Excerpt: ... incorporated religious sects, all of which is inconsistent with the principles of the constitution and of religious freedom and manifestly tends to the establishment of a national Church"; it then repeals all these laws."0 This caused all the property in any way held by Episcopal Church organization to revert to the public rise, unless for some special reason retained. Affairs remained in this condition until the session of 1801, when the Legislature returned to the charge and on January 12, 1802, passed a bill directing the overseers of the poor to sell the glebes for the benefit of the public. The preamble to this bill sets forth that " the General Assembly on the twenty-fourth day of January, 1799, by their act of that date, repealed all the laws relative to the late Protestant Episcopal Church, and declared a true exposition of the principles of the bill of rights and constitution respecting the same to be contained in the act entitled 'An act for establishing religious freedom' (Jefferson's law of 1785); thereby recognizing the principle that all property formerly belonging to the said Church, of every description, devolved on the good people of this Commonwealth on the dissolution of the British government here in the same degree in which the right and interest of the said Church was therein derived from them; and that although the General Assembly had the right to authorize the sale of all such property indiscriminately, yet being desirous to reconcile all the good people of this Commonwealth, it was deemed inexpedient at that time to disturb the possession of the present incumbents." In his latest book, Thomas Buckley tells the story of the statute, beginning with its background in the struggles of the colonial dissenters against an oppressive Church of England. When the Revolution forced the issue of religious liberty, Thomas Jefferson drafted his statute and James Madison guided its passage through the state legislature. Displacing an established church by instituting religious freedom, the Virginia statute provided the most substantial guarantees of religious liberty of any state in the new nation. The statute's implementation, however, proved to be problematic. Faced with a mandate for strict separation of church and state--and in an atmosphere of sweeping evangelical Christianity--Virginians clashed over numerous issues, including the legal ownership of church property, the incorporation of churches and religious groups, Sabbath observance, protection for religious groups, Bible reading in school, and divorce laws. Such debates pitted churches against one another and engaged Virginia’s legal system for a century and a half. Fascinating history in itself, the effort to implement Jefferson’s statute has even broader significance in its anticipation of the conflict that would occupy the whole country after the Supreme Court nationalized the religion clause of the First Amendment in the 1940s.

William Wirt Henry, which forced me to search for and examine for myself all available original sources of information concerning the struggle for religious liberty in Virginia. There had been manifested at various times and on various occasions a disposition to rewrite the history of that struggle, and to rob our Baptist fathers of the peculiar honor which has ever been claimed for them - that of being the foremost, most zealous, and most consistent and unwavering champions of soul liberty. And not a few of our own young brethren were beginning to question the soundness of that claim, and to count as " Baptist brag" much that was spoken on the platform and published in our newspapers during the "Memorial Campaign" of 1873. Hence, to satisfy my own mind, I determined to go hack of Howell's "Early Baptists of Virginia," to the sources from which he and others had drawn their information-to the Journal of the Virginia House of Burgesses, or General Assembly, and to the writings of those who participated in the struggle. Being convenient to the Congressional Library, in Washington, and our State Library, in Richmond, I seized every opportunity, during the remainder of my stay in Culpeper, to gather from all sources the evidence in this case. I copied everything of value which I could find, making note of book and page, and arranged the material for future use.
