It is to lay before the Senate the proceedings of a meeting of the building mechanics of the city and county of Philadelphia, convened for the purpose of expressing their opinions on the present state of the country, on the 24th of February. This meeting consisted of three thousand persons, and was composed of carpenters, masons, brick-makers, bricklayers, painters and glaziers, lime-burners, plasterers, lumber-merchants, and others, whose occupations are connected with the building of houses. I am proud, Sir, that so respectable, so important, and so substantial a class of mechanics have intrusted me with the presentment of their opinions and feelings, respecting the present distress of the country, to the Senate. I am happy if they have seen, in the course pursued by me here, a policy favorable to the protection of their interest, and the prosperity of their families. To tell the truth, and at the same time to avoid a lapse into the horrors of grandiloquence, would have been one of the supreme tests of literary skill. But Nature has an unbroken custom of inserting the compensation balance into her work; and thus, in the case of Webster, it came about that he was unkindly kept alive a little too long, whereby he encountered the occasion of the seventh of March, 1850, and made upon that day a speech which is perhaps the most famous in our history, and also surely the most unfortunate. The order of subse quent events shows plainly that there was no rea son for this too long survival upon his part. For his great work had already been done; and neither that speech, nor anything which he did afterward in the brief remainder of his life, much afiected the course of events in the country. The numerous manuscripts in Mr. Webster's possession at the time of his death, were, when collected and cursorily examined, placed in the hands of Mr. William Thaddeus Harris, of Cam bridge, to be assorted, and, as far as their nature admitted, alphabetically arranged. By the law of New Jersey, if any citizen of that State shall be restrained, under the New York law, from using steamboats be tween the ancient shores of New Jersey and New York, he shall be entitled to an action for damages, in New Jersey, with treble costs against the party who thus restrains or impedes him under the law of New York! This act of New Jersey is called an act of retortion against the illegal and oppressive legislation of New York; and seems to be defended on those grounds of public law which justify reprisals between independent States. It will hardly be contended, that all these acts are consistent with the laws and Constitution of the United States. If there is no power in the general government to control this extreme belligerent legislation of the States, the powers of the govern ment are essentially deficient in a most important and interest ing particular. The present controversy respects the earliest of these State laws, those of New York. On these, this court is now to pronounce; and if they should be declared to be valid and Operative, I hope somebody will point out where the State right stops, and on what grounds the acts of other States are to be held inoperative and void. It will be necessary to advert more particularly to the laws of New York, as they are stated in the record. The first was passed March lgth, 1787. By this act, a sole and exclusive right was granted to John Fitch, of making and using every kind of boat or vessel impelled by steam, in all cree 's, rivers, bays, and waters within the territory and jurisdiction of New York, for fourteen years.
