In The Secret Life of Bacon Tait, Hank Trent tells Tait’s complete story for the first time, reconstructing the hidden aspects of his strange and often paradoxical life through meticulous research in lawsuits, newspapers, deeds, and other original records. Active and ambitious in a career notorious even among slave owners for its viciousness, Bacon Tait nevertheless claimed to be married to a free woman of color, Courtney Fountain, whose extended family were involved in the abolitionist movement and the Underground Railroad. As Trent reveals, Bacon Tait maintained his domestic sphere as a loving husband and father in a mixed-race family in the North while running a successful and ruthless slave-trading business in the South. Though he possessed legal control over thousands of other black women at different times, Trent argues that Tait remained loyal to his wife, avoiding the predatory sexual practices of many slave traders. No less remarkably, Courtney Tait and their four children received the benefits of Tait’s wealth while remaining close to her family of origin, many of whom spoke out against the practice of slavery and even fought in the Civil War on the side of the Union. Book excerpt: A Degraded Caste of Society traces the origins of twenty-first-century cases of interracial violence to the separate and unequal protection principles of the criminal law of enslavement in the southern United States. Andrew T. Fede explains how antebellum appellate court opinions and statutes, when read in a context that includes newspaper articles and trial court and census records, extended this doctrine to the South’s free Black people, consigning them to what South Carolina justice John Belton O’Neall called “a degraded caste of society,” in which they were “in no respect, on a perfect equality with the white man.” This written law either criminalized Black insolence or privileged private white interracial violence, which became a badge of slavery that continued to influence the law in action, contrary to the Constitution’s mandate of equal protection of the criminal law. The U.S. Supreme Court enabled this denial of equal justice, as did Congress, which did not make all private white racially motivated violence a crime until 2009, when it adopted the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act. Fede’s analysis supports that law’s constitutionality under the Thirteenth Amendment, while suggesting why—during the Jim Crow era and beyond—equal protection of the criminal law was not always realized, and why the curse of interracial violence has been a lingering badge of slavery.

Book excerpt: In 1834 Virgil Stewart rode from western Tennessee to a territory known as the "Arkansas morass" in pursuit of John Murrell, a thief accused of stealing two slaves. Stewart's adventure led to a sensational trial and a wildly popular published account that would ultimately help trigger widespread violence during the summer of 1835, when five men accused of being professional gamblers were hanged in Vicksburg, nearly a score of others implicated with a gang of supposed slave thieves were executed in plantation districts, and even those who tried to stop the bloodshed found themselves targeted as dangerous and subversive. Using Stewart's story as his point of entry, Joshua D. Rothman details why these events, which engulfed much of central and western Mississippi, came to pass. He also explains how the events revealed the fears, insecurities, and anxieties underpinning the cotton boom that made Mississippi the most seductive and exciting frontier in the Age of Jackson. As investors, settlers, slaves, brigands, and fortune-hunters converged in what was then America's Southwest, they created a tumultuous landscape that promised boundless opportunity and spectacular wealth. Predicated on ruthless competition, unsustainable debt, brutal exploitation, and speculative financial practices that looked a lot like gambling, this landscape also produced such profound disillusionment and conflict that it contained the seeds of its own potential destruction.
