Book excerpt: The hope that international adjudication will some day come to replace international aggression has long been a fond aspiration of mankind, and nowhere, perhaps, has it taken firmer root than in the United States. The U.S. Supreme Court has been held up as a model for the successful adjudication of interstate disputes and for the evolution of a body of revered legal norms. Yet America's own record "vis-a-vis" international adjudication and the International Court has been marked by ambivalence and a sharp dichotomy between rhetoric and deeds. Integrating legal and historical materials and insights, Professor Pomerance examines in this volume the troubled saga of the U.S. pursuit of the Supreme Court of the Nations' idea, from its early pre-World War I origins through the present post-"Nicaragua" period of U.S. reserve, disillusionment and reassessment. Spurning a morality-play' interpretive mold, the author pays particular attention to recurrent themes and the roots of their recurrence; the specific cadences and nuances in the grand' and lesser U.S. debates on the Court; the continuities and changes in "both" partners of the U.S.-Court relationship; and the various prisms through which that relationship might be viewed. In this manner, the important contemporary debate on the future contours of the U.S.-Court nexus is sharply illuminated.

Book excerpt: This study examines the reservations to the acceptance of compulsory jurisdiction included in declarations made by States under Article 36(2) of the Statute of the Permanent Court of International Justice and of the Statute of the International Court of Justice and discusses the practical application by the Court of the principle of reciprocity to such reservations in contentious cases submitted to it under Article 36(2). It has been considered that, due to acceptance conditioned by so many diverse, and complicated reservations, the compulsory jurisdiction of the Court has been declining in significance. The recent trend of acceptance of the compulsory jurisdiction does not support such a conclusion. Since the practice of making declarations with reservations has continued, further study of the Court's jurisprudence in dealing with such reservations seems necessary. This analysis attempts to show that reservations in unilateral declarations do not contribute to the decline of the Optional Clause. In fact, reservations provide for the flexibility which many States consider essential in accepting the compulsory jurisdiction of the International Court of Justice. Thus, the right to include a variety of reservations in unilateral declarations may in fact contribute to the wider acceptance of compulsory jurisdiction.

Book excerpt: On 1 August 1946, the Senate Foreign Relations Committee reported Senate Resolution No. 196 to the Senate. The resolution advised and consented to the deposit by the President of the United States with the Secretary General of the United Nations of a declaration accepting compulsory jurisdiction by the International Court of Justice (ICJ) under Article 36 of the Court's Statute. There were two reservations in this resolution. The second reservation was modified in the Senate by the addition of eight words: "as determined by the United States of America." These eight words were the Connally Amendment, and they appear in the declaration filed by President Truman with the Secretary General a month later. They were added to the reservation in which it is provided that the United States recognizes the compulsory jurisdiction of the Court except that the declaration shall not apply to "disputes with regard to matters which are essentially within the domestic jurisdiction of the United States." The Senate Report discloses that the Committee had considered and rejected the self-judging clause. Considerably distilled, Senator Connally's oratory in support of his short amendment laid emphasis on the fear that the Court "might decide that immigration was an international question ... that tariffs were an international question ... that navigation was an international question."
