Book Synopsis Law in Northern Ireland by : Brice Dickson
Download or read book Law in Northern Ireland written by Brice Dickson and published by Bloomsbury Publishing. This book was released on 2023-06-30 with total page 531 pages. Available in PDF, EPUB and Kindle. Book excerpt: This textbook presents an engaging and thorough examination of the law in Northern Ireland. It guides students through the evolution of law-making, the legislative process, courts, and case law and presents a clear overview of the fundamental rules and principles of international law, public law, criminal law, and private law. It contextualises the myriad legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice, and provides useful information on how people become lawyers, what lawyers actually do once they become qualified, and how the legal system is funded. The appendices set out sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents. This edition has been updated following recent legal developments in Northern Ireland including the 'New Decade, New Approach' agreement of 2020 and the different elements of the power-sharing government, such as the proposed Languages Bill and the Northern Ireland (Ministers, Elections and Petitions of Concern) Bill. It explains the effect of Brexit, in particular the new concept of 'retained EU law' and the effect of the Ireland / Northern Ireland Protocol to the EU-UK Withdrawal Agreement. Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

Book Synopsis The process of constitutional change by : Great Britain: Parliament: House of Lords: Select Committee on the Constitution
Download or read book The process of constitutional change written by Great Britain: Parliament: House of Lords: Select Committee on the Constitution and published by The Stationery Office. This book was released on 2011-07-18 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: The constitution is the foundation upon which law and government are built. Yet the United Kingdom has no agreed process for constitutional change. The Committee does not accept that the government should be able to pick and choose which processes to apply when proposing significant constitutional change. It therefore recommends in this report the adoption of a clear and consistent process. These recommendations are not intended to restrict the government's right to initiate constitutional change, but to hold ministers to account for their decisions. The Committee regard it as essential that, prior to the introduction of a bill which provides for significant constitutional change, the government considers the impact of the proposals upon the existing constitutional arrangements, subject the proposals to detailed scrutiny in the Cabinet and its committees, consult widely, publish green and white papers, and subject the bill to pre-legislative scrutiny. The Committee looks at these processes in this report, as well as considering the desirability of public engagement and building consensus. Also the importance of not rushing parliamentary scrutiny of legislation once introduced into Parliament and of conducting comprehensive post-legislative scrutiny of significant constitutional legislation once passed. Also recommended is the minister responsible for a significant constitutional bill in each House set out the processes to which a bill has been subjected in a written ministerial statement. This comprehensive package from which the government should depart only in exceptional circumstances and where there are clearly justifiable reasons for so doing. The Committee believes this approach is pragmatic and achievable, enabling the flexibility of the United Kingdom's current constitutional arrangements to be retained whilst enhancing and underpinning those arrangements

Book Synopsis Modern Studies in Property Law - Volume 7 by : Nicholas Hopkins
Download or read book Modern Studies in Property Law - Volume 7 written by Nicholas Hopkins and published by Bloomsbury Publishing. This book was released on 2014-07-18 with total page 846 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contains a collection of peer reviewed papers presented at the ninth biennial Modern Studies in Property Law conference held at the University of Southampton in March 2012. It is the 7th volume to be published under the name of the conference. The conference and its published proceedings have become an established forum for property lawyers from around the world to showcase current research in the discipline. This collection reflects both the breadth of modern research in property law and its international dimensions. Incorporating a keynote address by Lord Walker of Gestingthorpe, retired Justice of the Supreme Court, on 'The Saga of Strasbourg and Social Housing,' a number of chapters reveal the bourgeoning influence of human rights in property law. Other contributions illustrate an enduring need to question and explore fundamental concepts of the subject alongside new and emerging areas of study. Collectively the chapters demonstrate the importance and relevance of property research in addressing a wide range of contemporary issues.
