Book excerpt: From the series, Foundations of Spanish, Mexican and Civil Law. Warren M. Billings, Distinguished Professor of History, Emeritus, University of New Orleans, and Visiting Professor of Law, William and Mary School of Law, Series Editor. Reprint of the first and only edition. Volume I contains Institutes of the Civil Law of Spain, a translation by Judge Johnson of Trinidad of the Instituciones del Derecho Civil de Castilla by Ignacio Jordan de Asso y del Rio, the mode of acquiring dominion from the Instituciones de Derecho Real de Espana by Jose Maria Alvarez and material reprinted from Laws of the State of Coahuila and Texas and Laws, Orders and Contracts, on Colonization, from January, 1821, up to 1829 edited by Stephen Austin. "White's Laws provides a comprehensive survey of historical and cultural events that developed hand-in-hand with the property law of the southern region of the United States. White's Laws also provides a rich illustration of the understanding that nineteenth-century Americans had of the events that related to property law, and it reflects the efforts that the U.S. government was devoting to the unveiling of the legal systems that had been applied in the region. Spanish- and French-speaking scholars may consult White's Laws when searching for a glossary or for terms that English speakers used. At the same time, English-speaking scholars may examine White's Laws when drafting translations

Available in PDF, EPUB and Kindle. Book excerpt: The Spanish element in Texas water law is a matter of utmost importance to many landholders whose livelihood is dependent on securing water for irrigation and to many communities particularly concerned about water supply. Titles to some 280,000 acres of Texas land originated in grants made by the Crown of Spain or by the Republic of Mexico. For these lands, the prevailing law, even today, is the Hispanic American civil law. Thus the question of determining just what water rights were granted by the Spanish Crown in disposing of lands in Texas is more than a matter of historical interest. It is a subject of great practical importance. Spanish law enters directly into the question of these lands, but its influence is by no means confined to them. Texas water law in general traces its roots primarily to the Spanish law, not to the English common law doctrine of riparian rights or to the Western doctrine of prior appropriation (both of which were, however, eventually incorporated in Texas law). A clear understanding of this background might have saved the state much of the current confusion and chaos regarding its water law. Dobkins’s book offers an intensive and unusually readable study of the subject. The author has traced water law from its origin in the ancient world to the mid-twentieth century, interpreting the effect of water on the counties concerned, setting forth in detail the development of water law in Spain, and explaining its subsequent adoption in Texas. Copious notes and a complete bibliography make the work especially valuable. The idea for this book came in the midst of the great seven-year drought in Texas, from 1950 to 1957. The author gave two reasons for her study: “One was my belief that the water problems, crucial to all Texas, can be solved only when Texans become conscious of their imperative needs and only if they become informed and aroused enough to act. “The second reason came from a realization that water—common, universal, and ordinary as it is—had been overlooked by the historian. It is high time that this oversight be corrected. In American history the significance of land, especially in terms of the frontier, has been spelled out in large letters. The importance of water has been recognized by few.”

Available in PDF, EPUB and Kindle. Book excerpt: That They May Possess the Land: The Spanish and Mexican Land Commissioners of Texas (1720-1836) by Galen D. Greaser (author) The grievances accumulated by Anglo-American settlers in Mexican Texas in the 1830s did not include complaints about the generous land grants the government had offered them on advantageous terms. Land ownership is central to the history of Texas, and the land grants awarded in Spanish and Mexican Texas are intrinsic to the story. Population in exchange for land was the prevailing strategy of Spain’s and Mexico’s colonization policy in what is now Texas. Population was the objective; colonization the strategy; and land the incentive. Spain and Mexico defined the formal procedures, qualifications, and conditions for obtaining a land grant. Colonization was a two-part process involving, first, the relocation of colonists from their place of origin to the new site and, second, the placement of colonists on the land in conditions that would enable them to become productive citizens. The colonization effort featured the use of private recruiting agents – empresarios - to assist with the first task. Government agents - land commissioners –oversaw the second objective. Title to some twenty-six million acres of Texas land, about one-seventh of its present area, derives from the land grants made by Spain and Mexico to its settlers. A land commissioner played a part in every case. The story of the empresarios who contributed to the colonization of Texas is a staple of Texas history, but an account of the land commissioners engaged in this process is given here for the first time. The cast of commissioners features, among others, a Spanish field marshal, a Dutch baron, a cashiered United States army colonel, a philandering state official, a self-serving opportunist, an Alamo defender, and a Tejano patriot. Drawn largely from primary sources and richly documented, this sometimes contentious story of the Spanish and Mexican land commissioners of Texas helps complete the narrative of the colonization of Texas and the history of its public domain. This study is a reminder of another lasting legacy of Spanish and Mexican sovereignty in Texas, their land grants.
