Available in PDF, EPUB and Kindle. Book excerpt: NEW -- Completely Updated Version for post-March 16, 2016 exams. Covers the MPEP 9th Edition, Revision 07.2015 including AIA, PLTIA, and Hague Agreement material. The Patent Bar Exam Practice Questions manual (Volume I) from Patent Education Series includes approximately 175 current patent bar exam practice exam questions to help you prepare for and pass the Patent Bar. The questions are organized by topic. There are around 35 topics in all. This will ensure you're studying every topic covered on the Patent Bar and hone in on areas you're having difficulty with. Answers are provided for each question, including citations to the MPEP. Taking practice exam questions is a great way to prepare for and pass the Patent Bar Exam. The questions cover the America Invents Act (AIA) and Patent Law Treaties Implementation Act (PLTIA), along with other important must-know topics. This practice exam book contains a mixture of old questions from the USPTO that were freely distributed, new questions that we have created, and old questions that have been considerably updated. If you can get some of these questions free, why should you pay for them? There were several old exams published and distributed freely online by the USPTO and many of these questions have circulated around the Internet. The problem is, out of the questions that were made available, more than half of them are outdated. If you simply take the old exams (which you can still find online) and start studying from them using the currently tested MPEP, you'll be in for a very frustrating experience. Those questions were all created in the early 2000's, therefore they are over ten years old. The PES team has spent hundreds of hours reviewing old exam questions, correcting them, deleting those that no longer apply, updating the MPEP cross referencing in the explanations, and creating new exam questions on new material. Some of the questions in this manual will be similar to questions you see on your exam on test day. However, it's best to use this manual to understand why the correct answer is marked as the best choice, rather than to try to memorize the questions. Learn the material first through careful review of the MPEP or one of our other study aids. Then try your hand at the practice questions in this manual. Get on the road to beginning your career in patent law today."

Available in PDF, EPUB and Kindle. Book excerpt: Scientific and technological innovations are forcing patent law into the spotlight and revealing its many glaring inadequacies. Take, for example, the patent case that almost shut down the BlackBerry, or the growing phenomenon of patent trolling, in which patents are acquired for the sole purpose of entrapping companies whose products relate to them. And patents on genes have everyone up in arms—and our courts confused. Robin Feldman explains why patents are causing so much trouble. The problem lies in our assumption that patents set clear boundaries for rights to an invention. In reality, they do no such thing. The very nature of inventions makes them impossible to describe unambiguously for all time. When something is so new that we do not understand yet how it works, what it is capable of doing, or how it could be applied—as is often the case in biotechnology—description is necessarily slippery. Instead of hoping for clear boundaries, and moaning when we don’t get them, Rethinking Patent Law urges lawmakers to focus on what the law can do well: craft rules that anticipate the bargaining that will occur as rights unfold. By steering clear of laws that distort the bargaining process, lawmakers can help courts answer difficult questions, such as whether genes, software, and business methods constitute patentable subject matter, whether patents in the life sciences should control inventions that have yet to be discovered, and how to resolve the battles between pharmaceutical companies and generics.

Available in PDF, EPUB and Kindle. Book excerpt: In Experiment, Right or Wrong, Allan Franklin continues his investigation of the history and philosophy of experiment presented in his previous book, The Neglect of Experiment. In this new study, Franklin considers the fallibility and corrigibility of experimental results and presents detailed histories of two such episodes: 1) the experiment and the development of the theory of weak interactions from Fermi's theory in 1934 to the V-A theory of 1957 and 2) atomic parity violation experiments and the Weinberg-Salam unified theory of electroweak interactions of the 1970s and 1980s. In these episodes Franklin demonstrates not only that experimental results can be wrong, but also that theoretical calculations and the comparison between experiment and theory can also be incorrect. In the second episode, Franklin contrasts his view of an "evidence model" of science in which questions of theory choice, confirmation, and refutation are decided on the basis of reliable experimental evidence, with that proposed by the social constructivists.

Book excerpt: Body Music reveals the remarkable depth and range of Dennis Lee as a poet and thinker. In eleven ground-breaking essays, Lee explores the experience of body music: the dance of energy from which poems arise. Whether he is discussing rhythm as a form of cosmology, examining children's verse, or probing what it means to worship without belief, his explorations constantly fascinate and entertain. At a time when literary theory can be highly abstract, Body Music is anchored in a writer's working experience. It opens up dramatic new ways to think about words and the world.

Available in PDF, EPUB and Kindle. Book excerpt: Two Top Industry Leaders Speak Out Judith Markowitz When Amy asked me to co-author the foreword to her new book on advances in speech recognition, I was honored. Amy’s work has always been infused with c- ative intensity, so I knew the book would be as interesting for established speech professionals as for readers new to the speech-processing industry. The fact that I would be writing the foreward with Bill Scholz made the job even more enjoyable. Bill and I have known each other since he was at UNISYS directing projects that had a profound impact on speech-recognition tools and applications. Bill Scholz The opportunity to prepare this foreword with Judith provides me with a rare oppor- nity to collaborate with a seasoned speech professional to identify numerous signi- cant contributions to the field offered by the contributors whom Amy has recruited. Judith and I have had our eyes opened by the ideas and analyses offered by this collection of authors. Speech recognition no longer needs be relegated to the ca- gory of an experimental future technology; it is here today with sufficient capability to address the most challenging of tasks. And the point-click-type approach to GUI control is no longer sufficient, especially in the context of limitations of mode- day hand held devices. Instead, VUI and GUI are being integrated into unified multimodal solutions that are maturing into the fundamental paradigm for comput- human interaction in the future.
