Book excerpt: Excerpt from A Comparative Glance at the French Code Civil and the Proposed New York Civil Code As We, though less than other nations, are greatly indebted to the Roman laws as codified by Justinian, it may not be uninteresting to glance at their origin. In the early centuries of the Roman State the law was uncertain and unfixed until in the year of Reine 303 the ten. and in 304 the famous XII tables were compiled, this being the oldest known compilation of laws. As time were on and the State grew in extent, population and civilization, these were found insufficient and were supplemented by the plebescite or ordinances of the plebelans and the scnatus consulta, decrees of the senate, the cmctorztas prudentum and jus civilc, or decisions of the jurists. Later, another form of laws called the pretorum edicts arose, and, under the Empire, the Imperial Constitutions. These, however, and especially the latter, grew so numerous that under Theodosiiis, and afterwards Constantine, they were codied. This was, however, so imperfectly done that Justinian, in 528, ordered a new Code to be formed, which was completed in the following year by Triboniaii and revised some years later. This, with the Pandects, formed the law of all parts of the Eastern and Westei nEmpire, before and after its fall; of Europe during the dark and middle ages, coexisting as canonical law with the customs and usages which grew up in various parts of Europe; and even new forms the basis to a great extent of the jurisprudence of the Latin races, and to some extent of all others. The Code Napoleon was the outcome of the French Revolution, of the destruction of the old world, of feudalism, privileges, exclusiveness and tyranny. It was the consecration of the principles of liberty and equality which the Revolution established. It inaugurated a new moral and physical life for the people, who had previously been little higher in the social scale than the cattle attached to the soil. Book excerpt: In Paris during the sixteenth and seventeenth centuries, the practice of adopting children was strongly discouraged by cultural, religious, and legal authorities on the grounds that it disrupted family blood lines. In fact, historians have assumed that adoption had generally not been practiced in France or in the rest of Europe since late antiquity. Challenging this view, Kristin Gager brings to light evidence showing how married couples and single men and women from the artisan neighborhoods in early modern Paris did manage to adopt children as their legal heirs. In so doing, she offers a new, richly detailed portrait of family life, civil law, and public assistance in Paris, and reveals how citizens forged a wide variety of family forms in defiance of social, cultural, and legal norms. Gager bases her work on documents ranging from previously unexplored notarized contracts of adoption to court cases, theological treatises, and literary texts. She examines two main patterns of adoption: those privately arranged between households and those of destitute children from the Parisian foundling hospice and the Hôtel-Dieu. Gager argues that although customary law rejected adoption and promoted an exclusively biological model of the family, there existed an alternative domestic culture based on a variety of "fictive" ties. Gager connects her arguments to current debates about adoption and the nature of the family in Europe and the United States. Originally published in 1996.
