It is best known for helping states pay for cash welfare for needy families with children, but it funds a wide array of additional activities. TANF was created in the 1996 welfare reform law (P.L. 104-193). TANF funding and program authority were extended through FY2010 by the Deficit Reduction Act of 2005 (DRA, P.L. 109-171). TANF provides a basic block grant of $16.5 billion to the 50 states and District of Columbia, and $0.1 billion to U.S. territories. Additionally, 17 states qualify for supplemental grants that total $319 million. TANF also requires states to contribute from their own funds at least $10.4 billion for benefits and services to needy families with children -- this is known as the maintenance-of-effort (MOE) requirement. States may use TANF and MOE funds in any manner "reasonably calculated" to achieve TANF's statutory purpose. This purpose is to increase state flexibility to achieve four goals: (1) provide assistance to needy families with children so that they can live in their own homes or the homes of relatives; (2) end dependence of needy parents on government benefits through work, job preparation, and marriage; (3) reduce out-of-wedlock pregnancies; and (4) promote the formation and maintenance of two-parent families. Though TANF is a block grant, there are some strings attached to states' use of funds, particularly for families receiving "assistance" (essentially cash welfare). States must meet TANF work participation standards or be penalised by a reduction in their block grant. The law sets standards stipulating that at least 50% of all families and 90% of two-parent families must be participating, but these statutory standards are reduced for declines in the cash welfare caseload. (Some families are excluded from the participation rate calculation.) Activities creditable toward meeting these standards are focused on work or are intended to rapidly attach welfare recipients to the workforce; education and training is limited. Federal TANF funds may not be used for a family with an adult that has received assistance for 60 months. This is the five-year time limit on welfare receipt. However, up to 20% of the caseload may be extended beyond the five years for reason of "hardship", with hardship defined by the states. Additionally, states may use funds that they must spend to meet the TANF MOE to aid families beyond five years. TANF work participation rules and time limits do not apply to families receiving benefits and services not considered "assistance". Child care, transportation aid, state earned income tax credits for working families, activities to reduce out-of-wedlock pregnancies, activities to promote marriage and two-parent families, and activities to help families that have experienced or are "at risk" of child abuse and neglect are examples of such "nonassistance".

TANF Funding. TANF provides fixed funding to states, the bulk of which is provided in a $16.5 billion-per-year basic federal block grant. States are also required in total to contribute, from their own funds, at least $10.4 billion under a maintenance-of-effort (MOE) requirement. Federal and State TANF Expenditures. Though TANF is best known for funding cash assistance payments for needy families with children, the block grant and MOE funds are used for a wide variety of benefits and activities. In FY2013, expenditures on basic assistance (cash assistance) totaled $8.7 billion-28% of total federal TANF and MOE dollars. TANF also contributes funds for child care and services for children who have been, or are at risk of being, abused and neglected. Cash Assistance Caseload. A total of 1.7 million families, composed of 4.0 million recipients, received TANF- or MOE-funded cash in December 2013. The bulk of the "recipients" were children-3.0 million in that month. The cash assistance caseload is very heterogeneous. The type of family historically thought of as the "typical" cash assistance family-one with an unemployed adult recipient-accounted for less than half of all families on the rolls in FY2011. Additionally, 15% of cash assistance families had an employed adult, while 4 in 10 families had no adult recipient. Child-only families include those with disabled adults receiving Supplemental Security Income (SSI), adults who are nonparents (e.g., grandparents, aunts, uncles) caring for children, and families consisting of citizen children and ineligible noncitizen parents. Cash Assistance Benefits. TANF cash benefits are set by states. In July 2012, the maximum monthly benefit for a family of three ranged from $923 in Alaska to $170 in Mississippi. Benefits in all states represent a fraction of poverty-level income. In the median jurisdiction (North Dakota), the maximum monthly benefit of $427 for a family of three represents 27% of poverty-level income. Cash Assistance Work Requirements. TANF requires states to engage 50% of all families and 90% of two-parent families in work activities. However, these standards are reduced by the amount of a state's caseload reduction from FY2005. Further, states may get an extra credit against these standards by spending more than required under the TANF MOE. Therefore, the effective standards states face are often less than the 50% or 90% targets, and vary by state. In FY2011, states achieved an all-family participation rate of 29.5% and a two-parent rate of 32.0%. That year, nine jurisdictions failed the all-family standard, and five jurisdictions failed the two-parent standard. States that fail to meet work standards are at risk of being penalized by a reduction in their block grant.

Book excerpt: Throughout the history of social assistance programs, administrators have attempted to limit access only to those families considered "worthy" of assistance. Policies about worthiness have included both judgments about need-generally tied to income, demographic characteristics, or family circumstances-and judgments about moral character, often as evidenced by behavior. Past policies evaluating moral character based on family structure have been replaced by today's policies, which focus on criminal activity, particularly drug-related criminal activity. The existing crime and drug-related restrictions were established in the late 1980s through the mid-1990s, when crime rates, especially drug-related violent crime rates, were at peak levels. While crime rates have since declined, interest in expanding these policies has continued. The three programs examined in this report-the Temporary Assistance for Needy Families (TANF) block grant, the Supplemental Nutrition Assistance Program (SNAP, formerly Food Stamps), and federal housing assistance programs (public housing and Section 8 tenant and project-based assistance)-are similar, in that they are administered at the state or local level. They are different in the forms of assistance they provide. TANF provides cash assistance and other supports to low-income parents and their children, with a specific focus on promoting work. SNAP provides food assistance to a broader set of poor households including families with children, elderly households, and persons with disabilities. The housing assistance programs offer subsidized rental housing to all types of poor families, like SNAP. All three programs feature some form of drug- and other crime-related restrictions and all three leave discretion in applying those restrictions to state and local administrators. Both TANF and SNAP are subject to the statutory "drug felon ban," which bars states from providing assistance to persons convicted of a drug-related felony, but also gives states the ability to opt-out of or modify the ban, which most states have done. Housing assistance programs are not subject to the drug felon ban, but they are subject to a set of policies that allow local program administrators to deny or terminate assistance to persons involved in drug-related or other criminal activity. Housing law also includes mandatory restrictions related to specific crimes, including sex offenses and methamphetamine production. All three programs also have specific restrictions related to fugitive felons. Recently, the issue of drug testing in federal assistance programs has risen in prominence. In the case of TANF, states are permitted to drug-test recipients; however, state policies involving suspicionless drug testing of TANF applicants and recipients are currently being challenged in courts. SNAP law does not explicitly address drug testing, but given the way that SNAP and TANF law interact, state TANF drug testing policies may affect SNAP participants. The laws governing housing assistance programs are silent on the topic of drug testing. The current set of crime- and drug-related restrictions in federal assistance programs are not consistent across programs, meaning that similarly situated persons may have different experiences based on where they live and what assistance they are seeking. This variation may be considered important, in that it reflects a stated policy goal of local discretion. However, the variation may also be considered problematic if it leads to confusion among eligible recipients as to what assistance they are eligible for or if the variation is seen as inequitable. Proposals to modify these policies also highlight a tension that exists between the desire to use these policies as a deterrent or punishment and the desire to support the neediest families, including those that have ex-offenders in the household.

States have broad discretion over the use of these funds. In FY2009, the most recent year for which expenditure data are available, the largest expenditures for services under the SSBG were for child care, foster care, and special services for the disabled. The FY2012 Consolidated Appropriations Act (H.R. 2055, P.L. 112-74) provided $1.7 billion for the SSBG in FY2012, the same level of funding as had been requested in the FY2012 President's Budget. This is also the same level of annually appropriated funding that the SSBG has received in every year since FY2002. Since FY2001, annual appropriations for the SSBG have included a provision stipulating that states may transfer up to 10% of their Temporary Assistance for Needy Families (TANF) block grants to the SSBG. In addition to funding from annual appropriations, the SSBG received supplemental appropriations in FY2006 and FY2009 for necessary expenses resulting from natural disasters. The FY2013 President's Budget, released by the Obama Administration in February 2012, proposed to maintain annual SSBG funding at $1.7 billion. FY2013 appropriations have yet to be enacted, but both the Senate Appropriations Committee-reported bill (S. 3295, S.Rept. 112-176) and the draft bill approved by the House Appropriations Subcommittee on Labor, Health and Human Services, Education, and Related Agencies would maintain level funding for the SSBG. By contrast, the Sequester Replacement Reconciliation Act of 2012 (H.R. 5652) includes a provision that, if enacted, would repeal the SSBG, effective October 1, 2012. This budget reconciliation bill was agreed to in the House on May 10, 2012, by a vote of 218-199. However, the Senate has not taken up the measure. The House Budget Committee report accompanying the reconciliation bill (H.Rept. 112-470) calls the SSBG a duplicative funding stream that lacks focus and accountability. Those with dissenting views argue that the block grant's flexibility allows states to address the needs of vulnerable populations and respond to local concerns. Prior to the introduction of the reconciliation bill, the House Budget Committee report (H.Rept. 112-421) accompanying the House-passed concurrent resolution on the FY2013 budget (i.e., the House budget resolution for FY2013, H.Con.Res. 112) had included a recommendation that the SSBG be eliminated in FY2013. Under current law, the SSBG is permanently authorized in Title XX of the Social Security Act (SSA). The 111th Congress amended Title XX of the SSA in the health care reform legislation signed into law by President Obama on March 23, 2010, the Patient Protection and Affordable Care Act (PPACA; P.L. 111-148). This law inserted a new subtitle on elder justice into Title XX, which was itself re-titled as Block Grants to States for Social Services and Elder Justice. The health reform law also amended Title XX by establishing two demonstration projects to address the workforce needs of health care professionals and a new competitive grant program to support the early detection of medical conditions related to environmental health hazards. The purpose of this report is to provide background and funding information about the SSBG; the report does not provide detailed information on other programs authorized within Title XX of the SSA.

Statistical Issues in Allocating Funds by Formula
