Book excerpt: Excerpt from The Trust Company Idea and Its Development It was formerly laid down that corporations could not be trustees. The reason assigned for this rule was that they could not be compelled to execute a trust, for Courts of Equity in decreeing the execution of a trust lay hold upon the conscience, and it is impossible that a body so artificially created could have a conscience. Again, it was said they could not be imprisoned if they refused to obey the rules of the court But these technical rules have long ceased to operate, and to-day in more than one country the trust company is as firmly established as the bank. It is interesting to note how starting from a common basis, the services of executor and trustee, distinct and totally different types of trust companies have been developed in the British Colonies and the United States reflecting on the one hand the conservative British character and on the other the versatile and organizing genius of the American people. Book excerpt: Excerpt from Trusts, Pools and Corporations The first requisite, therefore, for the successful conduct of economic instruction in the descriptive field is to provide raw material; which in discussion, supplementary to the general lec tures, may be worked over in detail in the classroom. Such material, by reason of the great increase in economic periodical literature since 1890, is now rapidly augmenting. Yet with classes often aggregating in such economic courses from one to two hundred men, as at Harvard University, resort by each student to the files of such periodical literature is out of the question. Public documents are also impossible for reference reading with a class of considerable size. And finally, in my judgment, a generally neglected and amazingly rich find lies em bedded in the mass of factual evidence accumulated in the course of legal proceedings in our courts. The mere decisions, as long currently used, are of course well known. But it is not the legal pronouncement in the case, infrequently interlarded with brief statements of fact, but the actual testimony adduced The Record of evidence submitted which has rarely been utilized. Such matter must be painstakingly uncovered, abridged, even digested, and made more conveniently accessible, to serve its due end for the teacher. To direct attention to this material by a few concrete illustrations from such sources, reprinted in this volume, is not an unimportant motive in its production. Book excerpt: Excerpt from The Truth About the Trusts: A Description and Analysis of the American Trust Movement While there is much discussion being carried on, yet the actual facts seem everywhere to be wanting. We read essays, more or less intelligent, by professed students of the subject; we read the labored treatises of college professors and other experts in political econ omy; we see the Shallow and uncertain references which are fre quently made to the tendency in political platforms, and the some times even more shallow bills which are introduced and rushed through our legislatures in the seemingly vain attempt to remedy the evils of the Trust we even hear expressed now and then, a practical Opinion from the lips Of some keen, successful business man - and conversely, we find the field flooded with socialistic liter ature on the subject. There are all sorts Of theories being propagated and ideas being advanced which essay to right the wrongs said to be caused by the growth Of the Trusts. There are condemnations and defenses; Sharp criticisms and pointless ones; apologies, chaotic and irrational; championships, vapid and absurd. Some Of these at tempts reflect study and thought; others prejudice and temper. Very few, whatever position may be taken, are fair and frank with all the various phases Of the question or appear to treat the subject in an entirely just and impartial manner. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Modern Trust Company: Its Functions and Organization To a correspondent asking, "What book or books will best give me a working knowledge of trust company and banking methods; particularly regarding the work of the various departments of the trust companies?" the New York Evening Post recently replied that so far as it was aware no such book had been published. A search in library catalogues confirms the almost equally discouraging statement of the Chief Bibliographer of the Library of Congress that "there is not much literature on trust companies appearing in separate book form." On the other hand, much has been written about the functions, organization, and methods of the banks. The reason is easily given. The development of the "trust company idea" is a recent one, and only within the past twenty years have these corporations become a prominent factor in the financial world. Until the organization of the Trust Company Section of the American Bankers Association in 1896, the only publications in reference to trust companies were short chapters in works on banking and an occasional magazine article. Since that time the transactions of the Trust Company Section and articles in banking periodicals and the financial press have constituted the most important contributions to the subject; but in spite of all that has been written on special lines of trust company work, it is still difficult to obtain a general knowledge of what a trust company is and how it does its business. The aim of the present volume is to describe the functions and organization of the trust company as it exists in the United States to-day.
