Neoliberalism in the postcommunist countries went farther and lasted longer than expected, but why? Unlike pre-existing theories based on domestic political-economic struggles, this book focuses on the imperatives of re-insertion into the international economy. Appel and Orenstein show how countries engaged in 'competitive signaling', enacting reforms in order to attract foreign investment. This signaling process explains the endurance and intensification of neoliberal reform in these countries for almost two decades, from 1989–2008, and its decline thereafter, when inflows of capital into the region suddenly dried up. Book excerpt: Detailed research on the UN Model Convention’s unique features The UN Model Convention has a significant influence on international tax treaty practice and is especially used by emerging and developing countries as a starting point for treaty negotiations. Driven by the aim to achieve consistency in the international tax treaty practice, the structure and content is, to a large extent, similar in the UN Model and the OECD Model. However, whereas the OECD has historically focused its efforts on issues mainly relevant for developed countries, the UN Tax Committee has continuously attempted to specifically take into account tax treaty policies for developing countries when drafting and amending the UN Model Convention. Compared to the OECD Model Convention, the UN Model Convention aims at giving more weight to the source principle. Popular examples are the PE definition in the UN Model which provides for a lower threshold than Article 5 of the OECD Model or Article 12A on Fees for Technical Services which has been introduced with the latest amendment of the UN Model Convention 2017 and allows for a withholding tax to be levied on payments to non-residents when the payer of the fee is a resident of that contracting State irrespective of where the services are provided. Interestingly, in the discussions of the tax challenges arising from the digitalization of the economy, the OECD and the G20 are also exploring options to allocate more taxing rights to the jurisdiction of the customer and/or user, i.e., the ‘market jurisdictions’. As this has traditionally been the focus of the UN Model Convention, its unique features and developing countries’ practices could be taken into account when exploring new nexus rules that are not constrained by the physical presence requirement. This book contains the master’s theses of the full-time LL.M. program 2018-2019 for which ‘Special Features of the UN Model Convention’ has been chosen as the general topic. With this book, the authors and editors do not aim at discussing each article of the UN Model Convention but rather focus on the unique features of the UN Model Convention, which are explored in detail. This is supplemented with an evaluation of the function and relevance of the UN Tax Committee in the international tax policy discussion and with an analysis of the influences of the OECD's BEPS project on the UN Model.he OECD's BEPS project on the UN Model.

What kind of change is required in local communities to conserve biocultural diversity? On the issue of commodity flow, research results of the supply-chain network, isolation in industry, and resource flows and stocks are presented in this book. For monetary flow, ownership networks, value-added networks, and profit shifting were studied; and regarding the flow of people, linkage of ethnic groups, immigrant assimilation, and refugees were examined. Based on the resulting view of globalization and isolation, the development of the isolation index using machine learning is discussed. Finally, recommendations for evidence-based policymaking in the United Nations are considered.

Book excerpt: Although the empirical literature has long struggled to identify the impact of taxes on corporate financial structure, a recent boom in studies offers ample support for the debt bias of taxation. Yet, studies differ considerably in effect size and reveal an equally large variety in methodologies and specifications. This paper sheds light on this variation and assesses the systematic impact on the size of the effects. We find that, typically, a one percentage point higher tax rate increases the debt-asset ratio by between 0.17 and 0.28. Responses are increasing over time, which suggests that debt bias distortions have become more important.

Book excerpt: Path to Capacity Innovation: An Africa-MNC Strategic Alliance, a policy framework is advanced proposing a strategic alliance between African countries -represented by NEPAD- and the multinational corporation with input from the NGO and couched upon an NEPAD-MNC-NGO cross-fertilizing integrative structure. Capacity innovation is the key to Africa's transformation: with the appropriate catalysts, innovation and transformation are but a matter of time in gestation. The first of two major catalysts necessary to prompting this change so long sought by Africans came at the adoption of the New Partnership for Africa's Development. It is one of the most profound collaborations of African Heads of State. The second catalyst is proposed in this work in the form of the multinational corporation as change agent for the innovation process working in alliance with NEPAD as Africa's spokesperson for innovation. The policy framework for African capacity innovation is the material product along with discourse for redress of corruption and security policy narrative for protecting the assets of multinational corporations.Bringing Forth Prosperity: Capacity Innovation in Africa questions capital theory as a development construct and an appropriate platform upon which sustained capacity innovation in Africa may emerge; explores Africa's road to modernity in the context of selected development constructs and assesses capacity innovation from a top down-bottom up perspective purposely to serve as backdrop to the Africa-MNC strategic alliance framework; constructs country capacity ID to identify internal resources available to African countries to support capacity innovation; conceptualizes the Africa-MNC strategic alliance to convey a capacity innovation philosophy; articulates an African capacity innovation policy framework to guide the Alliance through a series of actions designed to prompt innovation activity and set the continent on a course to sustained transformation; and articulates a scheme to protect assets -human and physical- derived through the Africa-MNC strategic alliance.
