Southern Pacific Company, a Corporation, Appellee The stipulation at pages 1171 and 1172 recites that the record on appeal by the American Dredging Com pany will be identical with that of the appeal of the Western Pacific Railway Company, with the exception of certain papers filed subsequent to that appeal, and then provides for those papers being added to the West ern Pacific Railway Company's record on appeal and that both appeals shall be heard on the same record. These papers added to the record on the appeal of the Western Pacific are the interlocutory decree awarding an injunction against American Dredging Company, pages 1 174 et seq., and the formal appeal papers of last named appellant. Therefore the question for this Court is whether the decree set out at pages 1 174-1 177 was or was not justified by the record of pleadings and evi dence as contained in the record on the appeal of the Western Pacific Railway Company.
