Excerpt: ...ground that the predicate was not sufficiently laid; that is, that suflicient search had not been made for the original in the places where it might be found, before resort was had to secondary evi-' dence. It appears from the bill that search and inquiry was made in the clerk's oflice and among his papers. The bill also makes it appear that the former district attorney, C. D. Spann, was the last person seen in possession of said mortgage during the former trial of the case; and Spann was not brought before the court, and no inquiry was made of him as to the whereabouts of said. original mortgage. In lieu of having Spann before the court, the State was permitted to prove by a witness that at a former trial of the case, said Spann, then district attorney, when on the witness stand made a statement in regard to the mortgage; that said Spann, at-a previous trial of the case, had the mortgage, which was the last time witness saw it; that Spann was present and represented the State at the second trial; and pending the proving up of the loss of the mortgage, Spann was put on the wit _ness stand, and the State inquired of Spann for the mortgage. The mortgage was not found at said second trial. The last time witness heard of Spann he was alive and well and in this State. This was an adroit method of getting before the court and jury the fact that Spann did not have the mortgage, but the testimony was hearsay. If the State could prove what it did, it could have gone further and proved all that Spann said about the loss of the mortgage at the trial.
