Book excerpt: Public participation is a vital part of constitution-making processes around the world, but we know very little about the extent to which participation affects constitutional texts. In this book, Alexander Hudson offers a systematic measurement of the impact of public participation in three much-cited cases - Brazil, South Africa, and Iceland - and introduces a theory of party-mediated public participation. He argues that public participation has limited potential to affect the constitutional text but that the effectiveness of participation varies with the political context. Party strength is the key factor, as strong political parties are unlikely to incorporate public input, while weaker parties are comparatively more responsive to public input. This party-mediation thesis fundamentally challenges the contemporary consensus on the design of constitution-making processes and places new emphasis on the role of political parties.

A common feature of SLAPPs is that their intention is rarely to win the case or secure a remedy; rather, the suit is brought to create a chill on political expression. Blocking Public Participation examines the different types of litigation and causes of action that frequently form the basis of SLAPPs, and how these lawsuits transform political disputes into legal cases, thereby blocking political engagement. The resource imbalance between plaintiffs and defendants allows plaintiffs to tie up defendants in complex and costly legal processes. The book also examines the dangers SLAPPs pose to political expression and to the quality and integrity of our democratic political institutions. Finally, the book examines the need to regulate SLAPPs in Canada and assesses various regulatory proposals. In Canada, considerable attention has been paid to the “legalization of politics” and the impact on the Charter in diverting political activism into the judicial arena. SLAPPs, however, are an under-studied element of this process, and in their obstruction of political engagement through recourse to the courts they have profound implications for democratic practice.

Burning the veil draws upon sources from newly-opened archives, exploring the ‘emancipation’ of Muslim women from the veil, seclusion and perceived male oppression during the Algerian War of decolonisation. The claimed French liberation was contradicted by the violence inflicted on women through rape, torture and destruction of villages. This book examines the roots of this contradiction in the theory of ‘revolutionary warfare’, and the attempt to defeat the National Liberation Front by penetrating the Muslim family, seen as a bastion of resistance. Striking parallels with contemporary Afghanistan and Iraq, French ‘emancipation’ produced a backlash that led to deterioration in the social and political position of Muslim women. This analysis of how and why attempts to Westernise Muslim women ended in catastrophe has contemporary relevance and will be important to students and academics engaged in the study of French and colonial history, feminism and contemporary Islam.
