Available in PDF, EPUB and Kindle. Book excerpt: This textbook presents an engaging and thorough examination of the law in Northern Ireland. It guides students through the evolution of law-making, the legislative process, courts, and case law and presents a clear overview of the fundamental rules and principles of international law, public law, criminal law, and private law. It contextualises the myriad legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice, and provides useful information on how people become lawyers, what lawyers actually do once they become qualified, and how the legal system is funded. The appendices set out sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents. This edition has been updated following recent legal developments in Northern Ireland including the 'New Decade, New Approach' agreement of 2020 and the different elements of the power-sharing government, such as the proposed Languages Bill and the Northern Ireland (Ministers, Elections and Petitions of Concern) Bill. It explains the effect of Brexit, in particular the new concept of 'retained EU law' and the effect of the Ireland / Northern Ireland Protocol to the EU-UK Withdrawal Agreement. Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

Available in PDF, EPUB and Kindle. Book excerpt: This book constitutes the first thorough academic analysis of legislative drafting. By placing the study of legislation and its principles within the paradigm of Flyvberg's phronetic social sciences, it offers a novel approach which breaks the tradition of unimaginative past descriptive reiterations of drafting conventions. Instead of prescribing rules for legislation, it sets out to identify efficacy as the main aim of the actors in the policy, legislative and drafting processes, and effectiveness as the main goal in the drafting of legislation. Through the prism of effectiveness as synonymous with legislative quality, the book explores the stages of the drafting process; guides the reader through structure and sections in their logical sequence, and introduces rules for drafting preliminary, substantive and final provisions. Special provisions, comparative legislative drafting and training for drafters complete this thorough analysis of the drafting of legislation as a tool for regulation. Instead of teaching the reader which drafting rules prevail, the book explores the reasons why drafting rules have come about, thus encouraging readers to understand what goal is served by each rule and how each rule applies. The book is aimed at academics and practitioners who draft or use statutory law in the common or civil law traditions.

Book excerpt: Cities are amongst our greatest creations. Yet, with cities now home to over half the world's population, there is increasing concern over their unchecked expansion and the detrimental effect this is having on the planet. This unfettered growth is affecting every ecosystem on Earth, from the deepest oceans to the highest mountains, as induced climate change and ever increasing demands upon the world's resources take effect. As the pace of urbanisation quickens, how can we make the world's cities more sustainable? Ian Douglas tells the story of cities. He shows why they exist, how they have evolved and the problems they have encountered, revealing how from the very beginning environmental management played a key role in urban life. He addresses specific problems, such as noise and air pollution, water supply and waste management, as well as the vulnerability of cities to hazards such as earthquakes and flooding. And he considers strategies to make cities more sustainable and help them adapt to climate change, such as waste recycling, energy conservation, dual water systems, sustainable housing, as well as initiatives to retrofit existing cities. Written by an acknowledged international authority, this unique volume will be welcomed by students and specialists in environment, planning, geography, ecology and the built environment.

Available in PDF, EPUB and Kindle. Book excerpt: The study of the law of tort is generally preoccupied by case law, while the fundamental impact of legislation is often overlooked. At a jurisprudential level there is an unspoken view that legislation is generally piecemeal and at best self-contained and specific; at worst dependent on the whim of political views at a particular time. With a different starting point, this volume seeks to test such notions, illustrating, among other things, the widespread and lasting influence of legislation on the shape and principles of the law of tort; the variety of forms of legislation and the complex nature of political and policy concerns that may lie behind their enactment; the sometimes unexpected consequences of statutory reform; and the integration not only of statutory rules but also of legislative policy into the operation of tort law today. The apparently sharp distinction between judicially created private law principles, and democratically enacted legislative rules and policies, is therefore questioned, and it is argued that to describe the principles of the law of tort without referring to statute is potentially highly misleading. This book shows that legislation is important not only because of the way it varies or replaces case law, but because it also deeply influences the intrinsic character of that law, providing some of its most familiar characteristics. The book provides the first extended interpretation of legislative intervention in the law of tort. Each of the chapters, by leading tort scholars, deals with an aspect of the influence of legislation on the law of tort. While the nature, sources and extent of legislative influence in personal injury law is an essential feature of the collection, other significant areas of tort law are explored, including tort in the context of commercial law, labour law, regulation and the welfare state. Essays on the Compensation Act 2006 and Human Rights Act 1998 bring the current state of the interplay between tort, politics and legislation to the forefront. In all of these contexts, contributors explore the deeper lessons that can be learned about the nature of the law of tort and its changing role and functions over time. Book excerpt: Pollutants, Human Health and the Environment is a comprehensive, up-to-date overview of environmental pollutants that are of current concern to human health. Clearly structured throughout, the main body of the book is divided by pollutant type with a chapter devoted to each group of pollutants. Each chapter follows a similar format to facilitate comparison and discussion. For each pollutant, the authors describe the sources, pathways, environmental fate and sinks as well as known toxicological effects. Importantly, the second chapter on heavy metals and other inorganic substances deals with trace element deficiencies which can have serious problems for human health. Some rocks and soils are naturally low in some trace elements and intensive agriculture over the past half century has effectively mined many trace elements reducing their levels in soils and crops. The final chapter is a discussion about the various risk assessment frameworks and regulations covering the main pollutants. Comprehensive, up-to-date coverage of environmental pollutants of concern to human health Clearly divided into pollutant type with each chapter devoted to a different pollutant group Clearly structured throughout with the same format for each chapter to help facilitate comparison and discussion and enable readers to prioritise chemicals of concern Description of the sources, pathways, environmental fate and known toxicological effect Includes contributions from leading researchers and edited by a team of experts in the field
