This book was released on 2016-09-15 with total page 1920 pages. Available in PDF, EPUB and Kindle. Book excerpt: Murdoch and Hunt's Dictionary of Irish Law defines the principal words, concepts and phrases, their legal source, whether statutory or judicial, and gives a brief introduction to the law. Now in its sixth edition and with its definitions having been cited in the Supreme Court, this book remains essential to the understanding and practice of the law. The dictionary's usefulness lies in the wealth of related information that is pulled together under subject-matter headings. The entries are usually accompanied with the relevant statutory basis, as well as related acts and even, in the case of a major topic of law, noteworthy textbooks in the area. The dictionary draws information from a range of sources including the Rules of the Superior Courts, Law Reform commission Reports, as well as Gazette and Bar Review articles. In this way the dictionary can also be used as a subject-index of Irish law which reflects the up-to-date legislative and judicial developments in each area whilst also encompassing references to academic commentaries. The layout of the dictionary has been carefully designed with alphabetical physical tabulations and bold fonts for entry titles, to ensure the ease and speed of use. The sixth edition of Murdoch and Hunt's Dictionary of Irish Law contains over 10,300 legal definitions from “a coelo usque ad centrum” to “zoonoses”. This new edition adds 533 pages, incorporating 308 acts and 6335 SIs enacted since the 5th edition's publication eight years ago. The ongoing value of the work can be seen in the 23 instances it has been cited by the superior courts in recent years. This value will only grow in this newly expanded and updated edition.

Book excerpt: Scarcely a parish in Ireland is without one or more dedications to saints, in the form of churches in ruins, holy wells or other ecclesiastical monuments. Professor Pádraig Ó Riain's Dictionary of Irish Saints is intended to serve as a guide to the (mainly documentary) sources of information on the saints named in these dedications, for those who have an interest in them, scholarly or otherwise. The need for a summary biographical dictionary of Irish saints, containing information on such matters as feastdays, localisations, chronology, and genealogies, although stressed over sixty years ago by the eminent Jesuit and Bollandist scholar, Paul Grosjean, has never before been satisfied. Professor Ó Riain has been working in the field of Irish hagiography for upwards of forty years, and the material for the over 1,000 entries in his Dictionary has come from a variety of sources, including Lives of the saints, martyrologies, genealogies of the saints, shorter tracts on the saints (some of them accessible only in manuscripts), annals, annates, collections of folklore, Ordnance Survey letters, and other documents. Running to almost 700 pages, the body of the Dictionary is preceded by a Preface, List of Sources and Introduction, and is followed by comprehensive Indices of Parishes, Other Places (mainly townlands), Alternate (mainly Anglicised) Names, Subjects, and Feastdays. Professor Ó Riain's Dictionary has been described as 'an astonishingly comprehensive, intelligent and well-organized work'; it is unlikely to be superseded for many decades to come.

There has been much revision of the text to reflect changes in practice resulting from the pre-contract deduction and investigation of title system introduced by the Law Society's Conditions of Sale 2019 Edition and Requisitions on Title (2019 Edition). The book explains the changes resulting from key legislation like the Land and Conveyancing Law Reform Act 2009 and Property Services (Regulation ) Act 2011. The book further incorporates the substantial case law since the last edition in which the text is frequently cited as authoritative.

Book excerpt: The Oxford Dictionary of Family Names of Ireland contains more than 3,800 entries covering the majority of family names that are established and current in Ireland, both in the Republic and in Northern Ireland. It establishes reliable and accurate explanations of historical origins (including etymologies) and provides variant spellings for each name as well as its geographical distribution, and, where relevant, genealogical and bibliographical notes for family names that have more than 100 bearers in the 1911 census of Ireland. Of particular value are the lists of early bearers of family names, extracted from sources ranging from the medieval period to the nineteenth century, providing for the first time, the evidence on which many surname explanations are based, as well as interesting personal names, locations and often occupations of potential family forbears. This unique Dictionary will be of the greatest interest not only to those interested in Irish history, students of the Irish language, genealogists, and geneticists, but also to the general public, both in Ireland and in the Irish diaspora in North America, Australia, and elsewhere.

This complex area is clearly and concisely explained by two leading experts in the charity law field. As well as fully outlining the legislation, including detailed coverage of the Charities Act 2009, this handbook considers the life cycle of a charity in Ireland: from its creation and registration to its governance and reporting obligations right through to its relations with other charities, at home or abroad, and the demise or dissolution of a charity. Examining the role of the charity trustee in both corporate and unincorporated charities, this book details the key relationships with relevant statutory agencies from the Charities Regulator through to Revenue and the Companies Registration Office. Setting out for the first time the practical issues facing charities operating in Ireland, this handbook is vital for any person concerned with the regulation of charities in this jurisdiction.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the jurisprudence of the Supreme Court of Ireland since its creation in 1924. It sets out the origins of the Court, explains how it operated during the life of the Irish Free State (1922-1937), and considers how it has developed various fields of law under Ireland's 1937 Constitution, especially after the 're-creation' of the Court in 1961. As well as constitutional law, the book looks at the Court's views on the status and legal system of Northern Ireland, administrative law, criminal justice and personal and family law. There are also chapters on the Supreme Court's interaction with European Union law and with the European Convention on Human Rights. The argument throughout is that, while the Court has been well served by many of its judges, who on occasion have manifested a healthy degree of judicial activism, there are still several legal fields in which the Court has not developed its jurisprudence as clearly or as imaginatively as it might have done. It has often displayed undue conservatism and deference. For many years its performance was hampered by its extreme workload, generated by its inability to control the number of appeals brought to it. However, the creation of a new Court of Appeal in 2014 has freed up the Supreme Court to act in a manner more analogous to that adopted by supreme courts in other common law countries. The Court's future looks bright.

Book excerpt: This new title is concerned with the securities law provisions in the Companies Act 2014 and derivative enactments, which are of most concern to listed companies and companies issuing equity and debt securities in Ireland. It deals comprehensively with the legal obligations to produce a prospectus or similar document, what is in it, what are the exceptions, what information must be made available to the markets and what are the other legal consequences on companies and dealers in shares and other securities as a result of having securities admitted to listing. Part A of the book gives an overview of the four key areas: Prospectus, Listing, Market Abuse and Transparency. It explains the structure of the law to enable non-experts to understand the law. Part B gives the legal and regulatory texts, which will be more of interest to lawyers and financiers in this area who need to be familiar with the primary law, which is not as yet readily accessible.

Book excerpt: Legal lexicography or jurilexicography is the most neglected aspect of the discipline of jurilinguistics, despite its great relevance for translators, academics and comparative lawyers. This volume seeks to bridge this gap in legal literature by bringing together contributions from ten jurisdictions from leading experts in the field. The work addresses aspects of legal lexicography, both monolingual and bilingual, in its various manifestations in both civilian and common law systems. It thus compares epistemic approaches in a subject that is inextricably bound up with specific legal systems and specific languages. Topics covered include the history of French legal lexicography, ordinary language as defined by the courts, the use of law dictionaries by the judiciary, legal lexicography and translation, and a proposed multilingual dictionary for the EU citizen. While the majority of contributions are in English, the volume includes three written in French. The collection will be a valuable resource for both scholars and practitioners engaging with language in the mechanism of the law.

It details European case law together with relevant case law from commonwealth countries, as well as detailing any Irish cases on the three areas and also covers design law. It is laid out in a practical and user-friendly way, with each section separate, but cross-referenced where necessary. Since the previous edition, only six years ago, there have been a number of fundamental changes to a number of aspects of intellectual property law, which make this new edition essential. The areas that have been expanded and updated in this edition include: - The voluminous European case law on IP issues arising since 2010 - The impact of the new EU TRade Mark Regulation No 2015/2424 - Supreme Court decisions on the law of passing off (McCambridge Ltd v Joseph Brennan Bakeries) and unregistered design rights (Karen Millen Fashions v Dunnes Stores) Along with these, the book looks to future and the developments on the horizon.
