The report tells a story of how Australia's First Nations communities and their cultural values are included in the management of water in Australia's Murray-Darling Basin. It explores themes regarding the recognition or identification of First Nations water values, how these values are considered in decision making, and the protection of these values. Connection to land and waters is fundamental to the cultural values of First Nations people and there is increasing progress in recognising and involving First Nations in restoring sustainable management as Australia continues its journey of dealing with increasing water demands in a highly variable and changing climate. However, only in recent decades has there been a move towards legal and moral recognition of ownership of the lands and waters occupied by its many nations before colonisation of Australia from 1788.The report looks at the inclusion of First Nations values and perspectives in water management across the Basin through various statutory mechanisms, tailored engagement processes and mainstream community engagement activities. The case study concludes with some general lessons about efforts in the Murray-Darling River Basin to recognise, assess and realise Indigenous cultural values associated with water that may be useful for others.

Book excerpt: Abstract: Fresh water supplies increasingly are under stress in many parts of the world due to rising populations, higher per capita incomes and corresponding consumption, greater environmental concerns, and the effects of climate change. Water rights and markets are part of the institutional menus for responding to these problems. We examine water markets in both Australia's MDB and the western US and their prospects for addressing water scarcity. The two regions share a number of important similarities including: climate variability that requires investment in reservoirs to make water available in low-rainfall periods; the need for internal and cross-border (state) water management; an historical major allocation of water to irrigators; increasing competition among different uses (agricultural, environmental and recreational in situ uses, urban demand); and the potential for water trading to more smoothly and quickly allocate water across these competing uses. A comparison of the two regions provides important insights about how economic factors can encourage more efficient water allocation, market structure and government regulation. We show that rights are more clearly defined and trading more common in Australia than appears to be the case in the western U.S. Longer periods of scarcity and hence, higher water values may explain this difference

It argues that while the principles (National Water Initiative) and rules (Water Act 2007) of water reform provide the framework to achieve the goals of reform, the financial incentives (2008 Water for the Future) need to change. In particular, the $3.1 billion allocated to buying water entitlements and the $5.8 billion targeted for water infrastructure subsidies under Water for the Future should be combined and spent on the basis of 'value for money'. If this were accomplished, and the funds were spent prior to the implementation of sustainable diversion limits in July 2011, the Australian Government would be much more likely to achieve a sustainable future for the environment and agriculture within the Basin, at no extra cost.
