Book excerpt: Quelle est la place du repos en droit du travail ? A l'origine, la finalité du repos consiste à limiter les durées excessives du travail afin de protéger la santé et la sécurité des travailleurs. La première loi sociale du 22 mars 1841 initie le mouvement en limitant la durée du travail des enfants. Puis une succession de lois et de règlements viendront étayer cette finalité. La seconde finalité d'un droit au repos consiste à prolonger la première en assurant la santé du salarié mais également en assurant son développement et le respect de sa vie personnelle, familiale et sociale. Le droit du travail influence le droit au repos afin de répondre à ces deux premières finalités. De cette façon, le droit au repos accède au rang de droit de l'homme figurant au sein du Préambule de la Constitution du 27 octobre 1946 et repris dans notre actuelle Constitution du 4 octobre 1958. La troisième finalité préconise le droit au repos, comme outil d'organisation et de fonctionnement de l'entreprise. Etroitement lié avec la rémunération du salarié, il devient le moyen d'organiser au sein de l'entreprise et le cas échéant au dehors de l'entreprise, les temps de travail et les temps de non travail : repos compensateurs, compte épargne temps, conventions de forfait... Cette finalité organisationnelle permet d'étendre les mécanismes d'aménagement et de réduction du temps de travail. Ici, le droit au repos influence le droit du travail et lui offre une définition plus positive que celle admise généralement « d'inverse du temps de travail ». Peut-il émerger une véritable catégorie juridique du repos en droit du travail ? La réalité du droit au repos ainsi que l'autonomie de celui-ci passe par la qualité de ce dernier. C'est en effet à la seule condition de la reconnaissance d'un vrai repos non suceptible d'ingérences extérieures qu'il faut tendre. Le droit au repos autonome mais en interaction avec le droit du travail est la seule possibilité servant à faire évoluer de la meilleure façon le droit de la durée du travail
