Available in PDF, EPUB and Kindle. Book excerpt: "This book examines the role of philosophical metaphor and allegory in the Aeneid, focusing on tendentious allusions to Lucretian atomism. It argues that Virgil, drawing upon a popular strain of anti-atomist and anti-Epicurean arguments in Greek philosophy, deploys atomic imagery as a symbol of cosmic and political disorder. The first chapter of this study investigates the development of metaphors and analogies in philosophical texts ranging from Aristotle to Cicero that equate atomism with cosmological caprice and instability. The following three chapters track how Virgil applies this interpretation of Epicurean physics to the Aeneid, in which chaotic atomic imagery is associated with various challenges to the poem's dominant narrative of divine order and Roman power. For Aeneas, the specter of atomic disorder arises at moments of distress and hesitation, while the association of various non-Trojan characters with atomism characterizes them as agents of violent disorder needing to be contained or vanquished. The final chapter summarizes findings, showing how Virgilian allusion to Lucretian physics often conflates poetic, political, and cosmological narratives, blurring the boundaries between their respective modes of discourse and revealing a general preference for hierarchical, teleological models of order"--

Available in PDF, EPUB and Kindle. Book excerpt: This intellectual biography of Immanuel Kant's early years-- from 1746 when he wrote his first book, to 1766 when he lost his faith in metaphysics --makes an outstanding contribution to Kant scholarship. Schönfeld meticulously examines most of Kant's early works, summarizes their content, and exhibits their shortcomings and strengths. He places the early theories in their historical context and describes the scientific discoveries and philosophical innovations that distinguish Kant's pre-critical works. Schönfeld argues that these works were all aspects of a single project carried out by Kant to reconcile metaphysical and scientific perspectives and combine them into a coherent model of nature.

Available in PDF, EPUB and Kindle. Book excerpt: Can the Supreme Court be free of politics? Do we want it to be? Normative constitutional theory has long concerned itself with the legitimate scope and limits of judicial review. Too often, theorists seek to resolve that issue by eliminating politics from constitutional decisionmaking. In contrast, Terri Peretti argues for an openly political role for the Supreme Court. Peretti asserts that politically motivated constitutional decisionmaking is not only inevitable, it is legitimate and desirable as well. When Supreme Court justices decide in accordance with their ideological values, or consider the likely political reaction to the Court's decisions, a number of benefits result. The Court's performance of political representation and consensus-building functions is enhanced, and the effectiveness of political checks on the Court is increased. Thus, political motive in constitutional decision making does not lead to judicial tyranny, as many claim, but goes far to prevent it. Using pluralist theory, Peretti further argues that a political Court possesses instrumental value in American democracy. As one of many diverse and redundant political institutions, the Court enhances both system stability and the quality of policymaking, particularly regarding the breadth of interests represented.

Book excerpt: The Brussels I Regulation, which ensures the free circulation of judgments within the EU, was recently revised; one of the main issues addressed was whether the Regulation affects the efficient resolution of international commercial disputes through arbitration within the Union. This book provides an in depth examination of the interface between the Regulation and international commercial arbitration. The author demonstrates that the consequences of this interface can encourage the use of delaying tactics, hampering the efficient resolution of international disputes.
