Book Synopsis A Prelude to the Welfare State by : Price V. Fishback
Download or read book A Prelude to the Welfare State written by Price V. Fishback and published by University of Chicago Press. This book was released on 2000 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Workers' compensation was arguably the first widespread social insurance program in the United States--before social security, Medicare, or unemployment insurance--and the most successful form of labor legislation to emerge from the early progressive movement. In A Prelude to the Welfare State, Price V. Fishback and Shawn Everett Kantor challenge widespread historical perceptions by arguing that workers' compensation, rather than being an early progressive victory, succeeded because all relevant parties--labor and management, insurance companies, lawyers, and legislators--benefited from the ruling.

Available in PDF, EPUB and Kindle. Book excerpt: This large-scale comparative study analyses the two principal mechanisms employed in modern legal systems to deal with the social problem of occupational illness and injury, namely, employers' liability and workers' compensation. It provides a detailed description of the systems in operation in twelve countries around the world, investigating the complex legal structures and the interaction with other social institutions, as well as their inter-jurisdictional coordination through private international law. Current international trends are identified and assessed and the fundamental political issues highlighted and explored. The study's ultimate goals are not only descriptive but also to answer the question of how compensation and liability systems can best be adapted to meet society's needs in the 21st century. The countries covered are: Australia (Mark Lunney), Austria (Ernst Karner/Felix Kernbichler), Denmark (Vibe Ulfbeck), England and Wales (Richard Lewis), France (Florence G'Sell/Isabelle Veillard), Germany (Raimund Waltermann), Italy (Alessandro P Scarso/Massimo Foglia), Japan (Keizo Yamamoto/Tomohiro Yoshimasa), the Netherlands (Siewert D Lindenbergh), Poland (Domenika Dörre-Nowak), Romania (Christian Alunaru/Lucian Bojin) and the United States of America (Michael D Green/Daniel S Murdock). The book is completed by three concluding essays that address general themes: Thomas Thiede, The European Coordination of Employers' Liability and Workers' Compensation Ken Oliphant, The Changing Landscape of Work Injury Claims: Challenges for Employers' Liability and Workers' Compensation Gerhard Wagner, New Perspectives on Employers' Liability - Basic Policy Issues
Book Synopsis Workers and Welfare by : Michelle L. Dion
Download or read book Workers and Welfare written by Michelle L. Dion and published by University of Pittsburgh Pre. This book was released on 2010-02-28 with total page 329 pages. Available in PDF, EPUB and Kindle. Book excerpt: After the revolutionary period of 1910-1920, Mexico developed a number of social protection programs to support workers in public and private sectors and to establish safeguards for the poor and the aged. These included pensions, healthcare, and worker's compensation. The new welfare programs were the product of a complex interrelationship of corporate, labor, and political actors. In this unique dynamic, cross-class coalitions maintained both an authoritarian regime and social protection system for some seventy years, despite the ebb and flow of political and economic tides. By focusing on organized labor, and its powerful role in effecting institutional change, Workers and Welfare chronicles the development and evolution of Mexican social insurance institutions in the twentieth century. Beginning with the antecedents of social insurance and the adoption of pension programs for central government workers in 1925, Dion's analysis shows how the labor movement, up until the 1990s, was instrumental in expanding welfare programs, but has since become largely ineffective. Despite stepped-up efforts, labor has seen the retrenchment of many benefits. Meanwhile, Dion cites the debt crisis, neoliberal reform, and resulting changes in the labor market as all contributing to a rise in poverty. Today, Mexican welfare programs emphasize poverty alleviation, in a marked shift away from social insurance benefits for the working class.

This book was released on 2012-12-06 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: Until a few years ago I concentrated my attention on workers' compensa tion programs in the United States and Canada. Because the United States has 52 programs and Canada has eight, I was exposed to a diversity of approaches that caused me to believe that few other approaches existed. Since 1984 I have become more aware of what the rest of the world has been doing and discovered that my knowledge needed to be broadened significantly. The trigger action was a 1984 faculty research exchange agreement between Keio University in Tokyo and the University of Minnesota that made it possible for me to spend much of my time studying Japan's workers' compensation program and comparing it with the United States approaches. Japan's program had several features that I had not encountered in the United States or Canada. After this experience I attached considerably more value to and spent more time studying the Social Security Administration's biennial reports on Social Security Pro grams Throughout The World, which include workers' compensation programs. I also presented papers at two meetings of the International Insurance Society based on my Japanese and Social Security Adminis tration report research. Many participants urged further study in this area and offered to send me materials describing their nations' programs. The result is this study which I hope that readers will find interesting and worthwhile.
Book Synopsis A Prelude to the Welfare State by : Price V. Fishback
Download or read book A Prelude to the Welfare State written by Price V. Fishback and published by University of Chicago Press. This book was released on 2007-11-01 with total page 331 pages. Available in PDF, EPUB and Kindle. Book excerpt: Workers' compensation was arguably the first widespread social insurance program in the United States and the most successful form of labor legislation to emerge from the early Progressive Movement. Adopted in most states between 1910 and 1920, workers' compensation laws have been paving seen as the way for social security, Medicare, unemployment insurance, and eventually the broad network of social welfare programs we have today. In this highly original and persuasive work, Price V. Fishback and Shawn Everett Kantor challenge widespread historical perceptions, arguing that, rather than being an early progressive victory, workers' compensation succeeded because all relevant parties—labor and management, insurance companies, lawyers, and legislators—benefited from the legislation. Thorough, rigorous, and convincing, A Prelude to the Welfare State: The Origins of Workers' Compensation is a major reappraisal of the causes and consequences of a movement that ultimately transformed the nature of social insurance and the American workplace.

Book Synopsis The Accidental Republic by : John Fabian Witt
Download or read book The Accidental Republic written by John Fabian Witt and published by Harvard University Press. This book was released on 2009-07-01 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the five decades after the Civil War, the United States witnessed a profusion of legal institutions designed to cope with the nation’s exceptionally acute industrial accident crisis. Jurists elaborated the common law of torts. Workingmen’s organizations founded a widespread system of cooperative insurance. Leading employers instituted welfare-capitalist accident relief funds. And social reformers advocated compulsory insurance such as workmen’s compensation. John Fabian Witt argues that experiments in accident law at the turn of the twentieth century arose out of competing views of the loose network of ideas and institutions that historians call the ideology of free labor. These experiments a century ago shaped twentieth- and twenty-first-century American accident law; they laid the foundations of the American administrative state; and they occasioned a still hotly contested legal transformation from the principles of free labor to the categories of insurance and risk. In this eclectic moment at the beginnings of the modern state, Witt describes American accident law as a contingent set of institutions that might plausibly have developed along a number of historical paths. In turn, he suggests, the making of American accident law is the story of the equally contingent remaking of our accidental republic.
