The main question to be determined is: Shall the railroads be owned and operated as public or as private property? Shall these great arteries of commerce be owned and controlled by a few persons for their own private use and gain, or shall they be made highways to be kept under strict government control and to be open for the use of all for a fixed, equal and reasonable compensation? In a new and sparsely settled country which is rich in natural resources there may be no great danger in pursuing a laissez-faire policy in governmental affairs, but as the population of a commonwealth becomes denser, the quickened strife for property and the growing complexity of social and industrial interests make an extension of the functions of the state absolutely necessary to secure protection to property and freedom to the individual. The American people have shown themselves capable of solving any political question yet presented to them, and the author has no doubt that with full information upon the subject they will find the proper solution of the railroad problem. The masses have an honest purpose and a keen sense of right and wrong. With them a question is not settled until it is settled right. It must be conceded that of all the great inventions of modern times none has contributed as much to the prosperity and happiness of mankind as the railroad. This fact, to gether with the consideration that nearly all the adjudications upon corporate mortgages relate to matters mostly foreign to the general Law of Mortgages, led the author to omit these matters from his work upon the general subject. The present volume is intended to make good that omission. It has been the purpose of the author not to include in the pres ent treatise subjects elementary or general in the Law of Mort gages. The public nature of railroad and other like corporations, having public duties to perform, in return for the franchises granted them, and the nature and extent of their property, have introduced into mortgages of their franchises and property new elements of law which have now developed into a separate branch of jurisprudence. A glance at the Table of Contents of this vol ume will show how widely the topics considered differ from those which arise under ordinary mortgages; and even when the titles are the same, an examination of the contents will generally show that, as applied to these corporate securities, the substance of the law is different. Since its publication nearly five hundred cases bearing upon the law of receivers have been published and appear in the present edition. The entire work has been thoroughly revised and the book has been much enlarged, the principal changes be ing in the chapters upon Actions, Corporations, Railways, Judgment Creditors, Real Property and Mortgages. In the preface to the second edition it was stated that the law of receivers over railways, while largely the growth of recent years, had not wholly emerged from its formative period, and that considerable modifications of existing doctrines might still be expected. The correctness of this statement is shown in the many new cases which have been embodied in the present chapter upon Railways, especially upon the topics of Preferred Debts, Actions against the Receiver and Receivers' Certifi cates, the doctrines pertaining to which have been largely modi fied as the result of the later decisions. No feature of railway receiverships has been more prolific of litigation in recent years than the extent to which the ordinary contract indebtedness of railway companies may, in the event of a receivership, be pre ferred over the claims of mortgage bondholders. The tendency of the later decisions of the Supreme Court of the United States, as shown in the present edition, has been to restrict the right to a preference to much narrower limits than had been fixed by the earlier cases.
