Book excerpt: Excerpt from A Philosophical Treatise on the Nature and Constitution of Man, Vol. 2 It may, however, be said that if men are not free to choose, being compelled to select that course which appears the chief good; it must be unjust to inflict punishment for not acting in a particular course, when men are not free to act. To this I reply that the very introduction of the punishment alters the balance of motive, and leads the individual to act in conformity with the law; which he does, nevertheless, quite voluntarily and from choice, as he still follows the course which will ensure him the greatest good, and preserve him from ill.' The frustration of the will, when the individual is compelled by circumstances to pursue a course of conduct different to that dictated by his will, as when he is under restraint; occasions direct violence to his feelings and emotions, and produces a vehement perturbation in the soul.6 Where a course of conduct is pursued different to that which the general result of the con current medial and mental influences would have directed, On account of some special evil threatening us in case we do not follow the former course; it is still the will by which we are determined, although in such case the will itself is not free, but is constrained. Book excerpt: Excerpt from A Philosophical Treatise on the Nature and Constitution of Man, Vol. 1 As regards the various works which have been consulted during the progress of this treatise, the author feels that he ought to State as exactly as he can, the extent to which he has made use of the thoughts and labours of others in this mode, and the manner in which he has turned them to account. To avow that he owes nothing to these able and learned writers, would be doing gross injustice to them. To assert that for everything of value which is here propounded, he is indebted to them, would be doing still grosser injustice to himself. To have attempted a mere epitome of their Opinions, would have been to present a chaos of sentiments which must have appeared as contradictory in principle as they were perplexing, and even valueless, as a source of instruction. The writer has accordingly scrutinized elaborately their various theories, and has availed himself of them much in the same way as a judge turns to account the reasoning of the different advocates who address his court, and the several phases presented by the evidence: not adopting their opposite and inconsistent views and conclusions, nor being misled by their arguments; but from the sum total of the reasoning and facts adduced before him, combined with his own investigation and experience, endeavouring to arrive at such an opinion upon the whole of the circumstances submitted to his consideration, as the entire subject may appear to warrant; and pronouncing such a decision as will meet the merits of the case, and be in con formity with the principles and practice of the law which it is his duty to administer. What appeared to the author to constitute the cream or essence of the thoughts of these distinguished writers, he has extracted, and presented to the reader, as notes in the margin of this work; from which he may both Obtain instruction as regards the wisdom displayed, and also perceive the extent to which the author has availed himself of their ideas. On the one hand, it would have been presumptuous when treating on so important a subject, not to have inquired fully what the greatest minds, who have preceded him, thought on the same topic. On the other hand, it would have been dishonest to have taken advantage of their labours, by putting forth their sentiments and conclusions as his own. The first is that Book II is the theoretical foundation of the Treatise. Second, Garfield argues that we cannot understand Hume's project without an appreciation of his own understanding of custom, and in particular, without an appreciation of the grounding of his thought about custom in the legal theory and debates of his time. Custom is the source of Hume's thoughts about normativity, not only in ethics and in political theory, but also in epistemological, linguistics, and scientific practice- and is the source of his insight that our psychological and social natures are so inextricably linked. The centrality of custom and the link between the psychological and the social are closely connected, which is why Garfield begins with Book II. There are four interpretative perspectives at work in this volume: one is a naturalistic skeptical interpretation of Hume's Treatise; a second is the foregrounding of Book II of the Treatise as foundational for Books I and III. A third is the consideration of the Treatise in relation to Hume's philosophical antecedents (particularly Sextus, Bayle, Hutcheson, Shaftesbury, and Mandeville), as well as eighteenth century debates about the status of customary law, with one eye on its sequellae in the work of Kant, the later Wittgenstein, and in contemporary cognitive science. The fourth is the Buddhist tradition in which many of the ideas Hume develops are anticipated and articulated in somewhat different ways. Garfield presents Hume as a naturalist, a skeptic and as, above all, a communitarian. In offering this interpretation, he provides an understanding of the text as a whole in the context of the literature to which it responded, and in the context of the literature it inspired.
