Book excerpt: Excerpt from The Right of Sanctuary in England: A Study in Institutional History Owing to the early Christianizing of Britain it is not at all improbable that the right of church asylum existed in England long before the coming of the Saxons and their sub sequent conversion. By some of the mediaeval chroniclers the practice of allowing churches to shelter and protect fugitives is ascribed to a mythical British king, Lucius, who is sup posed to have ruled Britain in the second 'c-entury. But this early period of British history is so obscure, so mythical, and so legendary, that no sure footing for the historian can be found in it, and though the practice of taking sanctuary in churches may have existed amongst the early British Chris tians, and in all probability did exist, we have no definite or trustworthy record of the fact. Indeed, it is not until the be ginning of the seventh century that we find any mention of the right of churches in England to afford protection to fugi tives within their walls. It is commonly held that this practice virtually died out after the medieval period, but Shannon McSheffrey highlights its resurgence under the Tudor regime and shows how the issue lay at the intersection between law, religion, and culture.

THE RIGHT OF SANCTUARY IN THE ENGLISH TRADITION takes the reader on a historical, criminal, and legal odyssey through the ancient practice of sanctuary, which was granted to fugitives fleeing from justice, by Catholic churches in England, during the Middle Ages. The book begins with a discussion of the origin of sanctuary, being rooted in the six Levitical cities of the Old Testament, and continuing through the Middle Ages and beyond. The author does a great job of handling the difficult historical landscape, giving a summary that shows how sanctuary rights have changed in interesting and amazing ways. The author skillfully examines the history of sanctuary in England's criminal justice system, covering the period from the 7th century, through the reign of Henry VIII and James I. The book is essentially a legal journey, which explains how the customs, traditions, and laws governing the practice of sanctuary morphed into modern laws, which govern asylum, diplomatic immunity, and other aspects of international law. The book also invites readers to reflect on the never-ending search for justice, truth, and individual rights, while skillfully bridging the gap between the Old Testament and contemporary world affairs.

Available in PDF, EPUB and Kindle. Book excerpt: Sanctuary law has not received very much scholarly attention. According to the prevailing explanation among earlier generations of legal historians, sanctuary was an impediment to effective criminal law and social control but was made necessary by rampant violence and weak political order in the medieval world. Contrary to the conclusions of the relatively scant literature on the topic, Sanctuary and Crime in the Middle Ages, 400-1500 argues that the practice of sanctuary was not simply an instrumental device intended as a response to weak and splintered medieval political authority. Nor can sanctuary laws be explained as simple ameliorative responses to harsh medieval punishments and the specter of uncontrolled blood-feuds. --

Book excerpt: Winner of the 2018 British Society of Criminology Book Prize Britain is often heralded as a country in which the rights and welfare of survivors of conflict and persecution are well embedded, and where the standard of living conditions for those seeking asylum is relatively high. Drawing on a decade of activism and research in the North West of England, this book contends that, on the contrary, conditions are often structurally violent. For survivors of gendered violence, harm inflicted throughout the process of seeking asylum can be intersectional and compound the impacts of previous experiences of violent continuums. The everyday threat of detention and deportation; poor housing and inadequate welfare access; and systemic cuts to domestic and sexual violence support all contribute to a temporal limbo which limits women’s personal autonomy and access to basic human rights. By reflecting on evidence from interviews, focus groups, activist participation and oral history, Gendered Harm and Structural Violence provides a unique insight into the everyday impacts of policy and practice that arguably result in the infliction of further gendered harms on survivors of violence and persecution. Of interest to students and scholars of criminology, zemiology, sociology, human rights, migration policy, state violence and gender, this book develops on and adds to the expanding literatures around immigration, crimmigration and asylum.
