The response of the government at Westminster was a declaration of martial law in the south and west of Ireland, placing the courts and civil authorities under the control of the army, and also converting a number of non-capital charges into offenses punishable by death. The army then set up its own courts to bring to trial and to punish those who contravened martial law. The lower tier of the military court sent 549 people to prison and recommended many others for internment. The upper tier of the court tried 128 people. 37 men were sentenced to death, of which 14 were executed. Many others received long sentences of imprisonment. Book excerpt: In March 1913, labor agitator Mary Harris "Mother" Jones and forty-seven other civilians were tried by a military court on charges of murder and conspiracy to murder—charges stemming from violence that erupted during the long coal miners' strike in the Paint Creek and Cabin Creek areas of Kanawha County, West Virginia. Immediately after the trial, some of the convicted defendants received conditional pardons, but Mother Jones and eleven others remained in custody until early May. This arrest and conviction came in the latter years of Mother Jones's long career as a labor agitator. Eighty-one and feisty as ever, she was able to focus national attention on the miners' cause and on the governor's tactics for handling the dispute. Over the course of seven months, more than two hundred civilians were tried by courts-martial. Only during the Civil War and Reconstruction had the courts been used so extensively against private citizens, and the trial raised a number of civil rights issues. The national outcry over Mother Jones's imprisonment led the United States Senate to appoint a subcommittee to examine mining conditions in West Virginia—the first Senate subcommittee ever appointed to investigate a labor controversy. Public sentiment eventually forced a release of the prisoners and brought about a settlement of the strike. In the face of this overwhelmingly adverse publicity, the governor suppressed publication of the trial transcript, and it was long thought to have been destroyed. Edward M. Steel Jr., an authority on Mother Jones, uncovered the trial proceedings while searching for Jones's manuscripts amid private papers at the West Virginia and Regional Collection. This volume makes available for the first time the transcript of this landmark case in labor and legal history, including an introduction that provides background on the issues involved.

Book excerpt: After the Rebellion, came the trials. 3,226 men and women were rounded up and brought to Richmond Barracks in Dublin, where they were screened for trial, deportation or release. In the following three weeks of May 1916 nearly 2,000 men and women were deported and interned. 160 prisoners were tried by Field General Courts Martial. These trials were held in camera - no press or public were admitted. None of the prisoners were legally represented or permitted to give sworn evidence in their own defence. Most trials lasted about 20 minutes or less. 90 death sentences were passed and 15 were carried out. This book provides a powerful analysis of an uncomfortable moment in history when the rule of law gave way to political imperatives. The trials and executions took place while the outcome of the Great War hung in the balance. The government judged that publication of the trial records would damage army recruitment and the war effort, so the trial records were suppressed and most were thought to have been destroyed. But since the turn of the century more and more trial records have surfaced, casting dramatic new insights into what took place. This book, the companion to The Trial of Civilians by Military Courts: Ireland 1921, is a fascinating and comprehensive study of the trials which proved to be a pivotal event in Anglo-Irish history.

There is no doubt that appalling crimes have occurred here. Over a million people have been forced to live in overcrowded displacement camps under the control of the Ugandan army. Joseph Kony's Lord's Resistance Army has abducted thousands, many of them children and has systematically tortured, raped, maimed and killed. Nevertheless, the ICC has confronted outright hostility from a wide range of groups, including traditional leaders, representatives of the Christian Churches and non-governmental organizations. Even the Ugandan government, which invited the court to become involved, has been expressing serious reservations. Tim Allen assesses the controversy. Milligan and his coconspirators in Indiana of fomenting a general insurrection and sentenced them to hang. On appeal, in Ex parte Milligan the US Supreme Court sided with the conspirators, ruling that it was unconstitutional to try American citizens in military tribunals when civilian courts were open and functioning—as they were in Indiana. Far from being a relic of the Civil War, the landmark 1866 decision has surprising relevance in our day, as this volume makes clear. Cited in four Supreme Court decisions arising from the wars in Afghanistan and Iraq, Ex parte Milligan speaks to constitutional questions raised by the war on terror; but more than that, the authors of Ex parte Milligan Reconsidered contend, the case affords an opportunity to reevaluate the history of wartime civil liberties from the Civil War era to our own. After the Civil War, critics of Reconstruction pointed to Milligan as an example of the Republican Party’s abuse of federal power; even historians sympathetic to Lincoln have found it necessary to apologize for his administration’s record on civil liberties during the Civil War. However, the authors of this volume argue that this distorts the nineteenth-century understanding of the Bill of Rights, neglects international law entirely, and, equally striking, ignores the experience of African Americans. In reviving Milligan, the Supreme Court has implicitly cast Reconstruction as a “war on terror” in which terrorist insurgencies threatened and eventually halted the assertion of black freedom by the Republican Party, the Union Army, and African Americans themselves. Returning African Americans to the center of the story, and recognizing that Lincoln and Republicans were often forced to restrict white civil liberties in order to establish black civil rights and liberties, Ex parte Milligan Reconsidered suggests an entirely different account of wartime civil liberties, one with profound implications for US racial history and constitutional law in today’s war on terror.

The bloody deeds of December 17, 1944, produced the most controversial war crimes trial in American history. Drawing on newly declassified documents, Steven Remy revisits the massacre—and the decade-long controversy that followed—to set the record straight. After the war, the U.S. Army tracked down 74 of the SS men involved in the massacre and other atrocities and put them on trial at Dachau. All the defendants were convicted and sentenced to death or life imprisonment. Over the following decade, however, a network of Germans and sympathetic Americans succeeded in discrediting the trial. They claimed that interrogators—some of them Jewish émigrés—had coerced false confessions and that heat of battle conditions, rather than superiors’ orders, had led to the shooting. They insisted that vengeance, not justice, was the prosecution’s true objective.
