The recently enacted Financial Sector Omnibus Law (FSOL) enhances the OJK’s institutional set-up, powers, banking regulation and supervisory frameworks and clarifies the Financial System Stability Committee’s (KSSK’s) mandate for systemic risk monitoring and coordination. The OJK has developed supervision capabilities and deployed innovative Supervisory Technologies (SupTech) to achieve greater efficiency in banking supervision. New regulations on corporate governance have elevated the importance of good governance within the banking industry. While progress has been made, the OJK must continue intensifying its efforts, considering emerging challenges in the global economic and financial environment and new risks from digitalization, cyber and climate change.

The Ministry of Finance and Economic Affairs (Iceland) (MoFEA) together with the Central Bank of Iceland (CBI) undertook a thorough legislative reform agenda which included the transposition of the EU legislative framework and EBA guidelines into Icelandic banking law, enacted a new law for banking resolution as well as established the Resolution Authority within CBI, and adopted new liquidity requirements (Basel III). Further, CBI fully implemented its risk based supervisory framework, adopting supervisory methodology that focuses on high-impact financial institutions, ensuring deep analysis by off-site supervisors on capital, liquidity, business model analysis, as well as governance and internal controls. CBI, together with other relevant agencies, also developed and implemented a new AML/CFT legislative and supervisory framework for banks (applicable to all regulatory institutions that CBI now regulates since the merger with the FSA).

There is need for a more frequent and comprehensive review of the regulatory framework to ensure they remain relevant to changing industry and regulatory practice. The regulatory framework needs to be updated to align closer with recent Basel norms, guidance, and principles, particularly in the risk management areas specified below. Supervision tools and methodologies and guidance to supervisors need to be augmented as specified below to make supervision more forward-looking and effective. The planned revision of the Banking Act should aim to address gaps and help strengthen powers and support more intrusive supervision.

The country is also in the process of transitioning from Basel I to Basel II. In the context of an Association Agreement to be signed with the European Union (EU),2 the NBM plans to implement the standard risk-weighting model of Basel II as well as other elements of Basel III. The objective is to enhance the NBM’s institutional capacity with the view to foster the banks’ prudential regulatory framework. The association process will also enable NBM to gradually implement the EU Capital Requirements Regulation and Directive (CRR/CRD).
