Book excerpt: Encompassing all the major fields of legal practice, Introduction to Turkish Law provides an essential understanding of the Turkish legal system, so that users can become familiar with law and legal processes in Turkey and pursue further research on specific Turkish legal matters. Twelve chapters, written by Turkish experts in their areas of specialty, focus on particular fields and provide also the Turkish equivalents of English terminology. The book covers the following topics: * sources of Turkish law; * constitutional law; * administrative law; * legal persons and business associations; * family and inheritance matters; * property; * obligations; * criminal law; and * the laws of civil and criminal procedure. The sixth edition reflects the continuing adaptation of Turkish law to international standards - especially in light of Turkey's hopes for membership in the European Union. These aspirations forced the Turkish lawmakers to modify some basic laws intensively or change them entirely. A short updated list of books and articles in English on Turkish law is appended.

Book Synopsis The Right to Counsel and the Protection of Attorney-Client Privilege in Criminal Proceedings by : Lorena Bachmaier Winter
Download or read book The Right to Counsel and the Protection of Attorney-Client Privilege in Criminal Proceedings written by Lorena Bachmaier Winter and published by Springer Nature. This book was released on 2020-06-10 with total page 440 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book provides an overview of the right to counsel and the attorney-client privilege in the following 12 jurisdictions: China, Germany, Greece, Italy, Japan, the Netherlands, Portugal, Spain, Switzerland, Turkey, UK and USA. The right to counsel is a fundamental right providing the accused access to justice in criminal proceedings. Lawyers can only practice their profession properly if clients have complete trust in their lawyer’s discretion. This trust is safeguarded by the attorney-client privilege, which is an indispensable part of every constitutional state and one of the most important professional duties of a lawyer. It is of particular importance in criminal proceedings regarding the protection of the confidentiality of lawyer-client communications in the different procedural stages, coercive measures as well as the various duties and interests in play. However, the communications protected by attorney-client privilege vary greatly from country to country. With regard to criminal investigations in an increasingly globalised world, where sophisticated tools enable broad digital investigations, there is an urgent need to clarify how this fundamental right is protected at both the national and supranational level. Each chapter explores the regulations, practices and recent developments in each jurisdiction and was written by highly qualified experts in the legal field – from academia and practice alike. It identifies possible solutions and best practices, providing valuable insights for practitioners and law-making bodies alike regarding the actual protection (or lack thereof) of lawyer-client confidentiality in the pretrial and trial stage of criminal proceedings.

Book Synopsis Counter-Terrorist Financing Law and Policy by : Burke Uğur Başaranel
Download or read book Counter-Terrorist Financing Law and Policy written by Burke Uğur Başaranel and published by Routledge. This book was released on 2019-04-09 with total page 286 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the 9/11 attacks the world has witnessed the creation of both domestic and international legal instruments designed to disrupt and interdict the financial activities of terrorists. This book analyses the counter-terrorist financing law (CTF), policy and practice at the national level, focusing on Turkey. The work examines the limits and capabilities of CTF efforts on terrorism threats and determines the effectiveness of CTF efforts in Turkey, a country which has a pivotal role in terms of countering terrorism regionally and internationally. The Turkish case-study is supported by an empirical study involving 37 semi-structured interviews with CTF practitioners and law enforcement experts with different affiliations and backgrounds. The findings illustrate that Turkey’s CTF system has not obtained an adequate level of effectiveness as a result of lack of proper implementation of its policy in the bureaucratic, legal and operational spheres. It is evident that the administrative and legal systems in Turkey are established according to the ‘one-size-fits-all’ international CTF standards and thus are compliant with the international CTF benchmarks, yet the interviews reveal significant challenges at the implementation level including lack of training and financial security, heavy handed bureaucracy, inadequate coordination and communication between international and national levels. The book will be an invaluable resource for academics, students and policy-makers working in the areas of financial crime and terrorism.

Book Synopsis Visual Evidence and the Gaza Flotilla Raid by : Maayan Amir
Download or read book Visual Evidence and the Gaza Flotilla Raid written by Maayan Amir and published by Bloomsbury Publishing. This book was released on 2022-01-13 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book engages with pivotal examples of extraterritoriality-from Antiquity and into the twenty first century-in order to broaden the original judicial and geographical definition and thereby include physical and digitized information, and visual data in particular. By focusing on a critical incident of recent Middle Eastern history-namely,the Gaza Freedom Flotilla of 2010 which sailed against Israel's enduring blockade-it shows how the device of extraterritoriality shapes not only the political situation in Gaza, the legal status of the maritime environment in which the flotilla incident took place, and the judicial actions taken in response but also reveals how the concept of extraterritoriality is key to explaining the State's subsequent efforts to confiscate and monopolize all visual evidence of its alleged violations of international statutes. Through the lens of the missing visual evidence characterizing the Mavi Marmara incident after-effects, it explores how the legal system's ability to evade transparency seems to be a built-in condition for eluding criminal accountability at the international level, with the emphasis on extraterritoriality's fundamental role in fashioning our current legal and political orders.
Book Synopsis Effective Criminal Defence in Europe by : Ed Cape
Download or read book Effective Criminal Defence in Europe written by Ed Cape and published by Intersentia NV. This book was released on 2010 with total page 696 pages. Available in PDF, EPUB and Kindle. Book excerpt: Every year, millions of people across Europe - innocent and guilty - are arrested and detained by the police. For some, their cases go no further than the police station, but many others eventually appear before a court. Many will spend time in custody both before and following trial. Initial attempts by the European Union to establish minimum procedural rights for suspects and defendants failed in 2007, in the face of opposition by a number of Member States who argued that the European Court of Human Rights (ECHR) rendered EU regulation unnecessary. However, with ratification of the Lisbon Treaty, criminal defense rights are again on the agenda. Based on a three year research study, this book explores and compares access to effective defense in criminal proceedings across nine European jurisdictions (Belgium, England/Wales, Finland, France, Germany, Hungary, Italy, Poland, and Turkey) that constitute examples of the three major legal traditions in Europe: inquisitorial, adversarial, a
