Available in PDF, EPUB and Kindle. Book excerpt: Human Rights after Hitler is a groundbreaking history about the forgotten work of the UN War Crimes Commission (UNWCC), which operated during and after World War II in response to Axis atrocities. He explains the commission's work, why its files were kept secret, and demonstrates how the lost precedents of the commission's indictments should introduce important new paradigms for prosecuting war crimes today. The UNWCC examined roughly 36,000 cases in Europe and Asia. Thousands of trials were carried out at the country-level, and hundreds of war criminals were convicted. This rewrites the history of human rights in the wake of World War II, which is too focused on the few trials at Nuremberg and Tokyo. Until a protracted lobbying effort by Plesch and colleagues, the UNWCC's files had been kept out of public view in the UN archives under pressure from the US government. The US initially wanted the files closed to smooth the way for post-war collaboration with Germany and Japan, and the few researchers who did gain permission to see the files were not permitted to even take notes until the files' recent release. Now revealed, the precedents set by these cases should have enormous practical utility for prosecuting war crimes today.

Available in PDF, EPUB and Kindle. Book excerpt: This 15-volume series summarizes the course of the more important proceedings taken against individuals accused of war crimes during World War II, excluding the major war criminals tried by the Nuremberg and Tokyo International Military Tribunals. These representative trials of war criminals were selected for this series based on the major points of municipal and international law that were raised and settled during the trials as well as the potential for the greatest legal interest. For example, Volume 4 includes the trial of General Tomoyuki Yamashita (PDF). Each volume begins with a unique introduction by the Right Honorable Lord Wright of Durley, Chairman of the United Nations War Crimes Commission. This third volume includes reports of ten cases. They are drawn from widely distant parts of the globe; the trial courts are diverse in character. consisting of National Courts and Military Courts acting under different warrants or commissions: The charges were diversified in character. 'Perhaps the most important case from the standpoint of international law is that which stands first in the volume. The prisoner was a German named Klinge. He was indicted before a Norwegian Court for torturing Norwegian civilians, and in one case so as to cause the victim's death., The ,trial court sentenced him to death under Articles of the Civil Criminal Code as modified by a Provisional Decree of 1945, which gave new and special powers to the Court in the 'case of war crimes, including the power to impose the death sentence where under the-relevant articles of the Civil Criminal Code imprisonment was the severest penalty.

Available in PDF, EPUB and Kindle. Book excerpt: In this fresh edition of the book which has inspired the global justice movement, Geoffrey Robertson QC explains why we must hold political and military leaders accountable for genocide, torture and mass murder - the crimes against humanity that have disfigured the world. He shows how human rights standards can be enforced against cruel governments, armies and multi-national corporations. This seminal work now contains a critical perspective on recent events, such as the invasion of Iraq, the abuses at AbuGhraib, the killings in Darfur, the death of Milosevic and the trial of Saddam Hussein. Cautiously optimistic about ending impunity, but unsparingly critical of diplomats, politicians, Bush lawyers and others who evade international rules, this third edition will provide further guidance to a movement which aims to make justice predominant in world affairs. 'A beacon of clear-sighted commitment to the humanitarian cause. . . impassioned. . . exemplary. . . seminal' Observer

Available in PDF, EPUB and Kindle. Book excerpt: As World War II recedes from living memory, there remain untold stories of important behind-the-scenes operatives who provided vital support to the leaders celebrated in historical accounts. Colonel Truman Smith is one of the most compelling figures from this period, but there has never been a biography of this important and controversial man. In Exposing the Third Reich, Henry G. Gole tells this soldier's story for the first time. An American aristocrat from a prominent New England family, Smith was first assigned to Germany in 1919 during the Allied occupation and soon became known as a regional expert. During his second assignment in the country as a military attaché in 1935, he arranged for his good friend Charles Lindbergh to inspect the Luftwaffe. The Germans were delighted to have the famous aviator view their planes, enabling Smith to gather key intelligence about their air capability. His savvy cultivation of relationships rendered him invaluable throughout his service, particularly as an aide to General George C. Marshall; however, the colonel's friendliness with Germany also aroused suspicion that he was a Nazi sympathizer. Gole demonstrates that, far from condoning Hitler, Smith was among the first to raise the alarm: he predicted many of the Nazis' moves years in advance and feared that the international community would not act quickly enough. Featuring many firsthand observations of the critical changes in Germany between the world wars, this biography presents an indispensable look both at a fascinating figure and at the nuances of the interwar years.

Book excerpt: This report of the President's Commission on Law Enforcement and Administration of Justice -- established by President Lyndon Johnson on July 23, 1965 -- addresses the causes of crime and delinquency and recommends how to prevent crime and delinquency and improve law enforcement and the administration of criminal justice. In developing its findings and recommendations, the Commission held three national conferences, conducted five national surveys, held hundreds of meetings, and interviewed tens of thousands of individuals. Separate chapters of this report discuss crime in America, juvenile delinquency, the police, the courts, corrections, organized crime, narcotics and drug abuse, drunkenness offenses, gun control, science and technology, and research as an instrument for reform. Significant data were generated by the Commission's National Survey of Criminal Victims, the first of its kind conducted on such a scope. The survey found that not only do Americans experience far more crime than they report to the police, but they talk about crime and the reports of crime engender such fear among citizens that the basic quality of life of many Americans has eroded. The core conclusion of the Commission, however, is that a significant reduction in crime can be achieved if the Commission's recommendations (some 200) are implemented. The recommendations call for a cooperative attack on crime by the Federal Government, the States, the counties, the cities, civic organizations, religious institutions, business groups, and individual citizens. They propose basic changes in the operations of police, schools, prosecutors, employment agencies, defenders, social workers, prisons, housing authorities, and probation and parole officers.
