Available in PDF, EPUB and Kindle. Book excerpt: The Supreme Court decision that property owners may be entitled to compensation for government regulations that deprive them of reasonable use of their property has thrown the land-use field into a state of turmoil. Will municipal land-use ordinances be found excessive? What regulations can be considered a reasonable exercise of police power for public health, safety, and welfare? Will municipalities be liable for compensation to property owners if development is restricted? How can municipalities and developers plan in the wake of this decision?Ordinance provisions cover components of subdivision regulation: general provisions, definitions, administration, procedure, design and improvements, off-tract improvements, and documents to be submitted. The Subdivision and Site Plan Handbook provides a narrative on the background, rationale, and intent of each requirement accompanying the model ordinance; gives an overview of the history of subdivision regulation in the United States; traces the evolution of land-use regulation through various stages; and presents the legal context for present-day regulation. The book has been designed for use by government administrators, developers, planners, attorneys, and others interested in land-use regulation. The model ordinance represents the most current thinking about land use and site control and responds to questions raised by the Supreme Court decision. David Listokin and Carole Walker's analyses are flexible, efficient, responsive to local conditions, and balance regulatory costs and benefits. This is a definitive and invaluable resource!

Available in PDF, EPUB and Kindle. Book excerpt: Saving the Neighborhood tells the charged, still controversial story of the rise and fall of racially restrictive covenants in America, and offers rare insight into the ways legal and social norms reinforce one another, acting with pernicious efficacy to codify and perpetuate intolerance. The early 1900s saw an unprecedented migration of African Americans leaving the rural South in search of better work and equal citizenship. In reaction, many white communities instituted property agreements—covenants—designed to limit ownership and residency according to race. Restrictive covenants quickly became a powerful legal guarantor of segregation, their authority facing serious challenge only in 1948, when the Supreme Court declared them legally unenforceable in Shelley v. Kraemer. Although the ruling was a shock to courts that had upheld covenants for decades, it failed to end their influence. In this incisive study, Richard Brooks and Carol Rose unpack why. At root, covenants were social signals. Their greatest use lay in reassuring the white residents that they shared the same goal, while sending a warning to would-be minority entrants: keep out. The authors uncover how loosely knit urban and suburban communities, fearing ethnic mixing or even “tipping,” were fair game to a new class of entrepreneurs who catered to their fears while exacerbating the message encoded in covenants: that black residents threatened white property values. Legal racial covenants expressed and bestowed an aura of legitimacy upon the wish of many white neighborhoods to exclude minorities. Sadly for American race relations, their legacy still lingers.

Book excerpt: Born and reared on the outskirts of Kansas City in Olathe, Kansas, Jesse Clyde Nichols (1880-1950) was a creative genius in land development. He grew up witnessing the cycles of development and decline characteristics of Kansas City and other American cities during the late nineteenth and early twentieth centuries. These early memories contributed to his interest in real estate and led him to pursue his goal of neighborhoods in Kansas City, an idea unfamiliar to that city and a rarity across the United States. J.C. Nichols was one of the first developers in the country to lure buyers with a combination of such attractions as paved streets, sidewalks, landscaped areas, and access to water and sewers. He also initiated restrictive covenants and to control the use of structures built in and around his neighborhoods. In addition, Nichols was involved in the placement of services such as schools, churches, and recreation and shopping areas, all of which were essential to the success of his developments. In 1923, Nichols and his company developed the Country Club Plaza, the first of many regional shopping centers built in anticipation of the increased use of automobiles. Known throughout the United States, the Plaza is a lasting tribute to the creativity of J.C. Nichols and his legacy to the United States. With single-mindedness of purpose and unwavering devotion to achievement, J.C. Nichols left an indelible imprint on the Kansas City metropolitan area, and thereby influenced the design and development of major residential and commercial areas throughout the United States as well. Based on extensive research, J.C. Nichols and the Shaping of Kansas City is a valuable study of one of the most influential entrepreneurs in American land development.
