Book Synopsis Law and Identity in Colonial South Asia by : Mitra Sharafi
Download or read book Law and Identity in Colonial South Asia written by Mitra Sharafi and published by Cambridge University Press. This book was released on 2014-04-21 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the legal culture of the Parsis, or Zoroastrians, an ethnoreligious community unusually invested in the colonial legal system of British India and Burma. Rather than trying to maintain collective autonomy and integrity by avoiding interaction with the state, the Parsis sank deep into the colonial legal system itself. From the late eighteenth century until India's independence in 1947, they became heavy users of colonial law, acting as lawyers, judges, litigants, lobbyists, and legislators. They de-Anglicized the law that governed them and enshrined in law their own distinctive models of the family and community by two routes: frequent intra-group litigation often managed by Parsi legal professionals in the areas of marriage, inheritance, religious trusts, and libel, and the creation of legislation that would become Parsi personal law. Other South Asian communities also turned to law, but none seems to have done so earlier or in more pronounced ways than the Parsis.

Book excerpt: In this new edition of The Amish and the State Donald Kraybill brings together legal scholars and social scientists to explore the unique series of conflicts between a traditional religious minority and the modern state. In the process, the authors trace the preservation—and the erosion—of religious liberty in American life. Kraybill begins with an overview of the Amish in North America and describes the "negotiation model" used throughout the book to interpret a variety of legal conflicts. Subsequent chapters deal with specific aspects of religious freedom over which the Amish and the state have clashed. Focusing on the period from 1925 to 2001 in the United States, the authors examine conflicts over military service and conscription, Social Security and taxes, education, health care, land use and zoning, regulation of slow-moving vehicles, and other first amendment issues. New concluding chapters, by constitutional expert William Ball, who defended the Amish before the Supreme Court in 1972 in the landmark Wisconsin v. Yoder case, and law professor Garret Epps, assess the Amish contribution to preserving religious liberty in the United States.

Book excerpt: LES PARSIS - By D. Menant - 1902 - CONTENTS - CHAPTER 1. THE EXODUS OF THE PARSIS I 11. THE ZOROASTRIANS iN PERSIA . 38 INTRODUCTION - INTRODUCTION - A SPECIAL interest attaches to this translation into English of D. Menants monograph entitled Les Parsis, arising from the circumstance that it is, in great part, the work of a Parsi lady, the late Miss Ratanbai Ardeshir Vakil. 1 have still a vivid recollection of the morning in the beginning of the year 1886 on which Mr. Ardeshir F. Vakil, senior partner in one of the leading firms of solicitors in Bombay, brought his two daughters Meherbai and Ratanbai to the Wilson ColIege to begin their career as students of the Bombay University. AIthough for many years that University had prefaced its Regulations with the sentence- In the following regulations the pronoun he and its derivatives are used to denote either sex, and had thus opened its doors wide to the women of India, only one lady student had been enrolled as undergraduate in Arts before these two sisters entered upon their College career. The experiment which was then made awakened some anxieties. Would it be possible for Indian ladies to study in a mixed College class How would the men be likely to conduct themselves in the new situation -these were questions which naturally presented themselves. The result of the experiment disappointed from the beginning all such fears. From the first day the presence of these ladies elevated the tone and discipline of the College class in a manner most creditable to the ladies and to the men. The success of this experiment paved the way for the admission during subsequent years of an increasing number of lady students to the privileges of a University education, who are under no small obligation.................
