Book excerpt: The importance of recognising the extent of law relating to Adults with Incapacity, and fostering a proper application of its terms, continues to increase. While the effect of an aging population inevitably will be a significant consideration, the law also embraces Adults who have conditions such as a Learning Disability or who experience the effects of events such as Stroke or Acquired Brain Injury. It is vital, therefore, that Practitioners can provide the best advice to clients and their families and supporters connected to this complex and developing area of work. It is equally important that other Professionals involved in assisting the lifestyle, finances and treatment of Vulnerable Adults appreciate how the law impacts on their work and informs their decisions. In Scotland, the Adults with Incapacity (Scotland) Act 2000 was the first major legislation passed by the Scottish Parliament which established a comprehensive regime affecting Vulnerable Adults, and reflecting the requirements of the Human Rights Act 1998. Provision was made in relation to matters such as Powers of Attorney, Guardianship and Intervention Orders, as well as authorisation of some forms of Medical Treatment. This Textbook offers a full overview of the content of the 2000 Act, and the practical steps available to Attorneys, Guardians and those advising them in discharging their responsibilities. In Scotland, a full Review of Mental Health Law is in progress which will address how the requirements of the United Nations Convention on the Rights of Persons with Disability (UNHCR) will be implemented. The textbook also will consider what changes in law and practice are likely to arise from the relevant parts of the Review and the possible paradigm shift mandated by the UNCHR.

Book excerpt: This book is a practical guide to conducting a proof in the sheriff court, based on the author's thirty years of experience of presenting evidence at proofs and hearings in the sheriff court, the Court of Session and before tribunals. The guide highlights the importance of risk management in an area of law that is fraught with hazards concerning costs, timescales and adverse outcomes. It also identifies many useful steps that ought to be taken with a view to minimising such hazards and making the process of conducting a proof as smooth and as painless as possible. Although the book is aimed primarily at practitioners it describes the practical application of the law of evidence, an area which will interest academics and students. The guide deals with managing clients, advice on preparation and how best to cover your back in this perilous area of practice. Although reference is made to court rules and textbooks the book is first and foremost a practice guide. ABOUT THE AUTHOR Andrew Stevenson S.S.C. is a practising solicitor advocate at Waddell and Mackintosh, Troon. He has undertaken many hundreds of proofs across Scotland since 1992 in virtually all areas of litigation and has long experience of acting as a commissioner to recover evidence in sheriff court actions both civil and criminal. Book excerpt: The termination of a commercial Lease is something that needs to be approached with great caution and attention-to-detail. A failure to take account of essential/current law and practice could result in a significant claim against the solicitor(s) involved in the transaction, and the consequences for the Landlord or Tenant will be significant. A Practical Guide to Terminating Commercial Leases in Scotland is designed to be a concise, yet definitive, guide for solicitors and students alike. It encompasses a summary of relevant statutes and case law throughout, and covers both voluntary termination and involuntary termination alike. The book covers: Constitution of a Lease - the essential elements required by Scots Law in order to create a Lease; Break Options - including a detailed analysis of essential cases on service, correct recipients, notice periods, conditionality, apportionment of rent, and errors of content; Irritancy - including a detailed analysis of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1985, and leading cases thereto, on both monetary and non-monetary breaches; Automatic termination (including separate chapters on both confusio and rei interitus); Voluntary termination (Renunciation); and Termination at Natural Expiry and the impact of tacit relocation (including statutory protection and a detailed analysis of the leading cases in this often complex and detailed area of law).

Available in PDF, EPUB and Kindle. Book excerpt: The second edition of Deciding Children’s Futures addresses the thorny task of assessing parents and children who belong to struggling families where there are issues of neglect or significant harm, and when separating parents are contesting arrangements for the care of their children in the family court. This practitioner’s guide discusses how to create relationships and pose questions that breach natural parental defences to understand their histories, anxieties, and needs. Drawing on practice knowledge, theory, and research findings, it integrates the accounts of parents and children with safeguarding imperatives and government guidance, to enable informed decisions that positively impact children’s futures. Chapters address issues such as drug and alcohol misuse, mental health difficulties and learning disabilities, Fabricated or Induced Illness (FII) abuse, and alienation of children, and encourage readers to consider the impact of their own values, histories, and beliefs on the assessment process. This edition is completely updated to reflect all the factors that have impacted assessments for the family court, including updates to case law and procedure rules, devolution of governments, and updates to DSM and ICD diagnostic categories. Providing a comprehensive understanding of assessment for the family court, this user-friendly volume will be of great interest to expert witnesses, social workers, mental health professionals, solicitors, and anyone working in the family court system.

Book excerpt: This practical guide is an introduction to crofting law for those with an interest in it or who may touch upon it, whether that is lawyers, law students, land agents, crofters, landlords, or anyone else with an interest in it. It covers the main issues briefly and concisely, aiming to highlight the complexity of crofting law and the pitfalls and traps that await the uninitiated. The aim is that readers will, as a result, be better versed in the basics of crofting law. ABOUT THE AUTHOR Brian Inkster is a solicitor specialising in crofting law. He is the Hon Secretary of the Crofting Law Group, a member of the Crofting Group of Scottish Land & Estates, the Cross-Party Group on Crofting at the Scottish Parliament, the Scottish Government Crofting Stakeholder Forum, the Crofting Register Stakeholder Forum and the Scottish Government Crofting Bill Group. Brian blogs about crofting law at the Crofting Law Blog (croftinglawblog.com) and regularly writes articles for The Crofter (the trade magazine of the Scottish Crofting Federation). He also provides comment and articles to local and national newspapers and magazines such as The West Highland Free Press, The Shetland Times, The Oban Times, The Northern Times, The Scotsman, The Herald, The Press & Journal, The Scottish Farmer, Scottish Legal News and The Journal of the Law Society of Scotland. Brian also gives talks on crofting law to universities and at conferences, workshops and seminars. He has provided detailed submissions to the Scottish Government on proposed crofting law reform. Brian has been interviewed about crofting law on BBC Alba, BBC Reporting Scotland and Sunday Politics Scotland. He has also been interviewed about crofting law on local and national Scottish radio news programmes. Brian was born and brought up in Shetland. He is the son of a fisherman rather than a crofter. He studied law at the University of Edinburgh before moving to Glasgow in 1991 to undertake his legal traineeship. Following conclusion of his traineeship Brian continued to practice law in Glasgow where he founded his own law firm, Inksters, in 1999. This case was ultimately decided in the House of Lords and has been described by Professor Roddy Paisley as "one of the most important cases on servitudes in the last 100 years". It established for the first time in law that, in certain circumstances, you can have a servitude right to park a car ancillary to a right of access. Brian obtained the distinction of being named Solicitor of the Year at the Law Awards of Scotland in 2006. He was called "a one man Scottish legal institution" in the Recommended Law Firm Guide 2010. At the Law Awards of Scotland in 2014 he was recognised as Managing Partner of the Year. Brian has an active interest in entrepreneurship, marketing, technology and corporate social responsibility in relation to running a law firm. He is often asked to speak on these topics at conferences, summits and retreats.
