The Education Commission of the States (ECS) analysts reviewed laws in the 50 states in creating an online database that highlights how state charter school laws vary, particularly in how states establish standards and accountability for charter school authorizers, allow for appeals, provide assistance with start-ups and fund charter schools. Recently, attention to authorizers--the entities responsible for approving and overseeing charter schools--has increased. A growing number of states are establishing standards and reporting requirements that authorizers must adhere to. Six evolving policy areas in state charter school laws are discussed in this brief. Other rapidly evolving policy areas discussed in this brief are limits or "caps" on the number of charter schools allowed in a state, automatic performance-based closures and virtual or "cyber" charter schools.

There are approximately 5,000 charter schools in the United States (about 5 percent of schools) and a push from parents and the Department of Education for more. Given that many charters authorized during the initial wave of charter applications have not proven themselves to be any better than traditional public schools, there have been efforts to tighten up authorizing. In an effort to screen out weak proposals and applicants, the application process has become much longer (i.e., 18-24 months), more demanding, less flexible, and more bureaucratic. As a consequence, students' access to innovative and high-quality options for education is being limited. Charter authorizing is a critical function and will increasingly shape public education in the United States. At the beginning of 2010, there were 872 authorizers including state education authorities, school districts, universities, nonprofit organizations, and two municipalities. The recommendations of this paper are most relevant to the 70 authorizers with more than 10 charter schools and a statewide scope. The 20 state charter offices in that category employ an average of 2.7 staff members. This paper recommends expanded as well as differentiated authorizing capacity for the maturing charter school sector. State education policymakers (legislatures and state boards) should consider six distinct authorizing pathways with associated capacity. These are: (1) Standard. An updated authorizing process should focus on qualified first-time applicants proposing a single school based on a proven school model with demonstrated community support; (2) High Performing. A short-form application with quick turnaround should be available for operators of two or more high-performing schools; (3) Innovation. Qualified applicants with a strong hypothesis should be able to seek conditional approval for innovative school models that incorporate novel assessment systems, performance-based progress, unique staffing and compensation models, distributed learning, blended institutions, and/or year-round learning. State commissioners could modify criteria to target specific reforms, populations, or geographies; (4) Online. Reflecting the Internet's ability to cross municipal and state borders, virtual and blended operators should have the ability to enroll students statewide and/or across a multi-state region under a reciprocal charter agreement; (5) Turnaround. School improvement providers should be invited to propose in a two-step process that would result in a list of preapproved vendors that are subsequently matched with turnaround or restart opportunities; and (6) Conversion. The conversion of a high-performing public or private school to charter status warrants special consideration. Conversions warrant a statewide (non-district) authorizer to ensure real charter status and treatment. This monograph is intended to promote discussion about emerging issues. It does not reflect adopted positions of the National Association of Charter School Authorizers (NACSA). It includes the author's personal opinions and anecdotes about charter school authorizing. There are some gratifying results, with near-unanimous adoption of such key practices as requiring financial audits of schools and performance contracts between authorizers and schools. The National Association of Charter School Authorizers (NACSA) extensive evaluation work discloses, for example, that there can be wide variation in the quality of contracts executed by one authorizer versus another. It's clear, though, that this report presents a strong argument for capacity and scale: NACSA's survey sample includes nearly all large authorizers active during the 2012-2013 school year. Large authorizers, who oversee approximately 66% of the charter school student population, have increasingly implemented more of NACSA's Essential Practices, whether considered cross-sectionally for each year or longitudinally for authorizers that responded both years. Conversely, the 2013 results indicate that it is more difficult for small authorizers to establish a full range of professional practices. Authorizers located within traditional education systems (local and state education agencies) seem to have a harder time adopting strong authorizer practices than those located in other types of organizations. Independent chartering boards, the statewide agencies created solely to approve and oversee charter schools, score highest among all types of authorizers across a number of categories, suggesting that their tight focus on charter school quality provides a strong incentive for honing their own skills. That is one reason NACSA has fought to establish such agencies and has helped defend them when threatened by legal and political attacks.

It is part of the U.S. Department of Education's 4-year study to document and analyze the charter-school movement. The study asked two questions: What changes have districts made in district operations and district education that can be attributed to charter schools? and Under what conditions do charter schools affect change in district operations and district education? To answer these questions, researchers conducted in-depth site visits in 14 school districts and interviewed by telephone administrators in 35 other districts. The results indicate that every district in the study reported being affected by charter schools and, accordingly, had made operational changes. Nearly half of the district leaders believed that their diminished budgets were attributable to charter schools and had begun tracking the number of students who attended these schools. Likewise, almost half of these leaders reported becoming more customer-service oriented, increasing their marketing and public-relations efforts, or heightening their frequency of communication with parents. Most districts also implemented new educational programs, made changes in educational structures in district schools, and/or created new schools with programs that were similar to those in the local charter schools.
