Following this approach to highway contracting, the contract specifications are expressed in terms of the performance of the roadway after it is placed into service, rather than in terms of the construction methods to be used or the final properties to be achieved in building the facility. Perceived benefits of the in service warranty approach include that a) the contractor is directly motivated to provide a facility that meets the needs of the motoring public (i.e., a smooth, safe roadway) rather than simply to meet prescribed construction standards, and b) competitive market forces will result in the design and construction of innovative and efficient roadway projects. This approach to highway construction contracting differs significantly from the approach currently used in Montana, and thus the results of using this approach are uncertain. This study has been divided into two phases. Phase I consists of a) identifying the critical issues that must be addressed if in service warranties are to be used, b) reviewing the manner in which these contracts have been implemented in Europe and across the U.S., c) determining current perceptions in Montana regarding these contracts, and d) formulating recommendations for demonstration in service warranty projects to be awarded in Montana. Phase II of the project involves a) developing a formal in service warranty contract instrument based on the recommendations from Phase I, b) selecting demonstration projects to be constructed using these contracts, c) monitoring their construction and in-service performance, and d) doing a cost to benefit analysis of the projects. Phase I of this study has been completed and the results are presented in this report. Issues that need to be addressed in developing warranty contracts on in service roadway performance include the aspects of the roadway behavior to be warranted, the duration of the warranty, the payment terms, the bid procedure, etc. Examples of how these issues can be addressed are available from Europe, where the use of in service warranties appears to be commonplace, and the U.S., where several state departments of transportation have recently researched and awarded demonstration warranty projects. The Montana Department of Transportation and the Montana construction community and bonding agents have a variety of concerns regarding the use of in service warranties on roadway construction projects. Many of these concerns can only be definitively answered by awarding and studying demonstration warranty projects. The first conclusion of Phase I is that the demonstration projects should be reconstruction jobs, on moderately traveled highways. Second, the projects should be warranted with respect to ride, rutting, cracking, and skid resistance for a period of 5 to 10 years. Contract awards should be based on securing the best technical quality for the lowest price. Finally, a maintenance bond should be required.

This has caused varied reactions from the parties involved in the design and construction of highways, resulting in a General Accounting Office study on methods for improving the quality of federal-aid highways, including the use of warranties. Ultimately, the owner will have to decide whether to use warranties in highway construction projects. Some of the potential benefits and concerns of using warranties, plus needed actions for successful implementation are presented in this synthesis, which is considered a snapshot of the issues at the time of publication.

Book excerpt: In a bid to ensure cost-effective highway construction practices, highway agencies constantly seek ways to accelerate project design and delivery through implementation of innovative contracting and procurement practices. The concept of warranties, which is one of such promising practices, involves a shift of the burden of construction quality control, product performance and product maintenance from the owner to the contractor. As such, warranty projects are expected to enhance product quality and service life, and ultimately, reduced life-cycle cost. The expected benefits of warranty projects, however, could be offset by their historically higher construction costs. It is therefore necessary to evaluate the costs and benefits of warranty contracts vis-à-vis traditional contracts so that the more cost-effective practice can be identified. The present study reviewed the state of warranty practice in highway pavement construction in Indiana and elsewhere, collects data on warranty and traditional contracts, and carried out statistical analyses to evaluate the relative costs, effectiveness and cost-effectiveness of these two alternative contracting practices. Effectiveness was measured in terms of average pavement condition and pavement service life, and costs were expressed in annualized costs per lane-mile. All costs were adjusted for inflation and economy of scale. The study confirmed that the warranty contracts generally have higher agency costs than traditional contracts, but produced pavements that were superior to their traditional counterparts in terms in average pavement condition (rutting, cracking and roughness) and service life. It was determined that the typical projected treatment life of warranty contract pavement was 25 years while similar traditional contract pavements had a service life of 15 years. The study results suggest that the superiority of warranty projects over traditional projects is more discernible when both cost and effectiveness are viewed over the entire life of the pavement treatment.

Book excerpt: As the primary focus of the Virginia Department of Transportation (VDOT) changes from highway construction to transportation maintenance, there is an increased need to extend the value derived from limited funding resources by increasing the service life of pavement rehabilitation treatments. In this regard, the development of a pavement warranty contract and a performance specification was considered in an effort to ensure that VDOT continues to deliver the highest quality pavement to the traveling public. The concept of a pavement warranty allows for a department of transportation to specify either performance criteria or materials properties that are to be met at the time of project acceptance or throughout the warranty period. These criteria are to be met through the efforts of the contractor in performing periodic maintenance or rehabilitation if required. Reports from the literature suggest that implementing warranty specifications may improve the final quality of the pavement project, reduce the state inspection forces required, and shift some of the responsibility from the department to the contractor. Other reports suggest that disadvantages may include a potential for reduced competition and higher material bid prices during the initial stages of warranty implementation. In an effort to help increase the overall quality of the roadway network and thus increase the service life of pavement resurfacings, VDOT sought to investigate the use of a warranty clause as part of an upcoming resurfacing contract. A performance-based warranty clause was developed in this pilot study to be included as part of the contract documents for a typical interstate resurfacing project. In this process, the bidding contractors would be given information about the condition of the pavement obtained from data collected through cores and the falling weight deflectometer and then the contractor would be responsible for developing the resurfacing pavement design that fulfilled the conditions of the warranty clause. The review of the submitted bids would be conducted in two stages where the technical merit of a proposal would be evaluated prior to the opening of a cost estimate. Because of the extensive deterioration of the pavement, the warranty concept was not pursued for the pilot project. This report recommends that the warranty concept be applied in another location as part of a future study. Reports in the literature from other state departments of transportation indicate that although warranties have the potential to improve overall pavement performance and reduce life-cycle costs, they must be developed such that competition between contractors is not reduced.
