Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Book excerpt: Assessing the effectiveness of the North American Agreement on Labour Cooperation (NAALC), this book examines the operation of the core institutions (the Secretariat and National Administrative Offices) over the past seven years. It discusses the main functions of these institutions in hearing public submissions on violations of labour laws and in conducting research and cooperative activities. Based on interview research, the analysis reviews the strengths and weaknesses of the accord to assess its contribution to a common labour relations regime in North America and its impact in creating new transnational communities of actors in government and civil society in the three countries. The NAALC is also compared with the social dimension of the European Union system, and a final assessment is made as to whether the NAALC institutions live up to the promises of their founders and whether these can be a model for labour relations in any future Free Trade Area of the Americas (FTAA) agreement.

Book excerpt: European governments have re-discovered labour migration, but are eager to be perceived as controlling unsolicited forms of migration, especially through asylum and family reunion. The emerging paradigm of managed migration combines the construction of more permissive channels for desirable and actively recruited labour migrants with ever more restrictive approaches towards asylum seekers. Non-state actors, especially employer organizations, trade unions, and humanitarian non-governmental organisations, attempt to shape regulatory measures, but their success varies depending on organizational characteristics. Labour market interest associations' lobbying strategies regarding quantities and skill profile of labour migrants will be influenced by the respective system of political economy they are embedded in. Trade unions are generally supportive of well-managed labour recruitment strategies. But migration policy-making also proceeds at the European Union (EU) level. While national actors seek to upload their national model as a blueprint for future EU policy to avoid costly adaptation, top-down Europeanization is re-casting national regulation in important ways, notwithstanding highly divergent national regulatory philosophies. Based on field work in and analysis of primary documents from six European countries (France, Italy, United Kingdom, Ireland, Germany, and Poland) this book makes an important contribution to the study of a rapidly Europeanized policy domain. Combining insights from the literature on comparative political economy, Europeanization, and migration studies, the book makes important contributions to all three, while demonstrating how migration policy can be fruitfully studied by employing tools from mainstream political science, rather than treating it as a distinct subfield.

As those forces have shifted power away from national governments and labour unions and toward capital, the appropriate institutional locus of labour regulation has become hotly contested. There have been efforts to move the locus of regulation downward to smaller units of governance, including firms themselves, upward to larger units such as regional federations and international organizations, and outward to non-governmental organizations and civil society. In this volume, labour relations scholars from North America and Europe examine the efficacy of these emerging forms of labour regulation, their democratic legitimacy, the goals and values underlying them, and the appropriate direction of reform.
