Book excerpt: The new boon brought by information technology has brought its scar in the form of cybercrime, moreover the new business environment required new regulations for its legal endorsement as more and more business communities are moving towards electronic commerce and transborder contracts. To address this issue the United Nation through its core agency, United Nations Commission on International Trade Law (UNCITRAL) had formulated a model legislation on electronic commerce. The Information Technology Act 2000 is the prime legislation dealing with cyber offenses and electronic commerce in India which is based on the United Nations Model Law on Electronic Commerce adopted by the United Nations Commission on International Trade Law (UNCITRAL).The Information Technology Act 2000 is applicable to the whole of India, including any offense committed outside India, if such contravention involves a computer, computer system or computer network located in India. India with the adoption of the Information Technology Act, 2000 has entered the coveted world of the few countries that have separate law to deal with information technology issues. This has paved way for the growth of e-commerce and e-transaction, thereby advancing economic growth and a new era of e-governance has come into existence which helps in bringing transparency, efficiency and accountability in governance.

The book will be very useful to a wide range of readers because it will both inform and provide the basis for instruction. This book significantly advances the scholarly literature available on the global problem of cyber-crime. It also makes a unique contribution to the literature in this area. Much of what has been written focuses on cyber-crime in the United States and in Europe. This much-needed volume focuses on how cyber-crime is being dealt with in Asian countries. It explains how law enforcement is responding to the complex issues cyber-crime raises and analyzes the difficult policy issues this new type of transnational crime generates. This book is an invaluable addition to the library of anyone who is concerned about online crime, computer security or the emerging culture of the Internet.

The spread of the Internet and the seemingly boundaryless options for collecting, saving, sharing, and comparing information trigger consumer worries. Online practices of business and government agencies may present new ways to compromise privacy, and e-commerce and technologies that make a wide range of personal information available to anyone with a Web browser only begin to hint at the possibilities for inappropriate or unwarranted intrusion into our personal lives. Engaging Privacy and Information Technology in a Digital Age presents a comprehensive and multidisciplinary examination of privacy in the information age. It explores such important concepts as how the threats to privacy evolving, how can privacy be protected and how society can balance the interests of individuals, businesses and government in ways that promote privacy reasonably and effectively? This book seeks to raise awareness of the web of connectedness among the actions one takes and the privacy policies that are enacted, and provides a variety of tools and concepts with which debates over privacy can be more fruitfully engaged. Engaging Privacy and Information Technology in a Digital Age focuses on three major components affecting notions, perceptions, and expectations of privacy: technological change, societal shifts, and circumstantial discontinuities. This book will be of special interest to anyone interested in understanding why privacy issues are often so intractable.

Book excerpt: Featuring contributions from leading scholars of health privacy law, this important volume offers insightful reflection on issues such as confidentiality, privacy, and data protection, as well as analysis in how a range of jurisdictions—including the US, the UK, Europe, South Africa, and Australia—navigate a rapidly developing biomedical environment. While the collection of personal health information offers the potential to drive research and innovation, it also generates complex legal and ethical questions in how this information is used to ensure the rights and interests of individuals and communities are respected. But in many ways laws have struggled to keep pace with technological developments. This book therefore seeks to fill a lacuna for legal insight and reflection. Over three parts, the book first explores the conceptual landscape which law and legal institutions must contend, and then turns to examine practical issues such as the GDPR, secondary use of data for research, genomic research, and data trusts. With cutting-edge analysis drawing on domestic and international case law, legislation, and policy, this comprehensive volume will prove fascinating reading for all students and researchers interested in this evolving and contentious area of study.
