not only through their implementation of protectionist economic policies, but also through the adoption of revised versions of the world-economy, through new technologies, and, in the case of Germany, military power. Britain struggled to stay in place. Britain’s world-economy was that of a pure trading state. Maritime trade in organic materials was organized through global capitalism and control over submarine cable telecommunications rather than territorial possession. America’s rise was greatly helped by being a capitalist power in possession of a secure territorial base in the mid-section of the North American continent, but America suffered from multiple polities competing for power, with the South particularly problematic. Germany developed a radically new world-economy that synthesized resources using organic chemistry. German science and technology began to diffuse to American corporate laboratories before World War One. After that war, diffusion to American laboratories and universities was massive and helped secure American hegemony.
