Book excerpt: Originally published posthumously in 1954, this book presents a study of the unwritten law of the Albanian mountain tribes by the renowned Scottish anthropologist, classical scholar and ethnographer Margaret Hasluck (1885-1948). In recording the legal aspects of tribal life, Hasluck also provides detailed information on the everyday existence of the tribes. Four chapters are given to the vendetta system, describing minutely the obligations of vengeance, the manner of conducting a feud, the degrees of expiation and the ways of ending. Other chapters give information about the daily life of the household; the laws governing the division of property; the administrative hierarchy; oaths, verdicts and penalties; theft and murder. This book will be of value to anyone with an interest in the writings of Hasluck, anthropology and the Albanian mountain tribes.

Available in PDF, EPUB and Kindle. Book excerpt: This book seeks to re-appreciate the concept of customary international law as a form of spontaneous societal self-organisation, and to develop the methodological consequences that ensue from this conception for the practice of its application. In pursuing this aim, the author draws from three different strands of scholarship that have not yet been considered in connection with one another: First, general jurisprudential theories of customary law; second, theories of customary international law, especially as they relate to international relations scholarship; and third, methodological approaches to the interpretation of international law. This expansive, philosophical layout of the book enables the author to put the conceptual enigmas of customary international law into a broader perspective. Among the issues discussed in the book are the dichotomy of its traditional and modern forms and the respective benefits and disadvantages of inductive and deductive approaches to its ascertainment. In the course of this analysis, the author draws insights from Friedrich August Hayek’s theory of law as a ‘spontaneous order’, an information-processing device which enables the participants of a legal system to make use of decentralised knowledge. The book argues that the major advantage of custom as a source of international law lies in the fact that it is the result of a gradual process of trial and error, rather than the product of deliberate planning. This makes it a particularly apposite source of law in a time of seismic shifts in the distribution of power within a vastly diverse community of States, when a new global order is expected to emerge, the contours of which are not yet clearly discernible. This book applies general concepts of legal philosophy to explain the continuing relevance of custom as a source of international law while at the same time inferring from this theoretical framework concrete practical and methodological consequences, the most important of which is the special role that purposive interpretation plays with respect to rules of international custom. Given this broad approach, the book will be of interest to several groups of potential readers including academics interested in the philosophy of customary law in general, academic international lawyers and legal practitioners, especially judges, scholars of international relations and all those interested in how the international community of States organises itself.

Book excerpt: While most financial and investment advice focuses on recent trends, or encourages consumers to buy a favoured product, this book breaks the mould, offering eternal wisdom that draws on years of expensive failures and enviable successes. Following on from the success of James Skakoon's The Unwritten Laws of Business (27,000 copies sold to date), this approachable but thoughtful gem brings together these useful lessons for the first time. Covering everything from reminders of the simplest of truths - 'Patience is a virtue' and 'Better safe than sorry' - to the more troublesome - 'Inflation is the stealthiest of enemies' and 'Guarantees are rarely guaranteed' - each law is presented in an accessible, easily digestible manner, and illustrated with examples. This is essential reading for savers and investors, novices and old hands - and these laws are applicable all around the world.

Available in PDF, EPUB and Kindle. Book excerpt: In the 1870s, a Kentish woman who had been repeatedly beaten by her lover retaliated by blinding him with sulphuric acid. The judge sentenced her to five years in prison. In contrast, a man who put out the eyes of a woman who left him was sentenced to only four months after telling the judge that he `was regularly drove to do it from her aggravation'. Making innovative use of court and police records, Carolyn Conley has written a lively account of criminal justice in Victorian England. She examines the gap between the formal laws and the unwritten law of the community, as well as the ways in which judges, juries, and police officers acted as mediators between the two. The book analyses the treatment of lawbreakers according to class, gender, and community status, and in so doing presents a vivid portrait of standards of propriety and justice at the time.

Book excerpt: Analyzing the workings of boundary maintenance in the areas of anthropology, energy, gender, and law, Nader contrasts dominant trends in academia with work that pushes the boundaries of acceptable methods and theories. Although the selections illustrate the history of one anthropologist’s work over half a century, the wider intent is to label a field as contrarian to reveal unwritten rules that sometimes hinder transformative thinking and to stimulate boundary crossing in others.

Available in PDF, EPUB and Kindle. Book excerpt: A country is policed only to the extent that it consents to be. When that consent is withheld, cops either negotiate or withdraw. Once they do this, however, they are no longer police; their role becomes something far murkier. Several months before they exploded into xenophobic violence, Jonny Steinberg travelled the streets of Alexandra, Reiger Park and other Johannesburg townships with police patrols. His mission was to discover the unwritten rules of engagement emerging between South Africa's citizens and its new police force. In this provocative new book, Steinberg argues that policing in crowded urban space is like theatre. Only here, the audience writes the script, and if the police don't perform the right lines, the spectators throw them off the stage. In vivid and eloquent prose, Steinberg takes us into the heart of this drama, and picks apart the rules South Africans have established for the policing of their communities. What emerges is a lucid and original account of a much larger matter: the relationship between ordinary South Africans and the government they have elected to rule them. The government and its people are like scorned lovers, Steinberg argues: their relationship, brittle, moody, untrusting and ultimately very needy.

Available in PDF, EPUB and Kindle. Book excerpt: This lively book reassesses a century of jurisprudential thought from a fresh perspective, and points to a malaise that currently afflicts not only legal theory but law in general. Steven Smith argues that our legal vocabulary and methods of reasoning presuppose classical ontological commitments that were explicitly articulated by thinkers from Aquinas to Coke to Blackstone, and even by Joseph Story. But these commitments are out of sync with the world view that prevails today in academic and professional thinking. So our law-talk thus degenerates into "just words"--or a kind of nonsense. The diagnosis is similar to that offered by Holmes, the Legal Realists, and other critics over the past century, except that these critics assumed that the older ontological commitments were dead, or at least on their way to extinction; so their aim was to purge legal discourse of what they saw as an archaic and fading metaphysics. Smith's argument starts with essentially the same metaphysical predicament but moves in the opposite direction. Instead of avoiding or marginalizing the "ultimate questions," he argues that we need to face up to them and consider their implications for law.

Available in PDF, EPUB and Kindle. Book excerpt: Contributes to a neglected topic in Irish literary and cultural history--the modes of protest and cultural forms available to the subaltern classes under landlordism. Using the economic writings of figures like John Stuart Mill and George Campbell and such literary works as Emily Lawless's 'Hurrish, ' Heather Laird shows that the so-called unwritten "agrarian code" of popular justice, though often depicted as anarchic and pathological, was pro-social as opposed to anti-social, emanating from an alternative moral code whose very existence undermined the legitimacy of the colonial civil law. The book explores this clash of legal systems and the resulting crisis in law administration.--From publisher's description.
