L'achoppement principal a trait aux preuves d'un fait générateur de responsabilité et d'un lien de causalité entre ce dernier et le dommage subi. De même, les producteurs rencontrent des écueils importants pour que leurs demandes d'exonération de responsabilité soient accueillies. Ces aspects témoignent de l'inadaptation du droit positif à l'endroit du défaut indécelable de la chose. Cela explique pour partie l'utilisation accrue de la technique contractuelle, par les producteurs, pour ménager leurs intérêts et le refus des assureurs de couvrir les risques inconnaissables, auxquels appartient le défaut indécelable de la chose. Le seul mécanisme mis en oeuvre à ce jour, pour assurer la réparation des victimes en présence d'un défaut indécelable, est celui du jeu de la solidarité nationale. De nouvelles voies doivent être empruntées, au travers du droit civil, du droit des assurances et de la solidarité nationale. Sur le plan de la technique juridique, le défaut indécelable intègre la catégorie des risques assurables. L'instauration d'une assurance obligatoire assortie d'une obligation d'assurance s'impose aujourd'hui, à la charge des producteurs. Elle doit être préférée à l'assurance directe, qui reste une solution inéquitable. La solidarité nationale doit être maintenue, mais exclusivement dans une fonction subsidiaire. En outre, un fonds de solidarité alimenté par les diverses branches d'activités auxquelles appartiennent les créateurs de risques doit être instauré. Parallèlement, des aménagements s'imposent en droit civil. Ils s'étendent du phénomène de résurgence de la faute, à l'extension du manquement à la vigilance, en passant par les concepts de traçabilité et d'imputabilité. Ces adaptations nouvelles se font à la faveur tant des victimes que des producteurs et se révèlent impérieuses pour asseoir une juste répartition du poids des conséquences dommageables de l'indécelabilité du défaut.

Asylum doctors in nineteenth-century France promoted the notion that manliness was synonymous with rationality, using this "fact" to pathologize non-normative behaviors and confine people who did not embody mainstream gender expectations to asylums. And yet, this gendering of rationality also had the power to upset prevailing dynamics between men and women. Jessie Hewitt argues that the ways that doctors used dominant gender values to find "cures" for madness inadvertently undermined both medical and masculine power—in large part because the performance of gender, as a pathway to health, had to be taught; it was not inherent. Institutionalizing Gender examines a series of controversies and clinical contexts where doctors' ideas about gender and class simultaneously legitimated authority and revealed unexpected opportunities for resistance. In order to provide results based on real insurance portfolios, use is made of three software packages, namely SLIC performing stop-loss insurance calculations for individual and collective risk models, CRAC dealing with actuarial applications of credibility theory, and LORE giving IBNR-based estimates for loss reserves. Worked-out examples illustrate the theoretical results. This book is intended for use in preparing university actuarial exams, and contains many exercises with varying levels of complexity. It is valuable as a textbook for students in actuarial sciences during their last year of study.
