Book excerpt: Excerpt from Virginia Reports, Jefferson-33 Grattan, 1730-1880: Volumes 1, 2, 3 and 4 Leigh Carr, J. TO understand correctly the ln struction given by the circuit court to the jury which tried the issue of devisavit vel non, we must not take it as an abstract proposition, but (as it was given) in connec tion with and as applicable to the case proved in evidence. Thus it was proved, (as is clear to me from the bill of exceptions), that the whole transaction Of signing and attesting the will, took place in the testator's bed-room and that the testator, before the witnesses subscribed, being asked if he acknowledged the will, and wished them to attest it, answered affirmatively. These facts enter in to the instruction of the court as if it had been said to the jury. In such a case as this, where the whole transaction took place in one room, and the testator acknowledged the will, and desired the wit nesses to attest it, if you believe that his mind was sufliciently sound to know the necessity of the precautions prescribed by the act, and he could have had himself turned in bed so as to see the witnesses, or have had them move so that he could have seen them. And he did neither, still it was an attestation in his presence. And this instruction, I strongly incline to think was correct. TO these pleas the plaintiff replied generally. At the trial, a statement Of facts was agreed on by the parties and submitted to the court for its decision on the law arising on the case agreed, in the same manner as if it had been a demurrer to evidence, and that the judgment shall be rendered according to the very right of the case without regard to the plead lugs. This book was released on 2003-11-03 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: From the end of the Revolution until 1851, the Virginia legislature granted most divorces in the state. It granted divorces rarely, however, turning down two-thirds of those who petitioned for them. Men and women who sought release from unhappy marriages faced a harsh legal system buttressed by the political, religious, and communal cultures of southern life. Through the lens of this hostile environment, Thomas Buckley explores with sympathy the lives and legal struggles of those who challenged it. Based on research in almost 500 divorce files, The Great Catastrophe of My Life involves a wide cross-section of Virginians. Their stories expose southern attitudes and practices involving a spectrum of issues from marriage and family life to gender relations, interracial sex, adultery, desertion, and domestic violence. Although the oppressive legal regime these husbands and wives battled has passed away, the emotions behind their efforts to dissolve the bonds of marriage still resonate strongly.
