Book excerpt: Excerpt from Treatise on the American Law of Administration, Vol. 1 of 2 English writers looked upon as an encroachment by the Church, and which common law courts jealously resented. The origin of distinct courts with probate powers in America cannot, certainly, be ascribed to such a cause, since ecclesiastical tribunals never possessed secular powers in this country. The reason is found in the nature of property, which requires for its control, after the owner's death, tribunals with functions different from those of courts adjusting property rights between litigants sui juris. Again, it is well known that the common law is shaped in many particulars by the feudal principles introduced by the Conqueror, while in America, at least since the Revolution, the feudal tenure has never been recognized, and feudal theories are therefore in applicable here. It is obvious, then, that property means quite a different thing at common law, as modelled on feudal principles, from property in the sense of modern statutes, whether English or American, and that the construction of such a statute from the common law point of view would be liable to lead to error and inconsistency. Book excerpt: Excerpt from A Treatise on State and Federal Control of Persons and Property in the United States, Considered From Both a Civil and Criminal Standpoint, Vol. 1 In the days when popular government was unknown, and the maxim Quod principi placuit, legis habet vigorem, seemed to be the fundamental theory of all law, it would have been idle to speak of limitations upon the police power of government; for there were none, except those which are imposed by the finite character of all things natural. Absolutism existed in its most repulsive form. The king ruled by divine right, and obtaining his authority from above he acknowledged no natural rights in the individual. If it was his pleasure to give to his people a wide room for individual activity, the subject had no occasion for complaint. But he could not raise any effective opposition to the pleasure of the ruler, if he should see fit to impose numerous restrictions, all tending to oppress the weaker for the benefit of the stronger. But the divine right of kings began to be questioned, and its hold on the public mind was gradually weakened, until, finally, it was repudiated altogether, and the opposite principle substituted, that all governmental power is derived from the people; and instead of the king being the vicegerent of God, and the people subjects of the king, the king and other officers of the government were the servants of the people, and the people became the real sovereign through the officials. Book excerpt: Excerpt from A Treatise on the Rules Which Govern the Interpretation and Construction of Statutory and Constitutional Law The treatise upon the Interpretation and Application of Stat utery and Constitutional Law, like that upon the Measure of°dam ages by the same author, has been, from the date of its publication, regarded as a legal classic. Based, in the main, ' upon the decisions of American courts, and discussing the principles of statutory con struction as they have been expounded and illustrated by those tribunals, it has been far more useful to the American lawyer, and has been more readily accepted as a guide and helper by American judges, than any work upon the same subject founded chiefly upon English precedents and drawing its materials from English sources. Originally published in the year 1857, the first impression was long ago exhausted, and a new edition has long been demanded. This want is now supplied, and a new edition is offered to the profession. It is proper for the editor to explain its plan, and the nature and scope of the additions which he has made. Book excerpt: Excerpt from Treatise on the Civil Jurisdiction of Justices of the Peace in the State of New-York, Vol. 1 of 2 In exemplifying any principle advanced, I have generally pursued the more usual course of authors, by giving a brief outline of the facts contained in the case itself, as reported, or stated, in the author te ferred to. To this remark, there will, however, be found many excep tions. And where I supposed the case so complicated and technical as to confound the general reader, I have usually dismissed it at once. Available in PDF, EPUB and Kindle. Book excerpt: The Max Planck Handbooks in European Public Law series describes and analyses the public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, it aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series begins this enterprise with an appraisal of the evolution of the state and its administration, with cross-cutting contributions and also specific country reports. While the former include, among others, treatises on historical antecedents of the concept of European public law, the development of the administrative state as such, the relationship between constitutional and administrative law, and legal conceptions of statehood, the latter focus on states and legal orders as diverse as, e.g., Spain and Hungary or Great Britain and Greece. With this, the book provides access to the systematic foundations, pivotal historic moments, and legal thought of states bound together not only by a common history but also by deep and entrenched normative ties; for the quality of the ius publicum europaeum can be no better than the common understanding European scholars and practitioners have of the law of other states. An understanding thus improved will enable them to operate with the shared skills, knowledge, and values that can bring to fruition the different processes of European integration.
